You're all joking right? TV and film generally sucks. I'm gonna go out on a limb here and say that sci-fi novels and short stories make the film and TV version of the genre look like my attempts at writing fiction when I was 10. Take Herbert's Dune for example - he created an awesome world full of history and developed characters. Then take David Lynch's adaption of Dune - it blew monkey dong. Or the Sci/Fi channel's version which was better than Lynch's but of somewhat poor production value. Some stupid things in other sci-fi movies/shows - 1) Star Wars. The Deathstar is probably the stupidest sci-fi invention of all. Though we are approaching the stage in real life where we are able to blow up our own planet, the evil dudes in Star Wars evidently believe that something like the Deathstar is the best way to go about it (George Lucas had probably never heard of anti-matter). 2) Star Trek. Where to start. How about the fact that every alien looks human but have weird shit on their head. Apparently there is some sort of convergent evolution in the Star Trek universe.

I think art has to be something that not everyone has the ability to create. Sure, everybody can be creative - but the class of people called artists are creative in a way that non-artists cannot be. Also, I don't believe that intention has anything to do with it nor the price (if any) other people pay for the aritist's work.

I have this difinition of art wherein the piece of art has to take some amount of skill that I do not have. For example, simply repeating "Let the bodies hit the floor" over and over again is not art. Because anyone can make up crap like that.

I disagree. Currently the RIAA activities are pretty much underground. Flip on FOX, CNN, or any of the talking-head shows or even the nightly news. Not a lot is mentioned of things like this. But I think all it will take is a slow week in the news. Imagine a day when Congress is out of session (like next week sometime) and perhaps a day when nothing terrible has happened domestically. Then, imagine you are a producer for one of the above networks and you come across this sad story of the RIAA suing a woman with MS. It would be a perfect segment, interview her, try and get an interview with the RIAA (I bet they will "decline to comment on current litigation"), and even bring up the statements of the record exec. whose son downloaded copyrighted music, whereupon the record exec. had a "stern talking" to him. Then, perhaps 60 Minutes or Dateline (both terrible news outlets by the way) will pick up the story. Then, in a matter of a week, the RIAA's tactics of behavior modification (which you mention above) will backfire. The results of their litigation will go from striking fear into the hearts of possible consumers to inciting anger and indignation into the hearts of same possible consumers.

I don't know that what they did is perjury. The trial hasn't even started yet. The plaintiff's were trying to show that they meet the prima facia elements of thier case in order to continue to trial after the defendant's motion for summary judgement. Of course this doesn't mean that the plaintiff's attorney's shouldn't be beat with a hose though.

  20. Re:Can we leave appeal to emotion at the door ? on RIAA Mischaracterizes Letter Received From AOL · · Score: 5, Insightful

I believe it is relevant and I'll explain why. The RIAA's interest in this case is not the rewarding of compensation for any damages they have suffered - their interest is in representing to the public (not the courts) that 1) copyright infringement is the same as theft 2) if you steal from them they will come after you and 3) when they come after you you'll not like it at all. The RIAA hopes that after enough of these lawsuits no one will bother with downloading their material because of fear of personally devastating law suits. If this is the case (and I've got to say that I have made AT LEAST one error before in my life) then the RIAA is clearly involved in a public relations campaign - the outcome of individual cases themselves is of little concern. Considering all this, if you find yourself opposed to the RIAA tactics and current IP law in general it would behoove you to make the RIAA out to be a bunch of heartless villains who prey on the disabled. The more terrible they seem the more ground they loose in the PR realm and the more likely they are to protect their IP in a manner more condusive to everyone's long term benefit (e.g. a new business model not so hampered by DRM).

The 'sic' was in response to your use of 'future survival.' It is obvious that any survival is necessarily in the future - thus you repeat yourself when you use it. I also believe that I was quite clear in saying that I hope capitalism is one day replaced with something better. I also "attacked" communism because you say that it is superior to capitalism - this is foolish and you seem unable to address any of the specific points I made about failures in communism. Also - I find your attribution of a certain 'attitude' to myself to be funnier even than your assertion that communism is better than capitalism. Once again I must suggest that you do your research so that you are able to add constructively to the process and not resort to ad hominem attacks about my "attitude." What exactly do you think should replace capitalism? P.S. - I did not misuse 'sic' - from dictionary.com - denote that a word, phrase, passage, etc., that may appear strange or incorrect has been written intentionally or has been quoted verbatim.

So I guess you would have been a proponent of things like the Chinese Cultural Revolution. Yeah, it was great. I hear there was even cannibalism. Or think of some of Stalin's wonderful 5-year plans. Also, the USA is not a democracy - it is a republic which uses democratic processes (I assume your comment of "four year non-plans" was referring to US presidential terms). I find it humorous that you feel the spread of capitalism to former communist areas is a "threat to the future survival [sic] of the human race." Are you serious? Certainly, capitalism has its flaws and will someday (hopefully) be replaced with a better system. But do you truly believe that communism is the answer? Why don't you look at the record of communism? Do you really believe that Stalin's artificial famines are better than capitalism's corporate farms? Instead of expressing your admittedly warranted anger at the US's policies in an ignorant fashion you should do some research so that you are able to add to the discussion/process in a reasonable and thought-out manner.
