    if you look at it, all the keywords are there. wow, now see : "OPPORTUNITY" a positive word. "AFFORDABILITY" another good, positive word. "COLLEGE" wow, higher education too.

    if you read it, you may be tempted to think this is something that provides opportunity, affordable college education and such. HOW can it be bad ?

    they do that all the time. check this now : Digital Millenium Copyright Act.

    examining it gives you all the necessary feelings : "digital" - wow it has to be something progressive. Millenium - oh boy, we are in 21st century yay. "copyright" -> it has "right" in it, so it has to be good. if you add the bait that is "it will provide/protect jobs" while advertising for it, you are sure to fool the public.

    but of course, for them to be fooling american public for SO long with same ploys, and successfully too, there has to be a number of preconditions, providing for the fooling. i am not sure which hold true :

    a) American people are UTTERLY stupid
    b) American people "dont care" c) American people care little, but only for selfish reasons - see "it will protect jobs". and plan very short sighted.
    d) American people are powerless
    f) All of the above
    g) Mixture from all the above in varying degrees.

    and they are setting a VERY harmful precedent here, by persuading a possibly technically ignorant judge to some stupid decision. (i would like to remind you here how a 80 year old judge recently dismissed google's concerns about privacy as 'senseless' and ordered google to hand over all info on youtube users to viacom).

    no there is no bottom line, and its not 'plain and simple'.

    we cant tolerate any game company, any game, any game fan base to make a mess in court and cause trouble for almost all software and i.t. for the decades to come, just out of their own self aggrandizement.

    the STUPID, the OVERLY MORONIC argument blizzard is using is that the program 'modifies the wow software running in THE MEMORY'.

    of course, that is trying to fool the old, senile court judges. everyone who has used computers a bit knows that when a program runs in memory, MANY aspects of it are modified on constant basis, and a few million times a second or more. windows kernel code modifies the wow software running in the memory, wow software ITSELF modifies itself in the memory, its memory footprint changes, it reads and writes data from disk, and to network and modifies itself accordingly.

    a computer's memory is something too complicated for a lawyer to fathom. they shouldnt sweat it.

    By the way, I think that it would be hard to out-cushy Google. Their campus is like Club Med and I have a hard time believing that they get anything close to maximum productivity out of their workforce because of it.

    you forget that software is a CREATIVE field. creation process is something mankind has never been able to totally figure out, how it works are a mystery.

    you can neither measure creativity, or systematize it, nor do anything 'structured' with it.

    a google employee engaging in nerf gun fights in %10 of its work hours can put something creative to the table that a, say, microsoft employee who works in %110 of his working hours in legacy corporate style cant. and this can turn the tables.

    and this is actually what its been like for the last ~12 years.
