Then the vendor just tabulates all that information, and at the end of the year sends out a bunch of checks.
There's a difference between "legal action" and "illegal". A company could instruct its lawyer to send you a C&D letter. That's technically a "legal action". However, what you are doing may not be illegal, and you may be forced to prove that in court if the company sues you for ignoring it's C&D demand.

Well, in general, you can never claim anything definitive from any anecdotal evidence. However, I can point out that it took over 5 months for the Xbox 360 to be generally available in retail stores. The PS3 has been out for less than 2 months, and it's reached that status. Does anyone know how many PS3s and Xbox 360s were manufactured in the first two months? My guess is that the numbers are pretty much the same, which means that the Xbox 360 was much more popular during its first two months than the PS3 was.
What the article says is that there is an agreement not to implement the Image Constraint Token (ICT) yet. This is a token that forces a downgrade of analog signals. This is why the Xbox 360 can have a HD-DVD add-on without a HDMI port.
I have an Xbox 360 and the HD-DVD drive for it. I connect via component cables to my 720p TV. Are you saying that if I insert an HD-DVD that has the ICT, that my image will be downgraded?
