I would argue in this case the defeated is initiating the end of the conflict by choosing the lesser of the two negative outcomes once it is established that there is no winning.
I disagree, while nuclear weapons may have hastened the end of the war, the "end" came in the form of a formal surrender.
If the US had not sought out or accepted the surrender of Japan the war would have continued in one form or another. Even if what one side is communicating is "give up or we do that again" it is still two sides meeting and making an agreement (the surrender was indeed negotiated, the US did compromise on the removal of the Emperor for instance) that ended the Pacific campaign.

Strictly speaking it is true that Microsoft has a big presence in the lobbying world but how do you figure that Microsoft would benefit from reform in the patent system? One of their main tactics for bullying smaller competitors (read all competitors) has been to use there vast library of vague patents to sue. Who would be the chief beneficiary of a bill like this?
In the long run I don't care who lobbied for a bill if it benefits the greater good (I don't know if this does or not, I am not a lawyer), which may be why I find your cynicism disturbing.

If a state or city institutes a tax on carbon with the expressed purpose of spending the money neutralizing the taxed emissions it won't take long before the governing body is spending those taxes on other budget items or subsidies for large businesses that have no real benefit for the people paying the "carbon tax".

I stand by the rest of my post. Our current executive branch would have no need to hide behind so called "social issues" if it was acting justly and in good faith with the American people. Even now the leadership of this country is spending much money and effort attempting to maintain the status quo for the benefit of themselves and there cooperate masters and frankly damning the future for short term benefit.

I for one would rather have a government that does not feel the need to hide from anyone or use any issue as a distraction from issues that are uncomfortable for the current political leaders. For me there are a few issues I would like to see addressed before we worry about legislating medical care and denial of civil rights as examples.

I don't dispute that... I'm sure now that ATi is owned by AMD we will see nVidia and Intel getting much friendlier than they have been.
