    You just put a warning in the license agreement on startup "Note: users are required by law to obtain licenses for patents covering all technology contained in this program before use." The users then promptly ignore that warning and use the program anyway.

    The problem is that you're distributing the files without a distribution license.

    Most people who own mp3 players, own only an ipod. Most people think an mp3 player is synonymous with an ipod, and would be surprised to learn that other companies make them too. Most people haven't seen any other mp3 player, EVER, and so would not be able to draw a comparison between the ipod interface and that of another mp3 player. Also, most people are complete retards.

    Oh, I forgot my completely unsubstantiated anecdote - Ok, so one time I bought each person in my entire family a bunch of mp3 players (including the ipod) from different manufacturers, and all of them preferred the other mp3 players to the ipod.

    Suffice to say, even the slickest market campaign can't account alone for iPod's success; just look at the PS3 or Zune: you can't pull the wool over everyone's eyes all the time.

    I have never, ever seen any marketting campaign for ps3 or zune. Not even an online one. The only way I knew about the zune was because I saw engadget mention it, and the only way I knew there would even be a ps3 was because there was a ps2.

    Meanwhile I cannot go for a few commercial breaks (depending on the network) without seeing a commercial for some new ipod nano or shuffle or colored ipod or ipod + itunes or new itunes album.

    All hard drives do that. In fact, if you suddenly cut off a normal hard drives power, the momentum of the disk will keep it spinning long enough to maintain said cushion of air while the head returns to the parking position.

    It's a very good comparison, which is precisely the reason why you don't like it. There are as many ways to injure a person as there are to injure Windows. But nevertheless, let me critique your post;

    To complete the analogy, the second part would be that Microsoft Windows is running in front of infected Ipods over and over, which is not the case. The Ipod is the item that approached Windows and did damage to it. Accordingly, your analogy should be that somebody with a gun approached their victim and did damage to him or her.

    maybe if microsoft wasn't just piling more wood onto the fire, their operating system wouldn't suck so much. sure, apple is being kind of smug with their choice of wording, but it really isn't their fault that windows is succeptable to a 5 year old virus.
    This is the same thing Apple is doing. By rationalizing the error Apple made, they are in effect discounting their faults. You cannot simultaneously take responsibility for something and say that somebody else is responsible.

    the fact that so few (estimated about 25 units) were infected goes to show that it was probably ONE person who screwed up at the factory.
    It only takes one point of failure to compromise an entire operation.

    An admission of guilt isn't an admission of guilt if you try to rationalize your actions in the process, especially if such rationalizations involve placing a portion of the blame elsewhere, or worse, citing somebody else's faults in an obvious effort to downplay your own.
