    At the moment, i can say all the nasty things i want about the current regime and be fine.
    Despite what all the paranoid loonies say about him, Bush hasn't made the USA into a police state. Nowhere near. Not saying I agree with him, there's certainly a case to answere about the Iraq war and all the money he's been making from his pals in the oil indu BRB, someone at the door.

    Even the death penalty doesn't deter crime.
    Perhaps that says more about the (quite small) range of offences it can be applied to than it does about deterrence in general.

    One thing's certain, when it comes to financial crimes just making the offender hand back his ill-gotten gains isn't much of a deterrent; worst the crook can do is break even.

    it must be proven by the claimant that the defendant intended to deceive the consumer.
    If intentions are provable, how do you prove them? You'd need a mind reading machine that could travel back in time.

    The best you can do is infer them from behaviour, but that's not proof.

    Hanlon's razor states: "Never attribute to malice that which can be adequately explained by stupidity".
    It sounds very nice, but you could use that as a defence against almost anything. People and companies need to take responsibility for their actions, even when mistaken - if it was a genuine mistake (not some kind of bait and switch) one can assume they'll learn from it and it won't happen again.
