    They wouldn't have a leg to stand on seeing as the T&C for XBox Live have terms specifically dealing with modded consoles which basically say if you get caught, the console is blacklisted. And if the T&C's said that you would also get blacklisted if you let someone else play on your system, would that also be an open and shut case? What about if the prevented you from using a telephone to coordinate with other players?

    The point I am making is that just because the T&C's say something does not make it true, state and federal law can and often do supercede certain types of contractual clauses. I'm not a lawyer, but I've read enough case law where the courts have invalidated parts of contracts to know that it happens all the time. I sure wouldn't bet the farm on it being open and shut.

    Remember that and always ask for both the CIR and MIR when talking to a sales person. If they will not specify a CIR (or don't know what it is), RUN, don't walk for the nearest exit. Last I checked, all of the major wired broadband providers in the USA had a CIR of 0bps for their consumer-grade services. So, either you run away, get no connection at all and never exceed that CIR of 0bps or you pick the least worst and usually get significantly more than the CIR.

    But here's what I base my analysis on.
    Across all age groups, women who have been divorced average a total net worth only 55% that of men who have been divorced. In the age group of 40 years and above, just over 80% of divorced men who have remarried have spouses younger than their previous wife. Furtheremore, divorced men remarry at a rate approximately twice that of divorced women. So I'm pretty confident that its a widespread trend for men to "trade in for a younger model" and that modern divorce laws overwhelmingly benefit men financially while women who trade up are not even a blip on the radar.

    You know, instead of stupid attempts to be snide like you've been doing. Why not just admit you are a fuckwit and stop pretending you have justification for you public mental masturbation.

    Simply put, there is no way of stopping the information on the 'net. It's like the underground books that were distributed during Communism in Russia: They kept popping up no matter how much the Soviets tried to quash them. Unfortunately, there is a huge chasm between having secretive technical means to circumvent the repression of information and cross your fingers that no 'legal' repression will be applied to you directly, and being able to walk down to the local library or bookstore and get easy, unmolested access to whatever info you want.

    It's like DRM - it is technically impossible to make it work perfectly. But if it works imperfectly, letting through only the 1% with the dedication, technical knowledge and lack of fear of legal repercussions, then it is doing its intended job by keeping the common man out of the loop.

    Sleeping while driving a bus might be worse than punching a boss, but most of the time this seemed upside-down and backwards to me. If the boss knows that each and every guy working for him can pop him in the face and still not got fired, the's going to treat them more equitably.

    It's like a version of checks and balances, or maybe it's a version of, "an armed society is a polite society." Something like that.

    If someone were to bring a suit against Microsoft for banning them for having a modded console Microsoft would slap them with a DMCA circumvention suit immediately, it would work in Britain and the US for sure. You might want to re-evalute that "for sure" bit. There is no precedent for prosecuting the owner of his own hardware for modifying it under the DMCA. I don't have the case information, but I suspect there is precedent for suing the resellers of pre-packaged modification devices, although even that may not be the case.

    One thing about the DMCA is that Hollywood really doesn't want certain parts of it tested in court, especially the parts that ultimately result in restrictions of fair use - and there is no physical difference between a "pirated" game and a "backup" in case the 2 year old puts the original in the microwave. MS has their head so far up Hollywood's butt that they won't do anything wrt to the DMCA in court without Hollywood's blessing, and hollywood just might not bless the kind of suit you suggest for fear of MS losing it and establishing a precedent.

    Look playing on xbox live has a set of rules. Like playing in the NBA, NFL, Nascar, etc ,etc. The obvious difference being that professional atheletes are paid to play, they do not themselves pay money in order to play. When a customer purchases a product there are certain minimum levels of performance guaranteed by state and federal consumer protection laws. Refusing to provide service to a user who has not done anything but modify his own personal property certainly has the potential run afoul of such laws.

    1. Console updates are given to anyone.
    2. You may download free stuff with either account
    3. Some content (free) may first be only available to gold members then to silver.
    4. You must have gold to play multiplayer.
    5. You can buy extra content without having a gold membership The only really pertinent point is one you didn't mention - does this "banning" prevent access to the non-multiplayer functions too? If so, MS is certainly in questionable territory.

    If they didn't want you to mod the box at all, they could just brick it. They'd probably quickly become the target of class-action lawsuit if they tried that. They may end up with one anyway - does this "live" service do anything other than play multiplayer games? Like software updates, 'free' games and/or other downloads? If so, then depriving the users that have paid for all of those services on the mere suspicion of mis-using one of the services may not sit so well.

    That said -- I think the judge should spend a few hours participating in IRC, reading bash.org, taking part in a forum about something he likes (maybe his car), checking out tubgirl, some pr0n, masturbating and so forth. Then maybe he will actually understand the medium. Somebody (prosecutor) should suggest that. I know that Brit law isn't supposed to be quite the 'fight' between prosecution and defense as US law is. But if I were the defense, I would totally push for the judge to do exactly what you say - once he actually sees that 99.99% of people on the web are just bullshitting, the prosecution would have a dificult time proving any sort of serious intent to "incite terrorism" (wtf is that anyway?) on the part of the defendents.

    Note I am not trying to say the guy should be the one in power in the relationship. Just that if both parties go in expecting equality instead of trying to gain the upper hand things turn out better. Lol! Your version of "equality" sure sounds like the man is in control.

    My oldest friend says it is because of the "trade up" culture we have here. Marry the best model guy you can at the time, wait and shop around for a better model and then trade in the current guy and move on. And who can blame them? Men have been doing exactly that. Why do you think no-fault divorce has become so prevalent? It makes the serial monogamy of men who "trade up" that much easier - traditional divorce would have left them with a lot more of a financial support burden, it's not like women ever had to pay alimony. No fault divorce laws have meant a net loss for women in this culture.

    So now that more women have acheived financial independence, what do you expect? Of course they are going to be just as picky with respect to a spouse as men have been. That old adage could not be more apropriate here, "What's good for the goose is good for the gander."

    Makes no sense. The News Corp purchase should really have been the instant death of MySpace cool. It makes plenty of sense when you take into account the fact the people who most need to care about myspace's MAFIAA connections are the least likely to know about them.

    Young musicians have been signing recording contracts without doing their due diligence for decades, posting to myspace is 10000x more common and easy than that. If they can't do it for the big recording contract, they sure won't do it to use a "free" website.

    HD-DVD initially was not going to support anything above 480p through component video which would have forced everyone with a non-HDMI HDTV to "upgrade" to a newer HDTV. They relented "after" Sony came out and said they would not enforce content protection for the first couple of years and allow 1080i through component. Sony said no such thing. The Image Constraint Token (ICT) is an anti-feature of AACS, the copy-prevention system for BOTH HD-DVD and BLU-RAY. It wasn't Sony that said ICT would not be enabled, it was HOLLYWOOD as the MPAA that said they would not set the ICT bit on any AACS releases for either format. It had nothing to do with competition between BLU-RAY and HD-DVD and everything to do with not pissing off the early adopters who are the target market for any HD products.

    There are numerous Blu-ray burners/drives for PCs and macs out right now. Where are the HD-DVD burners for macs? Where are the consumer level HD-DVD burners for PCs? Considering that you can't buy one for much under $500 and the blank media is at least $15 a disc, the question is moot, even for most of the early adopters.

    I'm not into anime or that sick tentacle porn so I could care less about movies from other regions. Are you fucking kidding me? Do you really believe that the rest of the world has no cinema of note beyond anime and hentai?

    Anyone holding such a ridiculous opinion has no business discussing any aspect of cinema, you are just too ignorant to have any insight whatsoever. Which is probably why your claim about the ICT was total bunk too.

Lots of people may get ideas from it that they would have never considered on their own.
