Open Standards is a great idea... The problem is all those companies and organizations that are not at all willing to drop the profits they make by maintaining and selling standards. This also holds for the organizations that maintain the standards and selling them is the only way to cover their expenses and functional costs.
Of course W3C is a bright exception to the above example. But then again its only an exception.
I see your point, but that's exactly what search engines are for, right? I mean, after all, if you 've got an adult site, you want traffic, don't you? If such a site is indexed in a search engine it means profit for the owners...
On the other hand, If they wanted to protect copyrighted material, they should just read the manuals and find out how to do it...

Anyway, i think everyone should carefully read the EULAs before buying or using MS products. It's not that I support MS, but since you buy a product whose EULA specifically states that the product still belongs to MS and that you do not have the right to alter it, then the MS can do what it wants with it, whether it is right or not.
The same holds for the MS services as well... take as an example the Hotmail EULA...
The solution to the MS problem is rather simple... read the EULA carefully and don't buy the product if you feel the license violates your rights (which should be the case for almost every MS product)
How can anyone get an IP for code? I mean, if this was true, we all should pay IP for writing single linked lists:)
Or even better i could patent some basic data structures (linked lists, trees, etc) and get everyone pay me for using them:)
