  1. Re:Cut/paste on Nintendo Warns MMO Company Over Trademark Issues · · Score: 1

I seriously hope Nintendo loses this one. They have no right to say anything from what I've seen. First off, you can not copyright/trademark/whatever an art style! If this were so, then ID could sue any game company using demons in a first person shooter... "oh look! there's an upside down pentagram!!! ...yep, definitely a rip off of doom! And look! There's an ammo counter in the bottom..." NO! If Nintendo won this battle, it would be a great stumbling block for any other game creators. As a character designer, I can see just as many differences as there are similaities in this one possible character instance. No, his hair is not the same, height and body shape do matter. The thing is that Link is not a very original character to begin with and a pretty vague design at that. It may be a slight rip-off in style but didn't DiVinci say "A good artist borrows, a great artist steals"? There is no such thing as an original idea...

Technically the name Zelda Online should be fine for anyone to release. The name "Zelda" was not invented by Nintendo and may not be common, but has been used by many people long before Nintendo opened their doors. Not only that but Nintendo has never released a game called "Zelda", it is called "The Legend of Zelda"...so technically, anyone could release a game called Zelda Online if they wanted.

Ok, first with you communist shtick there...umm, do you even know what communism means? Do you know the pros and cons of it? If you knew anything about this word you threw out so quickly in a communist country most likely all the products would be made by that country. Do you think China buys many American products? I could go on, but I'll let you look it up yourself...

Second off, and yes this is emotional... The game industry is a big piece of shit right now. There are maybe 1 in 50 games worth giving a second glance...let alone playing. I think the movie industry right now, might have a better quality:crap ratio going for it than the game industry. Where does the innovation in other media usually come from? A SMALL independent writer/director/artist, or "developer" in this case. And, excuse me with the math here...but you don't see Microsoft's 90% or more market share as a monopoly? How many hotels do you have to put on boardwalk in your version?

Now that that's out of the way.... The US gov't is in a much worse state right now than any of that, so I doubt they'll step in and break up any "monopoly's" here anytime soon. As an aspiring game designer...I can only hope there are enough people who actually care enough to give us little guys a chance in the future. I for one, will not be selling my soul, nor game company, to EA or any of the other overgrown publishers anytime soon.

"Publishers are people who burn CDs and slap a logo on the developer's hardwork."

That's the way it's supposed to work...but unfortunately it doesn't. Most publishers try to own the game they're publishing and make all the decisions for the publisher. There's a new company, 03 entertainment, that actually just publishes and that's it. This is wonderful for independent developers who don't want to sell their souls to EA and the like...

Am I alone in saying that I don't really see such a big problem here as the article would make out? W3C supports HTML and XHTML..... why can't it support both XForms and Forms 2.0? Just have both....use the Forms 2.0 for backward compatible and transition until people are ready to use Xforms instead..... I see Forms 2.0 as a midway point between current forms and Xforms....these things always take time, and remember people, these are standards, not requirements! Let's not give MS something they can use to say "ha! you should have used our proprietary standards....those 'open' guys can't make up their minds!" That's not a good situation for anyone, not even Microsoft if they would use a little foresight.

These "hot-hardware" guys obviously don't know much about computers to be testing 64bit chips in Windows. 64bit Windows XP will probably come out AFTER Longhorn....they are a long way away from figuring it out. Linux (and maybe BSD?) is the only way to really get an accurate test of these chips....sure running "legacy" 32bit apps is worth a look, but not the whole damn article. When will people learn that computers are about constant change and quit trying to be little fanboys of just one thing?
