I know it's illegal, by the TCPA from 1991, although the amendments from 2005 turned it into a nightmare (political and prior business association exemptions). It just seems they loophole around or ignore court orders/judgements because they are out of state, out of jurisdiction:

One day, a version 2.0 has to come out and they have to be addressed on a technological level, perhaps protocol. I know that someone probably wants to reply with "Your solution will not work because..." list, but all it requires is critical mass on the part of companies tired of spending money and resources on this crap. Even a legislative solution of no caller id blocking would help tremendously (if you're going to communicate with the person, what's the legitimate use of hiding the number right up to the call/fax?)

Actually, today I wouldn't count on that. That used to be true.
My research indicates that the largest junk faxers faxing stock touts are actually the company involved or closely related, in at least some cases.
The pink OTCBB stocks are not well regulated, so what those companies apparently do is just issue more stock to cover whatever is sold. It's fake.
They apparently make millions doing it, or at least thousands.

On the contrary, I do know how the system works. Jury nullification is pretty much as I have described it, but *the courts* (you know, the ones you said "just judge") have been working to destroy that mechanism (of course, since they are there for power, not for right.) It still exists in some venues, however. The courts haven't managed to stamp the citizens completely into the mud as yet.
I thought you were capable of discussion. Instead, you wipe the slate clean, deriding it as systematically and fatally flawed, and you sound, sir, like a crackpot.
It is, in point of fact, my belief that the legal system is completely, utterly broken, rarely providing anything that remotely resembles justice, often dispensing injustice, almost entirely bereft of fairness, yet standing ready to dispense favor to those with power, money, or both. Compounding matters, it is my belief that a huge number of the laws that the system finds worthy of enforcing are bad, in the sense of being inherently wrong (which I call "evil"), laws. It is my right (still, just barely) to hold and espouse these opinions.
If debate is what you seek, then all you have to do is bring a winning argument to the table. I am perfectly capable of saying, "why sir, you are right, and I stand corrected." That you have failed to do that is not my problem. It is yours. That you have put into a public forum statements that show you do not understand the area of argument is also your fault; but that is not an uncommon result when an attempt is made to defend an inherently flawed idea, ideal, or social structure.
As for the name-calling... definitely a point for you sir, to have so successfully demonstrated your devotion to the character of your profession.

I have found that the populace in general, and the legal profession as a specific sub-sector of the population, very rarely fails to meet my expectations. The both of you have made this mess; and now you shall simply have to live in it. I am certainly not interested in trying to save you from yourself. I just think you should be interested in doing so. But this, alas, requires that you have a fully developed set of ethics, and being in law... well, I'm sure you know what I'm thinking. And why. -

Re:Not a lot, in the UKSounds very similar to the approach taken in the US to go after Junk Faxers. TCPA stipulates for $500/fax received, tripled if the sender had explicit knowledge prior to sending that it was unwanted by the recipient. Fits into small claims in most states. Process = send demand letter, threaten with suit, file small claims suit, show up for single court date. Filing allows you to subpeona phone records, if needed. No lawyer necessary. Many times settlement occurs once they're served. It would work wonderfully if all JF's originated in-state, and if more people made the effort.
I don't think most US spam legislation gives that kind of capability to the average citizen. (maybe in Virginia?) But it's also easier with faxes, since POTS has very clearly defined and recorded sources/destinations for each transmission, unlike spam. FYI: www.junkfax.org

Maybe I can use this to track down the scumbags who send junk faxes to me at all hours of the night and morning, but whose numbers are listed only as "Out of Area". In fact, I bet this would be a handy tool for those who are trying to stop these asshats.

The junk fax link
Telemarketers on cell phones bear a lot in common with junk mail faxes, which are illegal. Junkfax.org explains all about that, and why you should be hearing a cash register every time you get an ad for a cheap tropical cruise!
Telemarketer cell phone calls are similar to unsolicited telemarketer faxes in that the recipient of the ad is required to pay to get the message in front of them. It doesn't matter if it's toner and paper or minutes, the cost is there. -

The first result was junkfaxes.org. Another site is starting a class action lawsuit againt fax.com, one of the most previlant junk faxers. Fax.com also happens to be the scumbags faxing my line at least once a day, even when I shut off the fax machine.
The bottom line is you can't do it alone. The only way to get any results is to join a class action suit, or get the FCC involved. They will either fabricate evidence to stall and/or increase you legal expenses, or if you do win, they will just refuse to pay. I have no time right now to bother with this crap, so I just save all the faxes and hope I'll get a few bucks when the class action suit goes through. -

Fax.com is a nasty outfit. Read this dossier on them. Also read this story and this FCC report and this lawsuit by the California Attorney General's office which detail the kind of sleazy behavior fax.com and its constituents engage in.

junk fax analogy
I agree with this approach and am surprised more people don't promote it. The anti-fax law appears reasonable, constitutional, and strangest of all effective.
The "junk fax" law in enforceable privately in state court, but also by the FCC.
Interestingly, here is a recent Missouri decision declaring the statute a violation of freedom of speech. I haven't looked closely at this aberrant ruling, not because junk faxes aren't speech (they are), but it appears wrong because of the way it analyzes Congressional intent.

websites and mailing listsAs others have mentioned, in the US there is a law against this and you'll probably need to get your company's lawyers involved.
There are a couple of resources for you and your lawyers to get started with. junkfax.org and http://www.junkfaxes.org are two separate websites dedicated to the cause, the second has an excellent mailing list where you'll find advice and experience on going after junkfaxers with the TCPA law.

When I worked for him at INFOSEEK, the company was immoral THROUGH and THROUGH.
I was asked to LIE about logs by the CFO, and their CTO, Patrick Naughton is an ADMITTED PEDOPHILE (he plead guilty when he was caught). -

Re:Cash in!The TCPA also provides for the same ammount for each spam fax you get. Unfortunately, tracking down and nailing spamfaxers can be difficult, although not impossible.
I'd expect the average telemarketer is a little less savvy about the subtle nuances of the TCPA and might be a decent target, especially in the case of cell phone spam.
