The video features about 5 minutes of steady slaughter of civilians in an airport by a CIA agent controlled by the player. This isn't "civilians caught in the crossfire" but rather wholesale murder of defenseless crowds.
That being said, I despise censorship, so I have no real problem with this game.
The makers of proprietary software force you to agree to a massive, complicated license before you can use their products because they want to control and restrict what you can do. Let's not pretend that GPL software is any different.

I got an iphone, its jail broken, and I love it. I also run OSX, but I built it from scratch, and didn't pay apple a dime. At some point you stop caring about what other people think about your choices in phones / operating systems and just use what you want.
Actually you are incorrect. While the most common "jailbreak" doesn't mess with the baseband software, there are plenty of people who do. Think sim/carrier unlocks and the 911 piggyback hack to make calls without a sim at all.
I think he is referring to the growing trend of police/themselves/ believing you cant film them or take pictures of them. I don't know how many times I have seen video of cops confiscating cameras and or arresting civilians for taking pictures of them.
