1) Your 'expert' testimony has been discredited numerous times in other jurisdictions. Why do you believe it will stand up in this jurisdiction?
2) You state that the hard drive you examined contained no traces of file-sharing software or infringing files. Does this not warrant that the case against Mrs. Lindor be dismissed?
3) Are you aware that your actions are harming your case against the Lindors?
4) Are you aware that you are leaving yourselves open to a countersuit on the grounds of malicious prosecution?
A way for people to get access to books that people have tried to ban? I'm all for it.
Mind you, there's probably going to be some dipshit corporation out there who sues Google over this.
TorrentSpy is a tool which some use for unlawful purposes.
. . . and the same can be said of any other tool - hammers, nails, cars, gunpowder, lengths of pipe.
The only difference here is that it's a tool for use "ON TEH INT3RN3TZ0RZ!!1!1!111!!1111!!!1eleventyone!!!1!11! 121!11!forty-two!111!11!11omg 3y3 8 j00r r4m3n n00dl3z!!!1!11! OMG 3V4L P1R4T3Z ARE USING IT TO STEAL OUR MOVIES! OMG SUESUESUESUESUESUE! CALL TEH 31337 SHOCK LAWYERS!"
TorrentSpy facilitates unlawful copying as much as any home improvement store facilitates the breaking of windows by selling bricks. It's a tool. It's neither inherently good nor evil. It can, however, be used for either purpose (good or evil).
And one good use for torrent networks (and other forms of P2P filesharing) is distribution of stuff from OverClocked ReMix and Rant Media.
Now if only the MPAA could get it through their thick skulls that they can use torrent networks to their advantage . . .
Wait a minute, am I fucking insane? The MPAA is a bunch of fucking Neanderthals. Either they evolve (doubtful) or die* (preferable).
*hey nsa and other law-enforcement/surveillance organizations - any comments made about the mpaa dying should not be construed as threats of violence. thank you for your attention, and i hope you don't get screwed over too badly by the illegal wiretapping lawsuits.
> if it weren't for the filesharing networks, I WOULD NEVER BE EXPOSED TO THE ARTIST I AM LISTENING TO IN THE FIRST PLACE.
Amen, brother!
Here, for your perusal are a few examples of music that I'd never have been able to acquire were it not for file-sharing:
B001e - Blow Up The World (opening theme for Patrolling with Sean Kennedy Bad Religion - Come Join Us (again, first heard on PwSK, acquired from Shareaza) Within Temptation - you name the song, I've probably got it thanks to Shareaza/WinMX Overload, Marko Polo, Vanilla Ninja, E-Type - Heard all of them in various games/game mods. Googled the lyrics I could make out, then used Shareaza to download the songs. Orbital - I would never have heard of these if I hadn't been looking for a copy of the Doctor Who theme (which they did a pretty good remix of). Frank Klepacki - Before I was able to get my hands on XCC Mixer, the only way to listen to his music was A) in the games he worked on, or B) by downloading it off P2P.
I didn't think weeds and small children would drink Foster's beer . . . or do you use it the way Escrima used powdered eggs to kill bugs (i.e., dropping a case of Foster's on them - bet that'd kill them real quick)?
. . . but that's beside the point, millenial.
Now, if I remember correctly, any attempt to uninstall the rootkit-based Sony DRM will screw up any form of recordable drive, be it CD-only, DVD-only, or CD/DVD combo, because that's the nature of the beast: "Fuck with me, and I'll fuck up your computer!"
Now, there are a few different theories on why - some people claim they've noticed that the DRMware modifies and/or overwrites the device drivers for the disc burners so that the drivers have to check for the DRMware and ask said DRMware "Is it okay to copy these songs to a disc?", some have said it's to do with the DRMware modifying the firmware, some people think it's basically nuking the write-to-disc ability of the drive - but whatever the underlying reason, the effect is still the same:
It may not be purely in the "News For Nerds" category, but the (un)PATRIOT(ic) Act affects everyone . . . so it falls squarely under the heading of "Stuff That Matters" in my book.
By "someone, somewhere that doesn't know what that's about", do you mean me? I certainly never heard of the Flying Spaghetti Monster myself - at least not until today.
I must admit, though, that the Flying Spaghetti Monster's heaven certainly sounds a lot more fun than sitting around on fluffy clouds and playing bright, cheerful melodies on a golden harp.
"'God is a liberal!', 'God is a Democrat!', 'God wants you to vote Republican!' - Never trust a man who puts his words in the mouth of God and says it's absolute truth . . . "
(And no, this isn't the philosopher, this one's actually a rather amusing musician from New York City, and that's from his song 'God Thinks' - and I happen to agree with the overall sentiment of the song, which is basically "Prejudice and crime is prejudice and crime, and cloaking it in holier-than-thou phrasing and religious rhetoric doesn't make a damn bit of difference. Can't we all just get along?")
It sort of makes sense. It seems an appropriate analogy to me . . .
But then again, I listen to VNV Nation, Within Temptation, and The Cruxshadows, so what do I know?
Diebold was crap since before they got involved in the e-voting field - they also make ATMs, and I understand that a lot of Diebold's ATMs malfunction quite often.
If they can't make a decent ATM, why the Foxtrot-Uniform-Charlie-Kilo should we trust them with our Foxtrot-Uniform-Charlie-Kiloing votes?
Unauthorized software installation, deliberate indroduction of software designed to create security vulnerabilities and unauthorized modification of computer function are already considered acts of cybercrime or acts that enable cybercriminals (such as identity thieves, phishers, spammers, industrial spies, and virus writers to name just a few - there are at least two known virus variants that exploit the rootkit).
Sony has also committed acts of vandalism (they're causing damage to the computer system by disabling the CD drive of any computer where the user deletes their rootkit DRM without the owner's permission, hence vandalism), and the US Department of Homeland Security has said the DRM rootkit poses a clear and present threat to homeland security.
Now THAT'S a headline I'd like to see: "Sony-BMG Executives Detained On Terrorism Charges".
Deliberate introduction of software that creates security vulnerabilities.
Unauthorized alterations to system function (namely, disabling the CD drive) if the DRM software is removed.
Is it any wonder that their CDs are now banned from most workplace computers, have been criticized as 'a threat to Homeland Security' by the DHS, and are facing multiple class actuion lawsuits?
I'd say Sherman has his head up his ass if he considers this the result of Sony "not doing anything wrong".
Who says "blackhat" and "asshat" are mutually exclusive? After all, people in government wear a shitload of hats:
-Senator/Corporate Activist/Election Rigger/Asshat: Chuck Hagel, a Nebraska Senator whose votes were counted on machines made by ES&S . . . the company of which he's president! -President/Asshat/Liar/War Criminal: George W. Bush Presidential Advisor/Traitor/Bush's Brain/Asshat: Karl Rove
IANAL, but here's what I'd ask:
1) Your 'expert' testimony has been discredited numerous times in other jurisdictions. Why do you believe it will stand up in this jurisdiction?
2) You state that the hard drive you examined contained no traces of file-sharing software or infringing files. Does this not warrant that the case against Mrs. Lindor be dismissed?

Yes, yes it does.
See you in court, my friend.
No, that's just self-referential.
Recursive would be something like what the acronym LAME stands for: "LAME Ain't an MP3 Encoder."
(Which, originally, it wasn't.)
. . . then I'm all for it.
If not, however, this doesn't really matter that much.
. . . that anyone wants to stay in the military at all.
. . . they're out there breaking their own damn laws?
Three words come to mind:

Oh, and one more: Hypocrisy. ---End of Line---

Likewise, AC. I've got better things to do - like hunting zombies and cooking Lucky Surprise Eggs.

In Soviet Russia . . . DRM bypasses YOU!
