    Man. We must be reading two different sets of provisions....because this shit makes my knees jerk all over the damn place.

    I don't believe that the GP is actually endorsing the Patriot act per se, but is pointing out that it is preferable to be afraid of something that is spelled out to being afraid of something unquantified.

  9. List of Expiring Provisions: on Congress to Revisit the Patriot Act · · Score: 5, Informative


    The following provisions of the USA Patriot Act will expire on Jan. 1, 2006 if not renewed by Congress:



    Section 201 -- Gives federal officials the authority to intercept wire, spoken and electronic communications relating to terrorism.

    Section 202 -- Gives federal officials the authority to intercept wire, oral, and electronic communications relating to computer fraud and abuse offenses.

    Subsection 203(b) -- Permits the sharing of grand jury information that involves foreign intelligence or counterintelligence with federal law enforcement, intelligence, protective, immigration, national defense, or national security officials

    Subsection 203(d) -- Gives foreign intelligence or counterintelligence officers the ability to share foreign intelligence information obtained as part of a criminal investigation with law enforcement.

    Section 204 -- Makes clear that nothing in the law regarding pen registers -- an electronic device which records all numbers dialed from a particular phone line -- stops the government's ability to obtain foreign intelligence information.

    Section 206 -- Allows federal officials to issue roving "John Doe" wiretaps for spy and anti-terrorism investigations.

    Section 207 -- Increases the amount of time that federal officials can watch people they suspect are spies or terrorists.

    Section 209 -- Permits the seizure of voicemail messages under a warrant.

    Section 212 -- Permits ISP (Internet service providers) and other electronic communication and remote computing service providers to hand over records and e-mails to federal officials in emergency situations.

    Section 214 -- Allows use of a pen register or trap and trace devices -- a device records the originating phone numbers of all incoming calls on a particular phone line -- in international terrorism or spy investigations.

    Section 215 -- Authorizes federal officials to obtain "tangible items" like business records -- including those from libraries and bookstores _for foreign intelligence and international terrorism investigations.

    Section 217 -- Makes it lawful to intercept the wire or electronic communication of a computer hacker or intruder in certain circumstances.

    Section 218 -- Allows federal officials to wiretap or watch suspects if foreign intelligence gathering is a "significant purpose" for seeking a FISA (Federal Intelligence Surveillance Act) order. The pre-Patriot Act standard said they could ask for the surveillance only if it was "the" sole or main purpose.

    Section 220 -- Provides for nationwide service of search warrants for electronic evidence

    Section 223 -- Amends the federal criminal code to provide for administrative discipline of federal officers or employees who violate prohibitions against unauthorized disclosures of information gathered under this act.

    Section 225 -- Amends FISA to prohibit lawsuits against people or companies that provide information to federal officials for a terrorism investigation.

    Yet another chapter in our epic struggle against the disgusting inhabitants of the evil blue planet unfolded today, when it was revealed by the Council that one of the invaders' probes was observed deploying a spindly, antenna-like structure.
    Hopes that the antenna would prove to be benign were quickly dashed, as our scientists determined conclusively that the antenna was designed to emit hazardous low-frequency radio waves, capable of penetrating far underground.

    K'Breel, Speaker for the Council, stress that there was no cause for alarm:



    "This latest nefarious plot by our enemies has successfully been averted. Immediately upon receiving news of this latest aggression, the Council approved an emergency action to neutralize the threat. The structure of one of the segments of the deadly antenna was successfully altered, rendering the device incapable of harm.



    When asked if rumours were true that the invaders' probe was actually outfitted with two of the deadly antennas, K'Breel declined to comment.

    Their summary: Microsoft is under 'attack' on all fronts, and either needs to inovate or die.

    I suppose, if these were in fact the only two options, M$ would in fact die, as they have never been in the business of innovation.

    However, the real situation is not nearly as simple as Beeb makes out...M$ will weather this latest crisis, just as they have weathered all previous ones. Their stranglehold on the marketshare isn't likely to be broken any time soon, and the depth of their pockets insures that they can wait out any siege.

    Second, and more importantly, there are a ton of issues that go into a hiring decision, many of which don't have a thing to do with the specifics of a job. An applicant may have skills, but may not have the right temperament, outlook, or might not be a good fit for the company's culture. (Or a zillion other reasons...)

    Not only is this completely correct and insightful (mod up, please), it also may be a good way to keep from having to select your own replacement, while getting/remaining in the boss's good graces at the same time.

    Just imagine, "...well, Mr. manager, I'd like to select a replacemet, but frankly, I just don't have the background. I'm afraid that anyone I select may be a bad fit for the company for some reason, since I don't have the experience and skill necessary to do good hiring. You would be far better off selecing a replacement yourself, Sir...you're certainly better at this than I am..."

    After all, you can catch flies much more effectively with honey than with vinegar.

    This is an excellent point against selecting a replacement for your position, and it's one that didn't even occur to me.

    I see where you're coming from....I was making the assumption that this manager, while superfically unreasonable, is fundamentally capable of rational thought, while you're reminding us that that assumption may not be valid.

    This is indeed a troubling scenario...in most situations, the best course would be to smile and nod, and walk on eggshells around him. However, in this situation, this potentially unbalanced person has the ability to cause serious damage to the writer's professional reputation and career. Another poster on this topic made the statement that the only thing a technical profesional really possesses is their reputation...a point with which I agree wholeheartedly.

    To borrow your analogy of a kid attacking you, as long as he is unarmed, you may be able to safely ignore him, but if he starts attacking with a club, knife, or gun (in short, if his attacks now have the potential to cause real damage), you are within your rights to protect your own well-being.

    Clearly, if the manager is indeed unbalanced, the writer has a very fine line to walk for the next couple weeks. in this situation, the only constructive advice I can offer is to make every attempt to appear as the rational and reasonable party...while still taking the necessary steps to defend one's professional reputation.
