  1. Fair Use? more like Fair Unuse! on Mom Sues Music Company Over Baby Video Removal · · Score: 1

Well, if you think about it she never asked for permission to use a song in a video. Some may think that because it is a derivitive work and should fall under fair use, it does not. It does not because the original song was used she didn't modify it in anyway so it is not a derivitive work. Overall, I think that she is probably going to lose this case in court because 1st she never lost any money over the work being removed from youtube and the RIAA along with Universal Music Group is going to stay that this is not a derivate work because the song was never modified. Always remember that copyright law was designed to allow the creator/holder of a work to make and destribute copies of works either original or derivated works. Before putting a video on youtube or any site make sure that it doesn't contain any music or artwork that is the poster doesn't own the copyrights to. Some of you may think that some of the copyright laws are stupid but they do serve a purpose. I think that lady suing Universal Music Group is going to lose the case and the owners, Universal Music Group, will probably countersue for copyright infringement. I am suprise they haven't done this already!

  2. That may be a bit much for this service. on Google Rolls Out Online Storage Services · · Score: 1

I currently use Mozy for my backup. http://www.mozy.com/ You get unlimited storage for the same cost as their mid level storage. About $50 a year. The only problem with Mozy is that it only works with PC or MAC no linux. But that is okay for most users. I can see that the future of online storage being very viable but it comes down to the cost. That is what the main problem is with today. Along with of course slow upload speed with many high speed internet connections.

  3. They have been saying in Broadcast. on NFL, MLB Accused of Bogus Copyright Claims · · Score: 1
When watching a sports event all broadcasters have been saying this notice for many years: long before the DMCA and the explosion of online video and such:

"Your not allowed to reproduce, retransmite, or reuse the pictures, descriptions or accounts of this telecast without the express written consent of XYZ. Any commerical or other use such as by charging an admission for a showing is likewise prohibited."

So why is their a problem now! It has been going on for a very long time! I can see maybe with the warning on the CD's that you see now but movies have had it for a long time as well. Remember the copyright notice that many of us fast forwarded thru to see the movie on VHS tapes.

  4. Re:The advantage then of buying real CD's on Apple Hides Account Info in DRM-Free Music · · Score: 1

Yes they can because one has to remember what copyright is: the right to copy and distribute original work by the creator or a company that paid for the work. Meaning it is illegal in the US to make a copy of a song and give it to a friend or sell it to a friend or anyone. It is illegal to create derivate works using the orignal material such a mix tape or mix disc. It doesn't matter if you sell them or not. It is legal for you to make a copy for your own use such as backing up a disc or transfering it to another medium or to play back with your friends. As long as you don't give them a copy of it. Most companies and copyright holders will not sue someone for giving a copy to a friend but the can sue. It is up to the company or the copyright holder. Does this mean that I aggree with all of this. NO! But that has been the law for many years.

  12. The whole purpose of the electoral college on Proposal to Update the Electoral College · · Score: 2, Insightful

Remember the whole purpose of the electoral college is to make sure every state has a say in how the federal government works. If the electoral college is removed or changed so that the popular vote winner nation wide wins than that would create a huge problem. The problem would be that politians would place all of their money into the following states: New York, California, Texas, and Florida. The other states would get nothing. The reason: if all you have to do is win these four states or just a majority in three of them than you would win the election. I would rather see the electoral college stay the way it is so states like South Dakota and Vermont can get a say in the federal government too. I think it would be better off if each state would create a system where each voting distict's popular vote winner would get their winning electoral college member counted than a winner take all system state wide. I mean that for New York State if 30 voting districts popular votes were republican than all 30 would got to the repulican and the 20 other districs that went to the democrates would go to the democrates. This would make the system work better than a winner take all system.

  13. Re:What I do on Why Popular Anti-Virus Apps 'Don't Work' · · Score: 2, Interesting

The problem with this approach in Windows XP is most programs will not work properly as a limited user. This is because most programs were designed for Windows 9x not NT. The programs that were designed orignally for NT will run this way. What Microsoft should do is with the new release of Windows Vista is setup a user account on the system as a limited user. For Microsoft certification they must be able to function as a limited user! This would fix a lot of problems with malware and viruses!

  19. What about the small non-commerical stations? on FCC to Require Broadcasters to Keep Tapes of Shows · · Score: 1

I have been apart of the small non-commerical sector of radio, this market containts many non-profit organizations, such as churches, high schools, college and others. These groups cannot afford to record all of their broadcasters. Many of them only record talk shows, news programs, and sports events but many of them broadcast music programs, such as top 40 hits or small local bands. These kinds of programs don't need to be recorded because their is a log of what songs were played from which cd's and records. So if their is a problem, we can check the log. With these new requirements being put in place will force many of these small non-commerical stations to go off the air?

To thing they replaced them with 6 NT 4 systems. The first week they were up, they had to be reboot multiply times and they became infected with a trojen horse. unfortionalty this first week became a normal week! I guess the university should remember the old statement: "If it's not broke don't fix it!"
