Although your point is a very good one, what if they change their policies or no longer offer certain tracks, you happen to be incorrect on one point: they still offer DRMed WMA"s.

They are now calling it "Napster to Go". It's $14.95 a month. It's the same old Napster service as was offered under the old owners. (I don't know about your Japanese music, with the new addition that WMA-compliant players can play the music. (This excludes Zune. But Creative and many others make players that are compatible.)

Napster is pushing un-DRMed MP3's because that is what the market wants.

  6. Fact check: None of the music anywhere has DRM on DoJ Defends $1.92 Million RIAA Verdict · · Score: 1

I used to be uninformed on this topic, but whereever you buy it, it's all DRM-free. Variable pricing has arrived, but you can get 5 tracks to keep at Napster for $5/month, and that includes listening to the song an unlimited number of times before you buy it. Or Lala.com, where you can listen to a song 3 times before buying it for 10 cents for a streaming version or a maximum of a $1.29 for a 256kbps MP3. I personally think the AACs Apple sells sound better.

Microsoft's Zune also is mostly DRM-free now, I think. There is even one subscription music service with some major label content that is DRM-free though I can't remember the name of it.

Part of the reason lawyers work is that they can keep things confidential. That means you do not wiretap their phones.
