The thing that scares me about this is that if this passes it will allow people with the resources to file patents on other peoples (with lesser resources) inventions. As things stand no one can patent something Ive created with any reasonable expectance that their patent can be defended in court. This law would basically allow patent trolls to scour open source software and patent anything they see. How could we expect to defend against anything like the wave of filings this would create?

Secondly, even if you are distrbuting binary encoders/decoders you don't pay anything until you hit about 50,000 units shipped.
That pretty much makes the x.264 decoder illegal.
No one is saying that you can't pay as much money as you want to use a specific video codec. All we are saying is that if I want to do an html5 cloud based video app (editing encoding etc.) or website for my business or for the general public, then I should be able to use the basic tag without having to worry about getting the pants sued off me.

Actually back in August they also announced that with the exception of free end user viewing all other licensing can change every 5 years. That means they could stick everyone for massive licensing costs when they feel they have enough users invested to force people to pay it.
Far more so than VP8's development was until last May. At least with H.264 it was being developed between different companies and industry groups whereas VP8 was a closed-source, proprietary codec developed by a two-bit company that almost no consumer before Google's buy out had every heard of.

When android phones are incompatible with some piece of software that is exactly what is going on. There is missing or old hardware that the software doesn't work on in the exact same way that your old Iphone doesn't work. If you are thinking that it's up to the user to sift through the android market place your a little behind the times.
Look I have no problem with Iphones. I show new users how to use them all the time (and yes setting up email and the like is difficult for a lot of people even in the Iphone.) I've developed a game for android, and haven't really run into the problem that Iphone people claim happens on android... More over I've taken to asking people about their android purchases and if they would rather have an Iphone and I have yet to meet someone who only bought an android phone because they couldn't get an Iphone. Most new buyers of android phones I've talked to actually seem pretty informed about the different available models and in most cases will tell you why they chose the one they did. Don't take my word for it though try it yourself.
OK if it helps we can refer to fanboys as protagonists. The point is still very valid however that there will be plenty of software written for the iPhone 4 that will not run on the older phones because of hardware incompatibility. Older phones don't have forward facing cameras or the ability to record movies or fast enough processors to handle software written for newer iPhones. That is reality.
And yes I admit I do not have any more statistical data than you do however I still don't believe that anyone who is about to plop down $100 on a new. phone and a two year contract won't shop around for their phone. Also given the fact that the initial iPhones will be 3g only is not going to go over as well as you think when 4g will be available on android phones thus year.
Having said that I think the iPhone is a well designed peice of hardware its just not the universe that apple followers seem to think it is.
any software written to take advantage of the new IPhone hardware will not run on the older models. This is the same issue that android faces with it's different models. No different.
I've been hearing more from people who own Iphone 3g's and 3gs's that want to switch to Verizon from AT&T then I have heard from android users who want to switch to Iphone. A lot of Android users like me have picked out the phone they wanted within the android ecosphere and are very happy with their decision.
That said, this years Iphone will most definitely have a dual core cpu and some kind of advanced graphics processor, leaving all the other Iphones in the dust, and creating the same hardware incompatible environment (old vs new) that IOS fan boys complain about when talking about android phones.

As far as the rest goes, I suppose an architecture firm might be able to use their workstations to render the limited amount of stuff they need. However even the small amount of commercial 3d work I do from home requires me to have a small render farm for doing test rendering. All serious rendering I pay to have rendered on a large Linux based render farm. Of which there are a few.
*Drafting, rendering, and animation (still one of the only domains exclusively populated by 'real' desktops running Windows)

Let me clue you in. No one with any common sense would pay the licensing costs for hundreds of rendering nodes based on windows. Linux is Renderman's biggest platform. In fact Maya, Softimage and Houdini (desktop modeling animation and special effects software) run on Linux. I'm assuming that it would be ridiculous for those companies to keep supporting a platform for no reason of course, but I'm guessing if you are creating films on a budget Linux become a real desktop option.
I would build my own internet if I could. In fact if you could get the government to give me the same amount of money and tax incentives that they have given the telcoms in the last ten years. Then get me the same conditions on land lease and access to public utilities. I would.

The DRM built in to flash works the same on Linux as it does on windows and mac. So tell me how movies and tv on Netflix are protected so much more than anywhere else?
No other major piece of graphics software that I can think of wastes space that kind of thing. The same goes for copy and paste. Blender uses standard keyboard shortcuts for those and has a complete built in undo menu.

Every piece of hardware that Apple uses, anyone else can get, minus a few tiny customizations, and the price is actually higher than their competitors for the same price. If you took a competing arm based tablet and stripped it of all of it's peripherals, and then reduced the price accordingly you'd end up with a cheaper tablet. The thing is that other tablet makers actually add more value for the money by giving you the ability to use SD cards, USB input, and mabey even a camera (or at least the ability to attach one). Apple's value is not necessarily in the product but more in the COA (cult of Apple).
The touch screen input is actually specific to this application. Many of these types of special education needs people have developmental and or motor/speech which means that touching the icons directly is almost absolutely necessary.
My wife is a speech language pathologist. We have talked about working on projects like this but haven't gotten around to it. I offered to help in an FOSS project that would have done something like this but ended up going nowhere. The only bad thing about this is that the company that produced this app will likely not be interested in making this app available for the cheaper android based tablets, and $200 is still a lot of money for todays middle class. The android tablets would inevitably make this more available to families without the money for an Ipad, but the whole package is still going to run more expensive than a lot of people will be able to afford.
But if anyone is interested in doing the programming I'm still up for doing the artwork, if there is enough love in the community to produce an app like this for free
When I ordered my Nexus one I also ordered a protective case and a belt thingy. It came with a neoprene sleve ( http://i.zdnet.com/gallery/378562-540-424.jpg ) and I just looked at that and thought.. "this thing is actually pretty smart" and I've been using it ever since. It keeps dust out of the phone. Keeps it from getting scratched in my pocket, and amazingly has been dropped more than a few times and has survived unscathed. I would just tell anyone after nearly a year of use, get a nice thick neoprene sleeve and save the trouble of all the other stuff.
