If I write a program and give you a copy, you do have the right to use it without any special license. You do not have the right to make derivative works, modify it, give others copies, etc.

It just so happens that *everyone* uses EULAs in proprietary software; you can't get a copy of a program from a company without agreeing to the license, but the license is by no means required.
