  3. The DEATH of BSD on Is BSD Dying? · · Score: 5

BSD is not dying. I am both a Linux and a FreeBSD user, and I can assure you that its not dying. Those anti-BSD "trolls" are nothing more than ignorant Windows lusers that have carried over their misinformed ideas from anti-apple/mac to anti-BSD. As Linux gets easier to use, there will be an ever growing stream of these morons.

Just go to netcraft.net and take a look at the top 50 uptimes. Only 3 times does any non-BSD OS appear there (BTW, Linux does not appear once). BSD is not dying, Linux has just stolen the spotlight for a few moments. Sure Linux has the spotlight, but BSD remains running on all of the mission critical servers. It doesnt matter how popular Linux gets, there will always be a place for BSD; this marketshare is not really being stolen from BSD, its being stolen from Windoze and others.

It doesnt matter how many millions of dollars some useless company is worth, the OS will still be pretty much the same. You cant just pump money into an OS and expect it to be better. BSD is a good product because of its age, and the truley devoted programmers. 1 free programmer doing what they truley love is the equivelant of 10 hired/commerical programmers. Quality, not quantity.

There are some things that Linux is good at, and some that BSD is good at. No amount of advocacy will change it. Advocacy is not the answer in most cases, it just turns into a flame fest. Once people see the statistics they will know in their heart.

Can I now legally copy audio CDs for my friends?

The simple answer is NO, but you can legally copy your friend's audio CD for YOUR OWN use.

To paraphrase the introduction to the Copyright Board's ruling:

On March 19, 1998, Part VIII of the Copyright Act came into force. Until then, copying any sound recording for almost any purpose infringed copyright.

Part VIII legalizes one such activity: copying of sound recordings of musical works onto recording media for the private use of the person who makes the copy.

It does not matter whether you own the original sound recording (on any medium), you can legally make a copy for your own private use.

To emphasize this point, endnote 4 of the Copyright Board's ruling says:

Section 80 does not legalize (a) copies made for the use of someone other than the person making the copy; and (b) copies of anything else than sound recordings of musical works. It does legalize making a personal copy of a recording owned by someone else.

    Please think before you flame

Well, since we have the tax now in Canada, it is kinda legal to do this. We now have the right for casual copying. This means basically, I lend you any CD you want and you can copy it. I can also make copies for myself (duh). However, I cannot make copies for you, you physically have to make the copy.

This is logical, because whats to stop people from just starting their own pirating business? It works nicely, people have the right to lend CDs out to friends and let them copy 'em. It may not seem like a lot, but it allows the music companies to actually distribute "their" music while giving consumers the rights they deserve with the content they purchased.

"My question, though, stems from the fact that (like it or not) software companies are within their rights to get paid for software they write, and to set up their own price structure,"

Well, the truth is, corporations dont have the liberty to partake in such things as industry wide price fixing. In my view, CPRM (or whatever the hell it is) is exactly the same abuse of power by corporate collaborations. They are using their collective power to screw consumers out of their freedoms (instead of their money, in this case)

" and to prosecute those who steal their software."

This is a whole other topic right here. Under only one circumstance do I see real "stealing". This is when, and only when, someone pirates the software they were intending to purchase beforehand or in any time in the future and does not pay for it. Most people pirate software that they would never in a million years purchase at the prices software distributors charge. These software companies write these off as "lost revenue" and attach a price tag to these "lost sales" when they would never had a sale in the first place. You cant actually steal something without depriving someone of something that they have ownership or rights to. When you download some "warez" to decide if you want to use it or not, or just use it forever but dont actually need it nor would have payed for it, you are really not taking money out of the pockets of anyone. Its a grey area when it comes to non tangible goods, there is no fine line that distinctively seperates stealing.

If you want a comparison, try the amount of money spent. An Athlon 1GHz compared to a G4 500 (~ same price, me guestimates), the Athlon would kill the G4. Dont compare MHz, compare prices.
