    It is the institutions job to ensure a viable environment condusive to learning for all students. Just last week I had to actually pull the plug on a computer behind me because the girl was IM'ing again, instead paying attention to the lecture. She's annoying every one around her. At least she had the courtesy to not make a ruckus about it (how could she?).

    We use Camtasia to produce Flash Videos for product training and demos, in 3 years we have NEVER had a customer call up and say that we crashed their browser by using flash. Nice try with the F.U.D. Must be reading the MS play book yourself.

    I take it when you say "(like me)" you mean people that think they know it/ get it, but really don't.

    I have personally found that you can either find the EULA online for a product or email and request it or download an evaluation copy of software and read the EULA. Your not out any money and you get a chance to read it. I am not saying all vendors do this (though they should).

    I am co-principal of a software company, we post the EULA, FAQ, and freely available evaluation download (30 day trial with click-wrap). We had a company out of state (we reside in Ohio) that purchased with a P.O. on their letter head. They didn't pay. Then when we went to chase them down about it,they said the product never worked (keep in mind they called us more than 12 times in a 6 month period before purchase).

    So off to court we go, they hire local counsel in Ohio, try the long-arm statute, and we win because we have a Jurisdiction Clause in our EULA.

    I am very much in favor of a EULA

    The one time in 8 years of business we have ever had to go to court (700+ customers mind you)and it protected us from a dishonest customer. I would disagree with you on your stance to EULA's. (yes I have been on your site, nice job).

    We offer the EULA on our website for our product. We also offer up to a 30 day no cost evaluation of our product (which you also agree to the EULA). The license is an eval license. If you purchase 15 days into the evaluation, the license turns into a registered license and eval is no more. Do you think that fair?

    Or do you think it fair that someone doesn't: read the FAQ, read our EULA, install the 30 day evaluation. Purchases, and then want's money given back?

    Whose fault is that and should we as the software publisher be penalized?

    Shows what you know. We are in a law suite with a person that purchased our software, and then never sent the money (they did this on a signed purchase order that they faxed). Part of our EULA is a jurisdictional clause. They tried using the Long-Arm Statute (google it) and it failed. When the clicked the agreement button on our EULA, the EULA became CONTRACTUALLY BINDING. Here's the funny part: We have a free evaluation that you can download, they contacted us MONTHS before they purchased, then after purchase said 'it didn't work'. Now you know why vendors have EULA's.

    I don't have a problem giving out the source with NDA. It's just that I find most people have a problem paying what I am going to ask for the brains behind 8 years of effort.

    I love people who critique whole industries that they have no real working knowledge of

    I pretty much think that most of us try to produce clean code, fix stuff when it breaks and learn from the experience

    Remember, you avoid mistakes through experience, you gain experience by making mistakes, it's life people get used to it.

    So the U.S. and conversly the U.S. tax payers that funded the Internet need to give it up?

    It's ours, we made it, and we're keeping it, buzz the fsk off! Let some other country come up with a better idea and maybe they will be in a dominate posistion in 30 years (Well at least an idea not derived by stepping on their entire populations neck to get it done, like uber cheap manufacturing). I am glad I live in the U.S.

    BTW, I am tired of people being down on American's because *gasp!* we are patriotic. I for one don't mind the U.S. staying top dog as long as possible. Don't like it? Move to China and see how much you like it (or India..or...) you get the point.

    Doesn't mean that it was done wrong or in an un-secure manner either. I have plenty of customers on SBS 2003. Takes me 6 hours in shop, another day prehaps onsite (depending on the number of client machines I need to un-crate and connect) and after that I may get to bill them MAYBE 4 hours a year after for misc. stuff.

    Not a bad investment considering all the extras they get with SBS 2003 (Groupware, Faxing etc...). I have clients that the only thing I have had to reboot after is hardware upgrades with 2000/2003 also. Up-time doesn't belong to the sole realm of *nix.

    Actually, it is totally revelant. Shitty TA's is definately topic of the post... And why are Engineering and Science programs shit? TA's that can't teach (American or other wise), uninterested Profs, and out of touch administration have everything to do with it.

    What I do get is the major Universities are opening campuses in other countries becuase of huge contributions to that universities endowment. U of M is in talks with I believe Singapore to open up a 'sister' school in conjuction with a University already there. So when the Singapore student graduates, they not only receive a degree from their native University, they get one from the U of M. Talk about eating your young...

    I too am a CS major, I need a school that is condusive to teaching ME, not garnering research dollars so some TA that is willing to get screwed money wise can teach instead of a professor soley there for research.

    I honestly don't feel like defending the 'cross cultural' significance of working with a Chinese or what ever TA. I already speak English and French, I am not about to learn 2-3 more spoken languages.

    U.S. Schools need to concentrate on U.S. students

    No, I am not up for this whole love the world thing, I have lived abroad and appreciate the friends I have made, but I am also not up for my friends out their having my job.

    One of the problems, especially in research 1 institutions, is that the prof. is there to do RESEARCH, RESEARCH, RESEARCH, then, PUBLISH, PUBLISH, PUBLISH. End of Story. They sure as hell are not there to teach. Just an unfortunate side effect of the job that they are currently on tenure track for.

    The teaching gets handed off to a T/A. You wanna know why the T/A is either Indian or Chinese? Well, it works like this: Along with the hot shot prof. getting the job, they get a departmental budget, guess which students will T/A for less $$ than their American counter part? Ding, Ding, Ding, you guessed it.

    I stopped attending math classes where the T/A was incompetent/incoherant. If I wanted to learn from a native Chinese or Indian speaker, well I would have went to school in either China or India. I either did the work on my own with help from peers that were already out, or "evaluated" classes with good T/A's and prof's. Guess what, at this level, they don't take attendance... Ahhh... now you are getting it..

    Actually, real books are free. Get a library card. I can imagine, when they have a display that has the resolution and contrast that is easy on my eyes as the printed page, I may go for it.

    I like the fact that if I drop or get wet my book, it will survive. I don't need batteries, and I don't really worry about someone stealing my book.

    Never said that you couldn't get an S10 to 180K. Post back when it has hit 240K and you still use it as a daily driver. I stand by what I said, the majority will agree.

    BTW, My buddys 96 S10 with 89K on it is shot to hell. My other buddys 99 Stepside (S10): Fuel pump already replaced along with a strut mount.

    To even argue the the American Auto Manufactures (all two of them now) put out anything quality like Honda,Nissan,Toyota are severely fooling them selves.

    BTW, the Cavalier it the biggest peice of shit to come off of a GM production line

    Ask my mom, she went through two before she wized up an bought a Camry this time around. I don't know what she was thinking the 2nd time. That GM 2.0 litre, what a piece of junk engineering.

    You wanna know what I am bored by? How about this, I have a 97' Corrola, My sister in law has 97' Lumina. Her car at 72K Miles : Replace Fuel Pump, Replace Injecters 2 and 4. My Car, NOTHING (at 98K miles) all in 2001.

    Fast Foward to 2005, Her car at 122K miles: Replace Torque Converter, My car, at 141K miles: NOTHING.

    You want to know what bores ME to tears? Sitting at the dealer ship getting my piece of shit American car repaired AGAIN. Thats REALLY boring.

    How many Ford Rangers or Chevy S10's do you see with 214K miles, now how many Toyota Tacoma's? I know of at least two Tacoma's over the 210K mark, and they start up and run like a champ. You'll get an S10 or Ranger to 180K if you change 3/4's the parts...

    Ask the Car talk guys on PBS, see what they think, better yet walk into a local repair shop and ask them what to buy. Go ahead, tell them your looking for a mid 90's small car/truck ask if you should get a Corolla or Cavalier, S10 or Tacoma. See what they say. Do it 10 times. I'll put money on it.

    The journalist found the quick way to egg on his face. If you are going to review technical gadgets, shouldn't you be at least some what technical?

    I think he should of stated that Apple designed a clean pre-amp stage that has a good S to N ratio and will deliver stable (as in wave form) signal to the cars amplifier.

    To many cheapo pre-amps introduce hiss and noise when hitting thier limits

    Now to get one and wire it to my trusty Crown DC300/A and DC150/A bi-amp setup through my IC150/a all outputed to my PSB Silvers, I love it when old and new tech comes together.

    I love how people with absolutely no background or education in such matters make "observations" (I use the term loosely) like this: Correct me if I am wrong, but aren't they essentially a HDD, Audio Output and (sometimes) a little screen? If that is all there is to it, go make your own.

    How about "I can't believe Apple is a for profit company". How dare they make an industry leading product and then 'gasp' profit from it.

I have met alot more fuck-ups w/o certs than I have with. Basically the people that are anti certs are the people w/o. Funny...
