    I think the basic premise put forth here is sound. We just need to adjust the viewpoint a bit. Rather than making games more like real life, with ads permeating every moment of our existence, let's flip it around. Make real life more like the in game experience and get rid of the ads completely in both worlds.

    Remember: the primary valid purpose of patents is to allow the recapture of investment capital plus additional profits in proportion to the utility of the discovery.

    The historical purpose of the patent system was to encourage the development of new inventions, and in particular to encourage the disclosure of those new inventions. Inventors are often hesitant to reveal the details of their invention, for fear that someone else might copy it. This leads to keeping inventions secret, which impedes innovation.

    For Jefferson the purpose of the patent office was to promulgate invention, not protect them. These two reasons are why he formulated a policy for patents that encouraged invention but maintained restrictions on what could be patented. Thus he was able to be true to his beliefs and perform the duties foisted upon him by the Patent Act of 1790.

    They've only found that a decision regarding copyright ownership based on the APA wasn't something that should have been decided in a summary judgment and that the decision should've been made during the jury trial.

    That sounds about right. Who better to decide a complicated copyright case than a bunch of people who can't think of a way out of jury duty?

    after buying an e63 and feeling like i've paid for buying battery powered feces i wouldn't trust nokia to design or engineer a matchstick

    the manufacturing is shoddy at best, the software is flaky and the support is laughable (two firmware updates later and the only difference i can see is that the equalizer doesn't work when you've got the headphones plugged in)

    Sounds like you should have done some research. There are two different versions of some Nokia phones, made in two different countries. One country's manufacturing of those phones is well known to be vastly superior to the other's. Guess which one you got?

    But I do want to make the point: Dumb people get what they deserve (point 2),

    If there is any justice in the world, you will end up with impaired mental faculties in your old age and some scammer will take you for everything you own.

    You do know there are minor labels, digital distributors such as Jamendo and Magnatune, as well as unsigned/independent artists, right? Some of music you'll find there is quite good. Subjectively, I'd even venture to say the good/bad ratio is better than the major labels.

    I, on the other hand, would disagree. The barrier for entry is so low that a significant percentage of their content sounds no better than two cats going at it in the middle of the night.

    While I despise the RIAA and their business practices as much as the next guy, they can't afford to back talentless hacks. Magnatune is akin to a collection of all of the first round contestants on American Idol, whereas the studio backed artists are more like the finalists.

    Why is it that web "designers" can't understand that I have perfectly functional "Open in New Tab" and "Open in New Window" options if the right click menu if I want to do so and if I don't use those options it's specifically because I DON'T want to open a new tab or window.

    What makes you think they don't understand? The web page developer is coding the page the way that the paying client wants him to code it. Your desires don't factor into it. The site owner wants your primary view to remain on his site so that's the way it's coded. If you would like it to behave differently, install greasemonkey and start coding.

    They don't like being told what to do by a monolithic entity trying to hold all the cards and write all the game's rules.

    Writing software for the iPhone and submitting it for approval is about as fun as playing a game of Mao, and for the same reasons.

    Not having a field test for marijuana isn't a reason that marijuana is still illegal. Hell if that was the reason it wouldn't be a schedule 1 drug, while Cocaine which is much much worse is only a schedule 2.

    But the difference between schedule 1 and schedule 2 is whether the substance also has a medical use or not. (At least in Ohio, YMMV)

    Little can be done... except block such messages entirely at the provider level. When the attack vector is clearly defined, it's easy to scan for it.

    Except that since the carrier gets $0.15 per msg here in the good old US, they have no incentive to block these messages. In fact, many of them have insisted that they have no ability at all to identify and block individual messages.
