  1. Re:What isn't copyrighted material? on Downloading Copyrighted Material Legal In Spain · · Score: 1

Private copying of cultural works (music, books, movies etc) *even if you don't own the original work* is a right granted by the Spanish Constitution itself.
The right to make backup copies of software is there as well, but only if you own the original. Public communication of a copyrighted work without the consent of the copyright holder is not permitted, BUT "sharing" between family and/or friends is legal as it is not considered "public" communication.
However, any of the aforementioned actions are prohibited if done for lucrative purposes.

The current points of conflict are a) whether sharing X in a P2P network can be considered "public communication", and b) whether downloading a song or movie can be considered "lucrative" as you're "saving" the money it would've cost you to buy the original.

For some common cases, current jurisprudence states that: downloading songs etc. for personal use is NOT lucrative and thus legal; downloading "backup copies" of software IS illegal (unless you can prove you own the original); offering P2P links (torrents or ED2K links) in a website is legal unless you put advertisements in it or, by any other means, get a monetary profit from that website traffic; selling pirated copies of anything is illegal (the key here being the word "sell").

Probably this website can help you: http://a2knetwork.org/reports2009/spain . It may, of course, contradict what I just said, but since IANAL I'd rather trust the website :)

  4. Opt-out? on Kraken Infiltration Revives "Friendly Worm" Debate · · Score: 1

Well, you could just release the worm AND concise instructions on how to block it.

The only people I could think of that could REFUSE to update their computer / network (as opposed to just not caring), are network admins that have very good reasons (known incompatibilities, critical systems, etc.) for not doing so, or just feel more confident updating manually. If this "good worm" were to be released along with blocking instructions, this admins could decide whether to let it in or not; and the rest of the uncaring, "do as you want as long as it doesn't bother me", "i don't give a sh*t" mass would be happily up to date and (hopefully) with less vulnerabilities, for the good of all of us.

There's the problem where the "bad worms" make use of those instructions to block the "good worms" - up to you to find a solution for that problem.

That's what the Zeroth Law is for: "A robot may not injure humanity, or, through inaction, allow humanity to come to harm."

Just program your robots so they "think" that, somehow, your enemies killing you is "harm to the humanity" but you killing your enemies is not. There you go.

Some other things robots could use their weapons against: parked vehicles, unmannered aircrafts, ground cannons, satellites, crucial buildings, transport infrastructures... Other robots...

What you're getting when you're pointed to another thread, 6 pages long, is a hell of a lot of FREE EXPERIENCE. I mean, 10-20 minutes of reading and you'll find yourself knowing:

    • The solution to YOUR problem
    • How to evade OTHER problems that may arise
    • More solutions for different scenarios
    • Last but not least, HOW that solutions were found.
You know, it's good to learn from your own errors; but learning from others' errors is good as well and saves you the pain ;) I think that's a strong point of forums: they are not specially good as a repository of information, but are great as a repository of experience :)

Well, in fact you can't compare crime rates between countries with different laws and different "crimes"... A crime in USA may not be a crime in Spain (e.g. downloading copyrigthed music over the Internet for personal, non-lucrative use is legal in Spain and not in USA (not sure if it's a crime but it's not legal)), as well as a crime in Spain may not be a crime in USA (owning a gun).

So, if you want to compare apples with apples, you should compare equal crimes. Murder is a good choice, rape or sexual aggression would be ok, too.

Perhaps our psychological fascination with dragons and birds of prey are subsequent results of frequent bird attacks on our ancestors? At any rate, it's been commonly believed that several thousand years of exposure to a species results in a slight increase of instinct of fear with each newborn.
So, with spiders and snakes being the most "irrationally feared" animals world-wide... Is it possible that our ancestors were constantly predated by giant spiders and basilisc-sized snakes?

This would explain Jon Peters' obsession with spiders... Somebody go tell Kevin Smith :D

  18. Re:What about Canada? on Free P2P In France? · · Score: 1

Here in Spain, "access to culture" is a Constitutional right, and thus the law allows us to copy and share music/movies/books as long as it's for personal use and there is no profit. Associations similar to the RIAA and the MPAA are trying to change this laws. Software programs (such as videogames) are explicitly excluded and it's plain illegal to download them if you don't own the original program. The statement "If the amendment survives, France would be the first country to legalize so called peer-to-peer downloading" is still true, thought, because in Spain P2P was already legal when it appeared ;)
