The proper way to regulate cell phones is for buisnesses and private properties to develop policies, and post them. Most theaters I go to have signs that say "turn off cell phones". If someone does not, they get thrown out. It is simple. Or, if you want to be savvy, you can set your cell phone to vibrate, when it goes off you can quickly see the caller id, and if it is important you leave and go to a washroom or step outside. What's the problem?

Let's use the home metaphor - you live in a house in a neighbourhood built by "MS Homes". They are nice, comfortable homes, but the security system involves closing your front door with a plastic latch. Because the latch doesn't LOOK like plastic, everyone feels secure. Burglars, however, suspect there is an easy way in to the homes.
Now, if none of the good guys examine the security and say, "Hey, maybe these latches should be steel", then eventually a bad guy will figure it out and your home is open for business.
In such an event, if a good guy opened *a* front door on a *single* MS home, then posted a note in the local newpaper that maybe latches should be upgraded, I'd sleep with a shotgun until my latch was replaced. Not true. Government should not have access to those records without a court order. So those records are private. If a company gives out your credit card data to someone, and you did not allow for that or sign for that, they have violated privacy laws. The only reason they give out that data is because you allow them to, read any credit card application. The problem is nobody reads those dang things and the credit card companies can get away with anything. If my bank can get me to pay 2 dollars to use an ATM, and everyone fought against them and lost, then imagine what your bank can do when you do not even know it. You have to read all those legal documents and respond.
The reason you feel like there is no privacy is because you never challenge these institutions. Did you ever write a letter to your bank telling them you do not allow any release of private information, that you do not want them selling your data to third companies? This might be why some people open bank accounts in the Cayman Islands. They are not terrorists, they just do not want information being shared with third parties unless they explicitly agree. Why don't banks here say they will not sell your personal information?
