Apple is under no obligation to apply version 3. They already have the software they need on the iPhone, and they can just keep using what was covered under version 2 and not bother with any changed that fall under the scope of the license change.
Who cares if they deserve it? Reading these stories is like listening to a three year old whine about not getting candy.
Fortunately for me, I enjoy that sort of thing.

The market is perfectly free. It's just expensive to provide the service. I personally think the government should take it over. I'd have a never-ending stream of laughs at how badly they would bobble the whole thing.
The last oddity was that a store employee was stationed by the door and was locking and unlocking the door as people would enter and exit. I pointed out to them (on the way out - I'm no fool) that the fire marshal would have a fit if he caught them doing that. Crowd control is understandable, but locking the only means of egress from a retail space when customers are present is a bit of a no-no. "If you're flammable and have legs, you are never blocking a fire exit."
