    Great! So, if my neighbor is bothering me, and I pay somebody $10,000 to make him stop, I can then "claim ignorance" when the solution the person I paid comes up with is to simply assassinate my neighbor? I'm sorry, but if you are paying somebody to put malware onto your customer's machines, you damn well better be responsible for ANYTHING they put into that software! The fact that you payed somebody else to do your dirty work for you SHOULD NOT absolve you of any guilt for their actions...

    Or they want to leave before they get indicted. If a CFO leaves just before a quarterly report, it generally means he is resigning to avoid committing perjury by signing a report he knows to be false. I beleive this report was intentionally delayed also, which is further evidence that there might be statements in the report that nobody wants to sign their name to.

    Yes, those are all valid legal theories. The point I was trying to make was that if your intent is to collect legal damages from somebody you have a contract with, then failure to inform the other party in a timely manner exactly what they were doing that allegedly violated the contract will be held against you when the time comes to set the dollar amount of damages. Sealing the list of infringements and effectively preventing any measures to fix the alleged problems then seems to indicate that they have no expectation of actually collecting any punitive damages.

    Great. This subwoofer can faithfully reproduce the waveforms used by infrasonic weapons! This is the resonant frequency of flesh and, theoretically, it can rupture internal organs if loud enough. Whether exposure to such infrasound can trigger epileptic seizures, as some fear, remains unclear; experimental data on exposure to such frequencies gives a variety of results." Yes, and infrasound can theoretically cause incontinence too, but I'm not sure what frequency works for that -- didn't the Mythbusters disprove that the infrasound incontinence myth?

    They aren't limiting supply to "ensure an immediate sellout"; they are limiting supply to keep the number of returned defective units down to a managable level long enough to figure out how to make non-defective units. Microsoft doesn't profit from the extreme markups seen during an artificial shortage; those markups all go to the retailers instead. Microsoft would never intentionally do anything that would limit their own profits! (Also note that ramping up production very quickly almost always results in more defects per unit.)

    Much as I detest the Sony DRM, this is not a valid criticism of it. Anybody wanting to implement cheats will just use the same method as the Sony DRM directly to hide the cheats, not rely on the Sony DRM having been installed first! This is a flaw in Warden that is independent of the fact that the Sony DRM is a bad thing. It also points out the flaw in the anti-cheat arms race -- since you don't own your customer's machines, any anti-cheating technology you deploy can be quickly circumvented by determined individuals.

    Uh, no. I'm not an OS expert, but I beleive NT 3.1 kept drivers in a seperate protection ring from the kernel (much like OS/2) so that 3rd party drivers couldn't crash the kernel. Since this was incredibly slow due to constant context switches between drivers and kernels, for NT 3.5 Microsoft made the concious desision to make the OS less reliable by putting the drivers in the same protection ring as the kernel to improve speed. As far as I know, subsequent MS OSes have kept this same trade-off, allowing drivers to corrupt the system in order to improve performance. I beleive Linux drivers can pretty much futz up the kernel too.. at least from personal experience with the driver I'm currently writing, accessing a NULL pointer from within a driver causes an exception and a reboot. Presumably Linux also sacrifices memory space protection to gain speed.

    Isn't one of the major counterarguments against a damages claim the claim that the complainant failed to take measures to mitigate the damages? Won't the court see the failure to enumerate the actual comlaint for 2.5 years as failure to take action to mitigate damages? I seriously doubt if SCO is going to collect the full (touches pinky to mouth) ONE BILLION DOLLARS in damages they are claiming if the refuse to tell anybody what they did wrong so that they can take steps to fix the problem...

    Explain to me again how you can build a POSIX-compliant operating system without out using any of the "methods and concepts", as well as the APIs, inherent in Unix? Does Microsoft's purported POSIX interface or other parts of their OS also use these methods and concepts (e.g. Vista using symlinks)? Does SCO honestly beleive that a license from SCO is required to be POSIX-compliant? Also, you can't copyright "methods and concepts", you can only patent them... how many patents does SCO hold on Unix "methods and concepts"??? None, last time I counted. Can anybody cite any section in any contract IBM or Sequent signed where they explicitly agreed not to implement any Unix-like functionality in any other operating system? Too bad this is a court sealed document, or we could all have a good laugh.

    Seriously, though, why should I have all these little devices which pretty much look the same? Uh, cause if you listen to music on your all-in-one all day, you won't have any battery left to receive phone calls by the end of the day? How about 'cause dropping a $99 device on the ground and breaking it is slightly less painful then dropping a $499 device?

    What I want is a cell phone that is really good at being a cell phone, and a MP3 player that is really good at being an MP3 player! I don't even use the camera or PDA features built into my cell phone, 'cause it make a crappy PDA and even worse camera. The idea about using your PDA as a programable IR oluetooth remote control is a good one, however.
