The Fair Use argument was negated when he shared them on KaZaA - RTFA, and look at page 15 that is even mentioned in the summary.
But let me point out what I believe ruins the Fair Use argument (IANAL):
Once Defendant converted Plaintiffs' recording into the compressed.mp3 format and they are in his shared folder, they are no longer the authorized copies distributed by Plaintiffs. Moreover, Defendant had no authorization to distribute Plaintiffs' copyrighted recordings from his KaZaA shared folder.
Each of the 11 sound recordings on Exhibit A to Plaintiffs' Complaint were stored in the.mp3 format in the shared folder on Defendant's computer hard drive, and each of these eleven files were actually disseminated from Defendant's computer.
Biggest example I can think of... Will it Blend? http://www.willitblend.com/
It is an ad campaign, but it is also video content. You don't get those kind of advertisements on TV. Maybe that's why online ad watchers are more engaged? The online ads are actually engaging?
Of course, I didn't read TFA. Is it referring to commercials within videos of TV shows online? Perhaps it's that viewers can't change the channel?
It's not an IT story, but it's every bit as much a waste of time as what others are talking about. I'm a music teacher. In my first year, all elementary "specialist" teachers (music, art, PE, etc) were required to attend a six hour course on how to teach the new reading curriculum, because, you know... that's what we teahch... Talk about a waste of time. The classroom teachers that were there seemed bored enough, and basically conversed through the whole presentation. And then, the specialists got split up because we were being too distracting.
The proletariat (from Latin proles, "offspring") is a term used to identify a lower social class; a member of such a class is proletarian. (Wikipedia.org)
I was going for funny, i had put a comment about putting on my tinfoil hat, but it was inside "" so it disappeared because i forgot to set it to plain old text.
Does anyone know if there's such a limit on optimum online? I know they've at least in the past used the word "unlimited" in their ads. I use a decent amount of bandwidth, though I wouldn't think I "abuse" my connection, but I don't really know if they have a policy of cutting off customers after a certain limit. In 10 years, it hasn't been an issue.
Isn't part of Godwin's law that, as soon as a nazi reference is made, the discussion should stop? If so, I guess I'm in just as much violation as the rest of you.
To add to what "I(rispee_I(reme" said, when the cartoon series in the 80s became extremely popular, it was brought overseas to the UK. When brought to the UK, it was renamed "Action Force." Producers were concerned that with such an american oriented title, it wouldn't be successful overseas. When writing the movie, they had the same concern -- that it wouldn't be successful internationally. So that is the reason for much of the multiculturalization the article talks about.
As long as they don't do G.I Joe: War On Drugs.

If we have higher than average economic success, then why do so many of us spend our lives in our mother's basement until we're 40 watching Star Trek reruns? Or is that just the leftists...
I disagree. I don't think that's incompetence. It's an honest admission that more investigating is needed to determine the way these blogs are being infected. Would you prefer them to make up an incorrect hypothesis as to how they're doing this?
>(Do people actually still use AT&T for anything other than iPhones?)
Yes. Since AT&T's purchase of SBC, (basically returning themselves to their pre-trust size) and the lack of any other local phone company in the area, many people have no choice but to use AT&T as the local provider of their land-line. This problem isn't as large as it would have been a few years ago before VOIP, but a lot of people don't like VOIP
From that discussion, a comment by scooter.higher

according to wikipedia, "Malware is software designed to infiltrate or damage a computer system without the owner's informed consent."
Sounds like windows to me...

Ooo, that's pretty cool, but not quite what I'm looking for. Awesome link though!
Does that mean I can finally get a goldfish night light?
Or, you could just change wikipedia so the definitions are swapped. Then you would have been right in the first place.
Yes, Comedy Central ordered 16 episodes to be released as 4 straight to dvd movies, which will also be aired on comedy central.

So are they getting their ideas from EA games now? Because this is basically the "NetBat system" that is used in Battlefield 2142.

When's the last time upgrading an M$ Product to a new version actually saved memory?
Maybe they should make it a poll on the main page. That would be a great scientific survey of all /.ers
