I've always held the opinion that the real winner of the console wars will be the one that first releases an openly programmable console. Sure, you'd lose on charging for the dev kits, but your hardware sales would increase sharply (think PalmPilot).

Take the C64 for example.. It enjoyed long-lived success because it had some neat commercial software, and the hackers made it into a great machine. Almost everybody and their cat had one. There are still some in service today.

I think this is Microsoft's plan for their "X-Box", except you'd be tied down with Microsoft compilers and, of course, Windows.

If someone like Sony, Sega, or Nintendo released a programmable console, it'd be awesome, crush the competition, and live forever.

These lawyers are working for free (or much less than they could get by going over to the Dark Side) and don't deserve this kind of abuse.

Section 48 of this request states that we supposedly "have received notice through the MPA and refused to remove the information at issue". This is absolutely false! We have never received any such request (from the MPA or anybody else for that matter) and we obviously were not given the opportunity to refuse! Either Jared Bobrow needs to go back to law school or the DVD CCA needs to get a new firm. This is the kind of sloppy work that could get an important document thrown out.

Explanation on legality of this information

The software (source as well as binaries) offered on this site can be freely redistributed because it was published under the GNU General Public License. The purpose of this software is not illegal copying of DVD disks. It is meant to provide information necessary to be able to program a DVD player for Linux. To do this, the CSS system needs to be incorporated in the player. Recently the (very weak) DVD content scrambling system was deciphered, freeing the way for a Linux DVD player. The CSS system is not a copy protection system, since it does not prevent copying of the disk. Writing information about the way an encryption scheme functions is completely legal. The source code and binaries on this site are completely legal too, since they contain no code from the DVD consortium or its members. The sources and programs on this site were written by third parties using clean-room reverse engineering methods which are (ready?) completly legal.

Attention www.rhythm.cx was hosting a list of mirrors for these files. That list of mirrors has been replaced with a page reading "This site has been taken down for legal reasons." Here's what the maintainer put on the site the day it was shut down:

However, I have only seen very few mirror _lists_ like this one anyplace. If anyone has the resources, it might be wise to mirror this list of mirrors as well so that the right people will still know that these mirrors exist.

Earlier, on the advice of legal counsel, I was advised against giving my name while talking to Emmett, but I've come to realize that "duck and run" isn't the most effective course of action when being hit with suits like this. I've taken down my mirror temporarily, and I look forward to putting at back up as soon as I hear something about the decision (I am on the opposite side of the country). It'll be interesting to see how everything pans out this morning.

You're right, a good reading of the injunction makes clear that they're not defending the terrible copy protection in the dvd mechanism. However, this has a lot to do with recent changes in the U.S. copyright laws, I recommend that folks read H.R. 2281 - The Digital Millenium Copyright Act. The Library of Congress has an easier to read summary online.

What it really comes down to is that the defendants were informed that they should have removed the offending materials and refused to do so (it's right at the top... of the injunction right beneath the 69K of MS-XML.) They can't touch the guy who wrote DeCSS because he complied upon notification of transgression.

If you haven't yet actually read anything about the DMCA, you'll find the WIPO/Title I sections useful in understanding what they new laws have to say about reverse engineering of the sort used in DeCSS. WIPO is the World Intellectual Property Organization, and Title I is the U.S. Congress ratifying general new international agreements about intellectual property. Read Educause's summary, particularly the section on: "Prohibitions on Circumvention of Technological Protection Measures ."

ps: Given the specific burden of proof placed upon service providers and their DMCA agents given by the DMCA, I'm especially shocked that some of the defending sites were .edu sites. Since we're (academic sites == service providers) monetarily culpable if we don't take "prompt" action upon notification, seems like someone at rpi dropped the ball.

This part doesn't take effect for a few months, but see if you don't find it the slightest bit relevant (and frightening):
''(b) ADDITIONAL VIOLATIONS.--(1) No person shall manufacture, import, offer to the public, provide, or otherwise traffic in any technology, product, service, device, component, or part thereof, that--

In most instances, "reverse engineering" is an acceptable option for creating new products. However, there are legal and ethical limitations that must be considered.

Reverse engineering is a common procedure that typically involves the disassembly, examination, and analysis of a product to reveal its design and function. Normally, this is done for competitive analysis, and sometimes for the purpose of building and selling a similar product. It is legally and ethically acceptable for a company to purchase a commercially available product, to analyze it thoroughly, to design and develop a similar product and a method for its manufacture; provided the new product and method do not violate the patent rights of another company.

Seems to me (and I'm NOT a lawyer, nor do I play one on TV) that the programmers were completely within their rights here. What really jumps out at this letter at me is that NOWHERE do they reference an actual patent number that I could look up. If they did, I'd be able to pick it apart a bit more; I can only assume that they intentionally left this out of the document because they're hoping a judge isn't smart enough to ask for it. I would think that if the patent helps their cause, they'd certainly quote it or reference it. My understanding of their letter is that they have their panties in a knot over illegal copying and distribution. The fact is, none of these defendants has been accused of either copying or distributing DVD movies. To quote the letter again:

49. Defendants knew or should have known when they posted or provided "links" to the DeCSS program on their web sites that it was being made available by virtue of the unauthorized use of proprietary information and that they were misusing proprietary confidential information gained through improper means. This is because the DeCSS program has the capability to defeat DVD encryption software and, as a result, the DeCSS program allows users to illegally pirate the copyrighted motion pictures contained on DVD videos - - activity which is fatal to the DVD video format and the hundreds of computer and consumer electronics companies whose businesses rely on the viability of this digital format.

Two things about this scare the living hell out of me. First, this business about "the DeCSS program allows users to illegally pirate the copyrighted motion pictures contained on DVD videos": Sure, it makes such things possible. At the same time, one can mix fertilizer, black powder and some other goodies together such that one could blow a building to hell. A camera makes it possible for one to observe you in the shower. A photocopy machine makes it possible for one to distribute damn near any document. But nobody's sueing Miracle Grow. Nobody's sueing Kodak. Nobody's sueing Xerox. See, the fact that Product X enables one to achieve a nasty objective DOES NOT make Company X liable. This has been established time and time again in the court system. And it holds, so long as Product X's primary purpose is NOT to assist in achieving the nasty objective. The software in question IS NOT written to aid in copying DVDs. It's NOT written to aid distributing illegal copys. It's primary objective was to make DVD's playable on Linux. Quite legal, if ya ask me.

Now, the second thing that really worries me here is that they're going after people who were NOT distributing the software. There are sites on that list who just LINK to the software, or a site that distributes it. Hasn't at least one prior ruling already said that this is a legal activity? If it's not, God help Google, and any other search engine out there. Or anyone who links to anyone who links to the software. And so on.

I'm also completely unsure if this program is anywhere near the stuff used by the licensed friends of the DVD CCA. If they're totally different, and don't make use of the same proprietary algorithms, etc, the case has just grown exponentially weaker. Me thinks that if these guys get shot down, someone oughta rewrite the program such that it doesn't use anything from Xing except the key - and whoops, that can be brute forced in a matter of weeks once a non-proprietary algorithm implementation is in place (see distributed.net efforts w/weak encryption cracking).

Anyways, I highly encourage these defendants to pull together and find a decent defense attorney (anyone out there who is one, and reads slashdot...?), and make sure that DVD CCA doesn't force them to bend over and take this...

I just read the email here, and I must say, they have a point in there somewhere. Specifically this:

31. Before allowing their copyrighted motion pictures to be used on the DVD format, the motion picture companies insisted on a viable copy protection system to prevent users from making copies of the motion pictures. Such protection is necessary to prevent copying from discs that are rented or borrowed and, more importantly, to prevent broader scale piracy through widespread transmission of these motion pictures over the Internet and widespread distribution of "pirated" discs in competition with the authorized prerecorded discs.

Essentially what they are saying is DVD would be dead if it had no copy protection. The movie companies who own the copyright on these things won't use DVD at all if there's no copy protection. Plain and simple. No copy protection, no Matrix on DVD.

I'm not agreeing with them, though. So don't flame me. They just have a point.

Actually, Sega Rally 2 does.. Imagine the horror I experienced when I popped the disc in and saw this image pop up on the screen.

I managed to crash it too, I popped the disc out while it was at the title screen and it returned me to the main dreamcast menu, and the right half of the screen flashed for like 10 seconds and then it just locked up.

Here is the most recent version of the css-auth CVS code as well as DeCSS. Please mirror & redistribute.
This page was originally a mirror of http://www.rhythm.cx/dvd/, but then rhythm.cx was forced down.
So I've taken it on myself to keep a list of mirrors. I try to update and check the status of the listed sites at least once per day. If you know of any mirrors not in my list, if you wish to mirror this page, or if you find that any of the listed sites went down, then contact me.

The software (source as well as binaries) offered on this site can be freely redistributed because it was published under the GNU General Public License. The purpose of this software is not illegal copying of DVD disks. It is meant to provide information necessary to be able to program a DVD player for Linux. To do this, the CSS system needs to be incorporated in the player. Recently the (very weak) DVD content scrambling system was deciphered, freeing the way for a Linux DVD player. The CSS system is not a copy protection system, since it does not prevent copying of the disk. Writing information about the way an encryption scheme functions is completely legal. The source code and binaries on this site are completely legal too, since they contain no code from the DVD consortium or its members. The sources and programs on this site were written by third parties using clean-room reverse engineering methods which are (ready?) completly legal.

www.rhythm.cx was hosting a list of mirrors for these files. That list of mirrors has been replaced with a page reading "This site has been taken down for legal reasons." Here's what the maintainer put on the site the day it was shut down:

NOTE (Thu, Nov 11, 12:17pm EST): I've recently been informed that a law firm which is likely to be one that would try get these mirrors taken down has been visiting this mirror site as well as others. With that said, there is a possibility that I may have to remove this site in the near future because like everyone else, I can't afford to go to court to fight it. Luckly, it seems fairly unlikely that any law firm will ever be able to get rid of all these mirrors at this point (there are currently 41 in 8 different countries and this list is growing every day). However, I have only seen very few mirror _lists_ like this one anyplace. If anyone has the resources, it might be wise to mirror this list of mirrors as well so that the right people will still know that these mirrors exist.

Explanation on legality of this information:

The software (source as well as binaries) offered on this site can be freely redistributed. It was written by authors who expressly permitted and encourage the redistribution of this software and information. The purpose of this software is not, I repeat not illegal copying of DVD disks. It is meant to provide information neccesary to be able to program a DVD player for Linux. To do this, the CSS system needs to be incorporated in the player. Recently the (very weak) content scrambling system was deciphered, freeing the way for a Linux DVD player. The CSS system is not a copy protection system, since it does not prevent copying of the disk. Writing information about the way a certain protection scheme functions is completely legal. The source code and binaries on this site are completely legal too, since they contain no code from the DVD consortium or one of its members. The sources and programs on this site are purely written by 3rd parties using clean-room reverse engineering methods, which is, again, completely legal. This software and information below make it possible for people who legally obtained their DVD movies to view them on their Linux systems.

www.rhythm.cx was hosting a list of mirrors for these files. That list of mirrors has been replaced with a page reading "This site has been taken down for legal reasons." Here's what the maintainer put on the site the day it was shut down:

Luckly, it seems fairly unlikely that any law firm will ever be able to get rid of all these mirrors at this point (there are currently 41 in 8 different countries and this list is growing every day). However, I have only seen very few mirror _lists_ like this one anyplace. If anyone has the resources, it might be wise to mirror this list of mirrors as well so that the right people will still know that these mirrors exist.

Haven't played Soul Calibur (yet), but as a Sonic Adventure owner, I can say that the game sure pushes the graphics hardware. One look at the first level of the game sold me on a Dreamcast. It's not too bad to listen to either (:

After cracking it open (figuratively speaking of course) the DC modem appears to use only about 1/3 of the pins available to it on the "expansion" port. As a sidenote, the only visible chips on the board appear to be a Rockwell R6785-19 chipset and a custom Sega chip, model number 315-6137.

There is a serial port on the back of the console, but that seems to be better placed or suited for unit-to-unit connections rather than anything high speed (like ethernet).

People have been using that phrase for longer than AOL has been in existance. It'd be interesting if they tried to trademark the phrase "AOL Sucks". At that point I guess we wouldn't be able to say that in public without getting sued, either.
