Slide show misrepresents the legal case
Okay, there are plenty of comments analyzing the code in SCO's slide show. Let's have a look at the legal argument.
Slides 3, 4, and 5 document SCO's contract with Novell to acquire Unix IP. I don't see anything funny there.
The funny part is on slides 6 and 7. Slide 6 contains excerpts of the AT&T License Agreement with IBM. Slide 7 contains more excerpts from the AT&T License Agreement with IBM, except that "AT&T" is changed to SCO in one place.
However, this is just the Licensing Agreement. This just the contract that allows IBM to use AT&T Unix within its organization.
Beyond this contract, IBM also has a Sub-Licensing Agreement. The sub-licensing agreement allows IBM to sell Unix products to its customers. SCO's presentation does not talk about the sub-licensing agreement at all, but this agreement is one of the contracts filed with the Court.
To draw an analogy: the License Agreement is like the agreement that lets you run Windows on your PC. The Sub-License Agreement is like the contract that lets Dell sell Windows to other people. SCO's presentation quotes the License Agreement, and says that license prohibits IBM from distributing code. But SCO's presentation ignores the Sub-License Agreement, which allows IBM to sell UNIX to its customers.
On top of that, IBM has a third agreement with AT&T which grants IBM additional rights on top of the Sub-Licensing Agreement. The third agreement explicitly states:
2. Regarding section 2.01, we agree that modifications and derivative works prepared by or for you are owned by you.
7.06(a) Nothing in this agreement shall prevent LICENSEE from developing or marketing products or services employing ideas, concepts, know-how or techniques related to data processing embodied in SOFTWARE PRODUTCS subject to this Agreement, provided that LICENSEE shall not copy any code from such SOFTWARE PRODUCTS into any such product or in connection with any such service and employees of LICENSEE shall not refer to the physical documents and materials comprising SOFTWARE PRODUCTS subject to this Agreement when they are developing any such products or service or providing any such service.
You can read the contracts for yourself. They are Exhibit A, Exhibit B, and Exhibit C at SCO Lawsuit Documents.
So IBM has an explicit right for their engineers who have worked on the UNIX source code use ideas, concepts, know-how, or techniques in other IBM products. IBM paid good money for this right from the lawful copyright holders. (This may explain why SCO is attacking the Sequent contributions, because Sequent doesn't have as much rights in its contract as IBM has in theirs).
This brings us to Slide #22, where an IBM engineer posts information about his experience with scalability in AIX. Under section 7.06(a) above, IBM has the explicit right to disseminate such information about Unix (let alone IBM's rights to talk about property which is purely theirs, such as JFS).
SCO knows this. SCO filed these contracts with the Court (accessible through Pacer) and SCO also published these contracts on their web site.
I would love for reporters to dig into the actual exhibits and ask questions based on the exhibits. Just hit the SCO Lawsuit Documents link above and read the exhibits. -

By their actions, they condone the GPL
Actually, I think you have this backwards. By distributing Samba (and for that matter, Linux) under a GPL license they have implicitly agreed to the terms of the GPL. They can argue until they're blue in the face that the GPL is invalid, but their words hold no merit if their actions say otherwise. It would be like standing on a street corner and yelling "There is no right to free speech!" - it makes no sense (the Chewbacca defense?). IDHTBAL (I don't have to be a lawyer) to show that their actions undermine their arguments.
Of course, technically they're only agreeing to the GPL if they distribute the software. So let's all go to SCO's ftp site and download some GPL'd code - preferably a nice big package, like kernel-source-2.4.19.SuSE-152.nosrc.rpm ,for example. -

Note that this exact same non-enforcement argument could apply equally well to the "stolen code" example that SCO showed yesterday. It has already been well-established that the code was published as far back as the 1970s and no real attempt has been made to restrict its redistribution until now. Why does SCO get to claim outrageous damages after 20 years of looking the other way, but when they trample over the GPL, they're home-free?
It infuriates me that anyone in the press can take SCO's position seriously. It is so full of obvious contradictions that do not require any real IT or legal knowledge to figure out. Shouldn't businesspeople have more critical thinking skills than this?

I don't think so. Look at a Unix timeline and you will see that this code, which appears to have been written around the beginning of 1973, predates not only BSD but all other C/Unix versions. It's effectively been there since day one.

IBM's contract explicitly states that IBM owns the copyright on work that IBM does, and IBM may use methods and ideas from Unix in their own works, as long as they don't actually copy literal code.
Sequent's contract doesn't have that clause and is silent on that matter.

How secure can it be if it's PROPRIETARY?Many Unix geeks, particularly on Slashdot, have praised Apple's decision to base Mac OS X off of the enterprise-ready BSD codebase. However, it seems that most have never actually taken a closer look at this OS. If they had, a closer inspection would reveal that Apple's philosophy toward *nix and Linux compatibility has been one of "embrace and extend", and this is meant in the M$ sense. Wherever possible, Apple has engineered their operating system to be incompatible with industry standards. Simply put, Mac OS X is a nonstandard, bastardized Unix that bears about as much resemblance to the real thing as does, say, Windows ME.
Let's start with the windowing environment, since that is the first thing users will notice. While both KDE and GNOME are mature, stable, and accepted as IEEE standards, Apple has elected to use neither. In fact, they don't even use X at all! Their display system is a proprietary, closed-source system called Quartz Extreme. In addition to the moral issues involved with closed software, this precludes the user from running X apps. There is an untested and alpha-quality X11 emulation layer available for download, but it is emulation, so programs will be slow. Does this sound like a standards-based system to you?
Looking under the hood, it gets worse. While all other *nixes use standard ELF binaries, Darwin (Apple's name for their proprietary "Unix" kernel) does not. It uses Mach-O, an unproven format that is proprietary to Apple. The moribund FreeBSD, off which OS X is based, uses ELF, so clearly Apple went to the extra effort of "switching" (heh) simply to break compatibility. With ELF, users would be able to run most of their Lunix apps; with Mach-O this is impossible. Additionally, Apple has moved most configuration info fromhuman readable text files into a proprietary database called "NetInfo", which is much like the Windows registry we all loathe. Why? These are only a few of the ways that Apple has deliberately broken compatibility with other systems, presumably in order to lock users in to expensive Mac hardware.
When we factor in the threat to users' civil liberties that is posed by the DRM included to support the iTunes Music Store (do you really think it will end there?) it is obvious that real *nix gurus should give OS X a wide berth. Caveat emptor.

SCO needs the GPL, apparently.
Checking out the head lines on CNet, and after reading some of the article, one might start to think SCO "might" have a case. But again, still no one has seen this code. But the more intersting thing I realized was this: SCO is now poo-pooing the GPL and questioning the "legality" of teh GPL. Then I got to the end of this CNet article and how the talked about the next release of OpenServer. It states that OpenServer would "provide better compatibility with Microsoft Windows through version 3 of Samba". I had to double check, but Samba is most definately GPL'd. Npw lets have a look at whats in Open Server 5, you'll see a good portion of it includes GLP software. So is this a "do as we say, not as we do" sort of thing?
