    If you watch a show on TV and watch the commercials, then the producers of the show have been justly compensated. Does that mean you can record it under Fair Use and make backups of it? I'd sure like to think so.

    Yes, they would. In fact they would hate it so much they are willing to give huge discounts to people who have a pirated copy. Some research suggests that "22% of PCs in the US use a copy of Windows that is not genuine." That's in the US alone. I've been to Vietnam. I'm not entirely there is a single legitimate copy in the whole country. IOW, outside the US the illegitimacy rate is most likely higher. But let's assume it's the same. If MS has 90% market share and 22% of those are pirated, and MS lost those 22%, they would then only have ~70% market share. That means a lot of people have OS X or Linux or something else. That will start software companies noticing. And a huge step down in that direction in such a short time, suddenly people (defined as share holders, 3rd party developers, consumers and businesses) will start to see that Microsoft isn't all that special, just like when Firefox dropped IE's market share below 90% in such a short amount of time.

    In fact, notice when Firefox ate MS's lunch in the browser world that suddenly MS had a new browser to show everyone. That's a freaking browser. You can do that quickly. An OS, as Vista has shown, takes a much longer time. It'll be a downward spiral. When MS starts to lose market share it will do so quickly, and Microsoft knows that. That's why they give discounts for pirated copies. That's why they won't disable the entire OS, just some unneeded functionality.

    Does MS care about non-paying customers? Yes, a whole lot. They maintain they're position by being so widespread, not because of their merits as the best OS developers. If they lose that market dominance, they will suddenly be "just another software company."

    Well yes there is. Peter Jackson is responsible for that though. There is also a Frodo, and a Sam, and even a Merry or two.

    Oh they don't like it now. But if/when Apple no longer has the stranglehold, then there is a chance for someone else to have that same stranglehold. Like Microsoft. It's just like most revolutions. Someone doesn't like the king so they start a revolution for ... another king, who does the same stupid things, but this time they're the one in charge. MS will not argue against the DMCA because of Apple's dominance as long as there is a chance that they can be the one with the dominance.

    New genres don't necessarily mean anything. Or I should say, a lack of new genres doesn't mean no innovation. Spore looks to be the same as Civilization just starting a little further back in time. I wouldn't really call this a new genre. Take a look at the gravity gun in Half-Life 2. Same old FPS? Not really. That was a simple innovation that really added to the life of the game.

    What I'd really like to see is more co-op play. I'm slowly developing a mod for Half-Life 2 like this. I just wish I had more time to develop it.

    Stupid school always getting in the way. I don't want to know recurrence relations. I want to know how to make a mod for Half-Life 2./rant

    Whether or not Jobs personally believes that it would drive people to piracy is moot. He has to know that that is what will get the RIAA's attention. So if he says that it will drive users to piracy, and others believe him, then the RIAA wouldn't attempt it, because then people will see that the RIAA wants people to pirate songs so that they can sue them. Again, this things might not be true, but it's all how it looks.

    Jobs says they will pirate if prices are fixed, people believe it, the RIAA does it anyway. Regardless of whether or not any of that happens, if the RIAA complained about piracy after they fixed prices, people would say "Jobs told you so. It is your own fault."

    Correct me if I'm wrong but the whole opneGL thing is blown way out of propotion. MS will supply an openGL driver and for anything that runs in non-fullscreen mode, Vista will use that driver which will wrap it in DX10. However, if you get a video card (and I assume you will if you want to be doing gaming in Vista, or even run the shiny gui) then you will get any openGL drivers that the video card is supplied with (i.e., ATI, nVidia, etc.) and then there is no DX10 wrapping of openGL functions.

    And these people weren't selling regular donwloads of Firefox. They were selling CDs, which cost money, that were burned with CD burners, which costs money and takes time. So what again is your point?

    MS wanted first mover advantage. Nintendo isn't releasing until later this year and many doubt Sony will be out the gates even by Christmas. So they could have had first mover advantage even this spring and been stockpiling so that they'd have enough.

    That's fine if they want to sell at a loss and depend on people buying software for revenue. So they exclude the casual market. I suspect though that the casual market has more disposable income as a whole than the relatively few hardcore. So if they want to shut themselves out of that market that's fine. By the time they get the supply for the casual as you imply, Nintendo will be out and get both the casual market and several hardcore (cause if you're really hardcore you buy more than one). Who wins. Not MS. Then Sony comes out and gets even more hardcore market share. Who wins. Not MS.

    Remember, these are people who lost billions on their first attempt. That includes software sales, and it wasn't because of mod chips. They're only around because of Windows and Office. Just because Windows and Office are successful does not mean the XBox people know what they're doing. Unless they're marketing strategy is as convulated as Vizzini from Princess Bride, I'd say they're market strategy was based solely on first mover advantage.

    But like I said, I'm not believing the lack of availability stuff about the 360 anyway. I know of at least 4 stores within a 15 minutes drive that have 'em.

    How about Fedora Core 5:
    1. Linux with SELinux enabled
    2. Firefox 1.5 and Konqueror with Opera as an option
    3. How about making it look the way you want?
    4. With Mono, you have Beagle
    5. yum for command line, yumex or pup for GUI
    6. Gstreamer, xine, mplayer: all installable through yum(ex)/pup
    7. Non root accounts plus lockdown
    8. All sorts of backup scripts
    9. Wiki, CVS, etc.
    10. Anaconda or a live CD

    I used to believe that too. But after 3 months and we still get "Xbox 360 is short supply" and "Xbox 360 won't meet demand until April" and other such stuff people start to realize that the problem is really the manufacturer's fault. And that looks bad for them. This isn't about generating buzz about being sold out. It's about not being able to make enough because they were too stupid to do so. Not that I necessarily agree with the limited supplies. Maybe in some places, but not where I am. I can walk into almost any place and see at least one Xbox 360 lying around (not the demo one).

    Yeah I wish more units could be selected. As much as I liked it, my biggest beef with Dune II was units coming out of the buildings into places they were stuck in. The only way to get them out was to destroy the building and rebuild it. I learn to put a lot more space between buildings then.

    I remember some of those LucasArts games. I loved Dark Forces, Jedi Knight, and Jedi Outcast (yes I know that last one was made by Raven). In fact, Jedi Outcast caused me to switch from being a bio-chem major with Medical School in the future to going into computer science so that I could make games. Later I realized I would rather be a level designer but computer science is good for that too.

    I also remember playing Dune II. That was fun.

    Does anyone remember "Freddy's Rescue Roundup" or a game called "Round 42"?

    putting a new UI on a steam engine would do it some good, but only to a point.

    Valve did that and it seemed to work out just fine for them

    #1 is not contradicted by #2 or #4. If ebay prices are right around retail it is because no one wants to pay more for it on ebay than they can somewhere else. If it were unavailable everywhere else, then demand would cause it to go up in price. But that it's the same price as retail means people are willing to bid on it until it gets to be the same price as they could get it at Best Buy or WalMart or wherever and they no longer want to bid.

    Here's my anecdotal evidence as well. Just this Saturday I was in CompUSA, Best Buy Circuit City, and WalMart. 360's were in each store ready to be purchased. In all but one location, no one was even playing the demos. Where someone was, they were playing Call of Duty 2. I watched for a minute as he played on an HDTV. After a minute I hung my head in disgust. Oh la la. They have PC level graphics only a few years later.

    I'm not impressed by the 360's actual performance. I'm not believing anything about the PS3's supposed performance. Nintendo is trying something different. I look forward to it. My PC allows me to mod. PC for me with the possibility of a Revolution.

    How do you measure limitness? That's similar to "Twice as small" and "Three times as light." How do you measure smallness or lightness? You can measure size and thus can say "Half as big," and you can measure weight and can say "A third the weight," but how does one go about measuring the other way around?

    This would be true! If it wasn't a myth, anyway. Sugar is not any worse for your teeth than any other fermentable carbohydrate. Just one more reason those low-carb diets are good for you. Unless of course you are eating Carl's Jr.'s Low Carb 6 Dollar Burger.

    Note: I am not seriously trying to promote low-carb diets as much as trying to debunk a myth.
