Researchers from Stanford and a defense research group at Rafael will demonstrate a way to spy on smartphones using gyroscopes at Usenix Security event on August 22, 2014. According to the "Gyrophone: Recognizing Speech From Gyroscope Signals" study, the gyroscopes integrated into smartphones were sensitive enough to enable some sound waves to be picked up, transforming them into crude microphones. -
Earth In the Midst of Sixth Mass Extinction: the 'Anthropocene Defaunation'
mspohr writes: A special issue of Science magazine devoted to 'Vanishing Fauna' publishes a series of articles about the man-caused extinction of species and the implications for ecosystems and the climate. Quoting: "During the Pleistocene epoch, only tens of thousands of years ago, our planet supported large, spectacular animals. Mammoths, terror birds, giant tortoises, and saber-toothed cats, as well as many less familiar species such as giant ground sloths (some of which reached 7 meters in height) and glyptodonts (which resembled car-sized armadillos), roamed freely. Since then, however, the number and diversity of animal species on Earth have consistently and steadily declined. Today we are left with a relatively depauperate fauna, and we continue to lose animal species to extinction rapidly. Although some debate persists, most of the evidence suggests that humans were responsible for extinction of this Pleistocene fauna, and we continue to drive animal extinctions today through the destruction of wild lands, consumption of animals as a resource or a luxury, and persecution of species we see as threats or competitors." As pretty much anyone who has ever used YouTube (or any similar service) knows, the DMCA has a lot of issues. For one, there's the fact that individuals or companies who file false DMCA claims, which are supposedly punishable under the law, are never punished. Another would be the unfair application of the DMCA - partners and other monetized channels on YouTube will (almost) never have their videos taken down from a single DMCA claim, even if a video made under the same circumstances and containing similar content would be taken down on a non-partner channel if a DMCA notice was ever filed. Is the EFF planning to do anything lobbying-wise to fix the DMCA? If so, what in your opinion would be the way to go about fixing it?
Granick: I don’t work for EFF anymore, so I can’t speak for their plans or thoughts.
The DMCA has two main parts, the notice and take down provisions, and the anti-circumvention provisions. By and large I think the notice and take down provisions are livable. the burden for specifically identifying infringing content is and should remain on rights holders. In making those identifications, there is the problem of unpunished abuse, and even just plain mistakes. Sometimes, legitimate content is improperly taken down and not restored. But overall, that system is allowing non-infringing content to flourish, and even enabling alternative business models for licensing and monetizing.
The anti-circumvention provisions, also called section 1201, are fundamentally broken. They interfere with people’s freedom to explore and modify software and devices that they themselves own. I support currently stalled efforts to reform section 1201 by protecting cell phone unlocking. If want to just address phone unlocking, there’s a right and a wrong way to do it. https://cyberlaw.stanford.edu/blog/2013/03/heres-how-legalize-phone-unlocking Still, these efforts fall short. Section 1201 could be and should be modified to regulate tools designed for infringement and leave mere access and tools that enable access alone.
Role of DMCA and free markets

Do you see free market innovation thriving with DMCA despite the apparent lack of innovation? Articulation of my question: When I buy a car, I can modify it. If people like my modification they can view it at my leisure and tinker themselves. GM doesn't sue me, and if I open a business to work on other GM cars to do similar GM vehicle modifications, then I have little legal exposure. However, with DMCA, GM can shut down a video if it's "suspected" I've infringed on a digital asset, and I can't legally sell modifications of their digital asset. This is why we see every new technology for digital streaming of data run a gauntlet of legal hurdles, which in turn stifles new innovation in the area of digital property.
Granick: The anti-circumvention provisions of the DMCA haven’t totally killed innovation even as they hamper it in a number of ways. The EFF has been documenting those ways.
Re:European "right to be forgotten"

Could you explain the "right to be forgotten" concisely and effectively so that people don't assume it grants "freedom not to be talked about"? Every story on Slashdot and every other news site with comments gets hundreds of angry responses from people who have completely the wrong idea about it.
Granick: The new case from the European Court of Justice says that people can compel search engines to remove certain reputation-harming search results that are generated by searching on the individual’s name. The ruling does not establish a “freedom not to be talked about” generally. But it is too broad. It interferes with the sanctity of search, which should be about getting people the most relevant results. Instead, it allows individuals to try to hide information about themselves, even if true. And the standard to be applied is horribly vague — search results are to be excluded if they are “inadequate, irrelevant or no longer relevant”. Companies will likely err on the side of caution and remove links upon request, regardless of the public interest in the information.
ECJ Google Spain v AEPD: privacy vs expression?

You must deal with the clash between freedom of information (and expression), like in the Schwartz-case, and the right to privacy (and to be forgotten, even by agencies such as the NSA), every day.
What is your opinion on the Court of Justice of the European Union's Grand Chamber judgement in C-131/12 (Google Spain v AEPD and Mario Costeja Gonzalez)? The court ruled that the fundamental rights to privacy and data protection should, ‘as a rule’ override ‘not only the economic interest of the operator but also the interest of the general public in finding that information’. However, in certain circumstances, there may be a preponderant interest of the general public (for instance, if the individual concerned was a public figure) [97].[...], this is an assessment which must be made by the national court [98]. One commentator (Guy Vassall-Adams) noted that: "It appears that the court never asked itself if these large corporations can be relied on to protect the public interest in freedom of expression, taking a principled stance in response to unmeritorious complaints, as opposed to simply following the easy (and cheap) course of erasing information on request. Across the Atlantic and around the world other countries will look on us with bemusement as they read information which we are denied. This judgment is profoundly harmful to the operation of the internet and a betrayal of Europe’s great legacy in protecting freedom of expression."
Do you think the Court struck a good balance between the rights to privacy and freedom of expression? Can we expect a similar ruling by the US Supreme Court?...
Granick: For the reasons above, I think the ruling is a big mistake. I don’t believe this rule would be possible in the United States, as it almost certainly violates the First Amendment.
...What is your opinion on the Streisand effect of such cases (everybody knows that Mario Costeja Gonzalez was at one time involved in bankruptcy proceedings, because this is in ECJ case).
Granick: This individual will go down in history for both bankruptcy proceedings and for engendering one of the more confounding privacy rulings of the decade.
How to fight harder and win

Ms. Granick, thanks so much for taking the time, your expertise on this issue is very valuable! I was an intern on Capitol Hill and was able to sneak into the Senate Judiciary Committee hearing on updates to the DCMA where Metallica and Shaun Fanning testified. My question: On issues of digital technology and freedom how can we, the people of the US, fight harder & win?
What represents a "win" against the RIAA/MPAA or a "win" for net neutrality? If all we need is Congress to pass Common Carriage why is it so difficult to get done? Ever since I attend that Senate Judiciary hearing, and I learned the issues, I realized it's always the same groups opposing digital freedom. What do we have to do to fix these issues forever so we can move on to better problems?
Granick: I’ve become even more disillusioned with Congress than I already was. I think money in politics is a huge problem. Its polarizing the politicians such that they do not do what the public wants even when there is a general consensus. Lawmakers can’t agree so they propose laws that do nothing and please no one, and then those bills do not pass. I remain optimistic, but we need to get all the pieces of democracy healthy again—free press, level playing field, educated populace—before Congress is going to be a fruitful avenue for the public interest to win. This is why I support the Rootstrikers and Larry Lessig’s MayDayPAC.
Re:Can Privacy ever actually be Maintained?

a follow on to this that is more personal. Without a doubt EFF has been owned 20 times over by NSA, not to mention anybody who works as a director of internet civil civil liberties. Personal stuff too. emails, bank records. Email accounts of your family, friends, and friends of friends (3 hops)! And unlike most NSA snooping which seems to be captured for the glee of capturing, your stuff is probably pretty closely monitored.
Do you think about this or worry about this? does it change your online behavior, or relationships with friends and family?
Granick: This has changed my behavior. I use encryption now far more than I did, for emails, texts and for phone calls. The people I communicate with are not that tech savvy though, and so that limits my ability to encrypt all the time. I use cookie blockers now, when I didn’t before. I don’t want Facebook tracking what I read. If I had more privacy friendly options, I’d use them. People often preface things they say to me with, “If the NSA is listening, they may not understand this, but” I find that terrifying, that people are afraid to be honest with their friends, and eventually maybe with themselves, for fear of government overreaction.
But I haven’t given up and you shouldn’t either. The idea isn’t complete secrecy, but to make opportunistic mass surveillance and bulk data collection impossible, and to make investigating people expensive again. That is one way we can ensure that such investigations happen for good reason, i.e. when they are worth the trouble. A great essay on the inevitability of privacy is by @neilmrichards: Privacy is Not Dead—Its Inevitable There’s also a great essay by Eben Moglen on why privacy is not hopeless. He says Snowden distinguished “between those forms of network communication that are hopelessly corrupted and no longer usable, those that are endangered by a continuing assault on the part of an agency gone rogue, and those that, even with their vast power, all their wealth, and all their misplaced ambition, conscientiousness and effort, they still cannot break.”
Where is personal privacy going?

Ms Granick, I'd really appreciate your perspective of where you think the personal privacy equilibrium will be. What personal privacy protections do you believe will survive the next 20 years in the US?
Do you believe that there will be individual control of personal information that will have suffice force of law to be functional meaningful in the US? Do you believe those protections will be useful if the information is stored outside the US?
Granick: I believe the Fourth Amendment is going to evolve in constructive ways such that it will still be relevant to privacy in 20 years. I think we’re going to reform statutes to provide location privacy. There’s a lot of support for that. And I think we’re going to have a single rule for law enforcement access to communications content from public providers. Beyond that, I think we’ve got work to do.
My opinion is that the location of data is not going to be a major factor in whether our government accesses it, except to the extent that it can do more mass surveillance of unencrypted data overseas at this point in time. I think that’s going to (slowly) change for technological and political reasons.
Campaign Finance Reform

It seems that no matter which party we vote for, we get either corporate-funded stooges or patronizing paternalists, like Dianne Feinstein of California. The media are complicit in this miscarriage of justice with their anointed "serious" candidates and "wasted" votes, for various reasons probably including the high amounts of money that they receive during campaigns.
So, what do you think about Larry Lessig and his change of focus from free culture to Congressional corruption?
Granick: I admire Larry immensely for the work he’s doing now on money in politics and for his innovation and commitment to the cause. I support the MayOne PAC wholeheartedly, and hope you will too.
Reconcile wisdom vs. technological savviness

Slashdot has had a lot of discussion recently with regard to the (perception of the) Supreme Court justices (apparent) lack of technological savviness due to their age. This is pervasive throughout all of our government, from federal to local and throughout all three branches. Classically, this was desirable for the wisdom that comes with age, the prevention of coercion for the independent Supreme Court and/or the perks that could come from having a representative with seniority.
How do you see evolution of our government in a future where technological advances come at an ever increasing pace?
I.e., how does our government reconcile the need for wisdom in governance with the need for an understanding of the technology in the modern world, and the application of laws against it?
Granick: There are lots of informal ways to address this. For example, Supreme Court clerks are from a different generation, and understand cell phones. There are tech trainings for judges. I’ve attended them. Overall, I think the older judges are getting the point that technology matters, and they are trying to do better. The recent Fourth Circuit opinion in Lavabit got the tech, for example. Of course, you start with awareness that there’s a problem, and solving it is another matter. But its solvable.

Hey Jennifer, I just thought of another question. What is your opinion on cyber bullying and litigation?
E.g. a bully posts sensitive personal data about someone, and he or she wants that data to be "forgotten" by search engines, web hosts etc. (data processors). To obtain this result, he or she would have to go to a court, and because of the fact that most court proceedings are public and published (in the EU, at least, and let's assume this is concerning an adult, because in most countries, court cases involving minors are closed), this information would be even more widely broadcast, through the public records of the courts.
Is this a legal catch 22, do you see any solutions for these kinds of victims?
Granick: Courts deal with confidential information all the time, like in trade secret cases. And I think those tools can be used to hide sensitive personal data like addresses, credit card numbers and the like during litigation. But there is a bigger problem you are touching on here which includes “revenge porn”, upskirt photos, pictures of college kids passed out from drinking too much, and the like. Our society hasn’t developed a good way of dealing with these privacy violations yet. I do not think the law should change to make Internet search engines or platforms legally responsible for policing this content. Such changes may threaten public access to embarrassing information about politicians, for example. But while we figure out how we should respond, some people are suffering. So far this is a Catch-22, and I look to markets, technology and norms to develop into the main drivers for mitigating this serious problem.

Stanford Getting Rid of $18 Billion Endowment of Coal Stock
mdsolar sends this report from the NY Times: "Stanford University announced Tuesday that it would divest its $18.7 billion endowment of stock in coal-mining companies, becoming the first major university to lend support to a nationwide campaign to purge endowments and pension funds of fossil fuel investments. The university said it acted in accordance with internal guidelines that allow its trustees to consider whether 'corporate policies or practices create substantial social injury' when choosing investments. Coal's status as a major source of carbon pollution linked to climate change persuaded the trustees to remove companies 'whose principal business is coal' from their investment portfolio, the university said." -

Security At Nuclear Facilities: Danger Likely Lurks From Within
mdsolar (1045926) sends this excerpt from the Stanford Report: "Insider threats are the most serious challenge confronting nuclear facilities in today's world, a Stanford political scientist says. In every case of theft of nuclear materials where the circumstances of the theft are known, the perpetrators were either insiders or had help from insiders, according to Scott Sagan and his co-author, Matthew Bunn of Harvard University, in a research paper published this month by the American Academy of Arts and Sciences. 'Given that the other cases involve bulk material stolen covertly without anyone being aware the material was missing, there is every reason to believe that they were perpetrated by insiders as well,' they wrote. And theft is not the only danger facing facility operators; sabotage is a risk as well ... While there have been sabotage attempts in the United States and elsewhere against nuclear facilities conducted by insiders, the truth may be hard to decipher in an industry shrouded in security, [Sagan] said. The most recent known example occurred in 2012 – an apparent insider sabotage of a diesel generator at the San Onofre nuclear facility in California. Arguably the most spectacular incident happened at South Africa's Koeberg nuclear power plant (then under construction) in South Africa in 1982 when someone detonated explosives directly on a nuclear reactor." -
Physicist Proposes a New Type of Computing

Turner calls his idea orbital computing. Turner points to recent discoveries (including a new material that allows rapid switching of its electron states and new low-power terahertz laser technology) that could lead to the development of a computer with vastly improved performance over current technologies." -
Stanford Bioengineer Develops a 50-cent Paper Microscope
An anonymous reader writes "Scope: A Stanford bioengineer has developed an ultra-low-cost print-and-fold microscope and is now showing others how to make one themselves. The 50-cent lightweight, paper 'Foldscope' — which 'can be assembled in minutes, [and] includes no mechanical moving parts' — was designed to aid disease diagnosis in developing regions." The Mammoth Cometh: Revive & Restore Tackles De-Extinction

Now, in The Mammoth Cometh, this week's NY Times Magazine cover story, Nathaniel Rich writes that 'bringing extinct animals back to life is really happening — and it's going to be very, very cool. Unless it ends up being very, very bad.' Among the 'genetic rescues' being pursued by The Long Now Foundation's Revive & Restore project is The Great Passenger Pigeon Comeback. And returning a flock of passenger pigeons to the planet is just the tip of the iceberg. 'We're bringing back the mammoth to restore the steppe in the Arctic,' says Stewart Brand. 'One or two mammoths is not a success. 100,000 mammoths is a success.' De-extinction, while no doubt thrilling ('It would certainly be cool to see a living saber-toothed cat,' Stanford's Hank Greely and Jacob Sherkow argued in Science), is disturbing to many conservation biologists who question the logic of bringing back an animal whose native habitat has disappeared, worry about disease, and are concerned that money may be diverted from other conservation efforts." -
Face Masks Provide Chinese With False Hope Against Pollution
Hugh Pickens DOT Com writes "Emily Sohn reports at Discovery Magazine that high levels of air pollution in Beijing, where levels of pollution have spiked above 750 micrograms per cubic meter, have caused a run on face masks as people look for ways to protect themselves from the smog. The capital is on its sixth day of an 'orange' smog alert — the second-highest on the scale — with the air tasting gritty and visibility down to a few hundred meters. But experts say that under the hazards they're facing, the masks are unlikely to help much. In fact, images of masked citizens navigating the streets of Beijing highlight the false confidence that people put in face masks in all sorts of situations, including flu outbreaks and operating rooms. For a step up in protection, consumers can buy a category of mask known technically as N95 respirators, which are generally available at hardware stores. N95 facemasks are often used in industrial workplace situations to protect against things like lead dust and welding fumes, and they are certified by the National Institute for Occupational Safety and Health to trap 95 percent of particles sent through them in testing situations. But in order to work N95 respirators need to be professionally fitted to each person's individual face (PDF) to make sure there is a tight seal with no leaks. If they truly fit right, they are uncomfortable to wear." -
Scientists Study Permian Mass Extinction Event As Lesson For 21st Century
Hugh Pickens DOT Com writes "About 252 million years ago, cracks in the Earth's crust in Siberia caused vast amounts of lava to spill out and blanket the region with about 6,000,000 cubic kilometers of molten material—enough to cover the continental U.S. at a one mile depth. It triggered a huge change in climate, causing a mass extinction event that killed roughly 90 percent of life on earth. Now Helen Thompson writes in the Smithsonian that a team at MIT has focused its efforts on this major extinction event, which marks the end of the Permian period and the beginning of the Triassic period. Their results suggest that the die-out happened a lot faster than previously thought — perhaps over a span of only 60,000 years. The shorter time scale means that organisms would have had less time to react and adapt to changes in climate, atmospheric CO2 and ocean acidity. Without the ability to adapt, they died. Other mass extinction events have also been narrowed down to short timeframes. The asteroid impact that killed the dinosaurs at the end of the Cretaceous period only took about 32,000 years. A similar study of another mass extinction triggered by volcanic eruptions at the end of the Triassic period suggests it lasted less than 5,000 years. Even though all of these extinction events were caused by different things, the ecosystem collapse happened very quickly. 'Whatever the causes of the extinctions may be, and it looks like there are very different causes for some of them, the biosphere may collapse in very similar ways once it gets beyond a tipping point,' says Doug Erwin. Some scientists see the end of the Permian as a lesson for the 21st century (PDF) and say that understanding the conditions leading up to, within, and after a mass extinction event may help us to avoid human-induced ecosystem collapses in the future. As Erwin puts it, 'you don't want to start a mass extinction, because once a mass extinction begins, the prognosis is pretty grim.'" -
Warning At SC13 That Supercomputing Will Plateau Without a Disruptive Technology
dcblogs writes "At this year's supercomputing conference, SC13, there is worry that supercomputing faces a performance plateau unless a disruptive processing tech emerges. 'We have reached the end of the technological era' of CMOS, said William Gropp, chairman of the SC13 conference and a computer science professor at the University of Illinois at Urbana-Champaign. Gropp likened the supercomputer development terrain today to the advent of CMOS, the foundation of today's standard semiconductor technology. The arrival of CMOS was disruptive, but it fostered an expansive age of computing. The problem is 'we don't have a technology that is ready to be adopted as a replacement for CMOS,' said Gropp. 'We don't have anything at the level of maturity that allows you to bet your company on.' Peter Beckman, a top computer scientist at the Department of Energy's Argonne National Laboratory, and head of an international exascale software effort, said large supercomputer system prices have topped off at about $100 million 'so performance gains are not going to come from getting more expensive machines, because these are already incredibly expensive and powerful. So unless the technology really has some breakthroughs, we are imagining a slowing down.'" Stanford's MetaPhone Project: Crowdsourcing Metadata To Challenge the NSA

Puzzled Scientists Say Strange Things Are Happening On the Sun
Hugh Pickens DOT Com writes "Robert Lee Hotz reports in the WSJ that current solar activity is stranger than it has been in a century or more. The sun is producing barely half the number of sunspots as expected, and its magnetic poles are oddly out of sync. Based on historical records, astronomers say the sun this fall ought to be nearing the explosive climax of its approximate 11-year cycle of activity—the so-called solar maximum. But this peak is 'a total punk,' says Jonathan Cirtain. 'I would say it is the weakest in 200 years,' adds David Hathaway, head of the solar physics group at NASA's Marshall Space Flight Center. Researchers are puzzled. They can't tell if the lull is temporary or the onset of a decades-long decline, which might ease global warming a bit by altering the sun's brightness or the wavelengths of its light. To complicate the riddle, the sun also is undergoing one of its oddest magnetic reversals on record, with the sun's magnetic poles out of sync for the past year so the sun technically has two South Poles. Several solar scientists speculate that the sun may be returning to a more relaxed state after an era of unusually high activity that started in the 1940s (PDF). 'More than half of solar physicists would say we are returning to a norm,' says Mark Miesch. 'We might be in for a longer state of suppressed activity.' If so, the decline in magnetic activity could ease global warming, the scientists say. But such a subtle change in the sun—lowering its luminosity by about 0.1%—wouldn't be enough to outweigh the build-up of greenhouse gases and soot that most researchers consider the main cause of rising world temperatures over the past century or so. 'Given our current understanding of how the sun varies and how climate responds, were the sun to enter a new Maunder Minimum, it would not mean a new Little Ice Age,' says Judith Lean. 'It would simply slow down the current warming by a modest amount.'" -

To Beat Spam Filters, Look Like A Spammer?
Slashdot contributor Bennett Haselton writes "A recent webinar for newsletter publishers suggested that if you want your emails not to be blocked as 'spam,' you paradoxically have to engage in some practices that contribute to the erosion of users' privacy, including some tactics similar to what many spammers are doing. The consequences aren't disastrous, but besides being a loss for privacy, it's another piece of evidence that free-market forces do not necessarily lead to spam filters that are optimal for end users." Read on for the rest of Bennett's thoughts.Lest you think that spam filters only rarely make mistakes any more, recall the instance in which after I mailed out a group of 10 proxy websites to my own mailing list, the British "anti-spam" outfit Spamhaus blacklisted two of the domains, which caused the registrar (Afilias) to disable all 10 of the domains en masse, so that the sites simply disappeared from the Web. (This happened even though our mailing list is 100% closed-loop confirmed-opt-in; users have to reply to a confirmation message in order to join the list, so the actual emails were not "spam.") It took several days to find out what happened and restore the domains, during which Spamhaus and Afilias refused to answer any of my inquiries, and have to this day not reached out or explained what they're doing to avoid similar screw-ups in the future. And this was just the latest in a long line of headaches caused by spam filters including filters at Hotmail, AOL, Yahoo, and Gmail, which had regularly categorized our emails as "spam" and caused users to miss them.
So when the email deliverability company WhatCounts announced their October 16th webinar on how to avoid having your mails blocked as spam, I watched in real time with some interest. The webinar (which you can view here), was presented by Brad Gurley, the "Director of Deliverability" for WhatCounts, who has worked in the email "deliverability" industry for 10 years. While email deliverability services is one of the products that WhatCounts charges for, the presentation didn't contain any blatant plugs for their own services, so I'm taking the contents at face value. Even if any statements in the webinar happened to be incorrect, it's still safe to assume that the presentation represents mainstream thinking in the email deliverability industry, which will determine what recommendations are made to email senders.
I hasten to add that WhatCounts should not be blamed for any of the recommendations that they made that I'm counting as "eroding privacy"; their job was to answer the question, "What is the best way to make sure my emails don't get blocked as spam?", and they answered it. The fault, if any, should lie with the spam filters which encourage these practices. Furthermore, I'm only saying that the practices encouraged in the webinar are eroding user privacy, not violating it. (If you ask every new subscriber for their name and geographic location, I would call that an "erosion" of privacy if it normalizes the practice of collecting more user data than you need, but it's not a privacy violation as long as the user willingly gives it to you.)
The webinar begins with some recommendations that are actually good netiquette, such as cleaning subscriber lists regularly (removing bouncing addresses), and displaying a prominent "unsubscribe" link for users who want to leave. If you run a newsletter, and good netiquette isn't a compelling enough reason to put an "unsubscribe" link near the top, here is a direct quote from the webinar:
"The Unsubscribe link should be prominently placed within the message body. Unsubscribe links that are hidden or hard-to-find will generate spam complaints from unhappy users who want to unsubscribe. Placing the link in the preheader has been shown to reduce spam complaints in many cases."
That's one reason that every message that I send to my own newsletter, contains this text at the top:
[You are receiving this because you subscribed to the Circumventor distribution list. To unsubscribe from this list, click here: http://www.peacefire.org/circumventor/cv-unsub.html or reply with the word "unsubscribe" in the subject.] (I give people the option of replying with the word "unsubscribe", even though that creates some hassle for me to process those requests manually, because many of our users are on censored networks and cannot access the unsubscribe link on the peacefire.org website.)But, on to the less-stellar news: the presentation also says that the key to getting users to keep opening your emails -- and hence to signal to the email providers like Hotmail and Yahoo that your mails are not "spam" — is "engagement." Gurley suggests that senders "tailor mailings to segments of subscribers based on demographic data," including segmenting users based on city or zip code. Nothing sounds wrong with that, except that to "tailor" the mailings based on demographic data, you have to have that demographic data -- i.e. ask users for their age, sex, location, income bracket, or other information at the time that they join the list.
As I said, I don't consider this a violation of privacy if the user gives their information voluntarily, it's just an erosion of privacy, because it normalizes the process of asking users for extra data when there's no clear reason why it's necessary. In the late 1990s, you could join most companies' email lists without providing any more information than an email address; if you were asked for more information, it was for an obvious reason (such as filling out a profile on match.com, or ordering a product to be shipped). The less information about users was stored all in one place, the less opportunity there would be for the company to abuse it, or to be bought out by some other company that would abuse it, or for someone to hack into their servers and steal the information outright.
Our mailing list in particular serves a segment of the population who are particularly privacy-conscious -- they're using our proxy sites to circumvent Internet blocking software, so in almost all cases, just the simple act of being our mailing list could get them in some amount of trouble with somebody (although the severity would vary). So by design, we collect the minimum amount of information -- the email address -- necessary to send new proxy sites to the users. The more information that we asked for, the less likely the user might be to sign up in the first place.
Again, companies are within their right to ask for this information, but I don't think the rest of us newsletter publishers should be penalized for not asking for it.
The presentation goes on to say that email providers such as Hotmail and Yahoo judge whether an email is "spam" based on what proportion of the time users open an email from that sender. As Gurley says, "Give people a reason to open your email and keep opening it." The trouble is that this penalizes email notifications where you can fit all of the relevant content into the subject line -- many of my emails say something like "new Circumventor: badbadger.info", and for most users, that's all they need to see. Some subscribers have specifically said that they always want to see the new proxy site name in the subject line, because they're on a network where they are blocked from accessing their full email inbox, but they can use other webpages to see the subject lines of recently received emails. (For example, Yahoo Mail users might be on network where Yahoo Mail is blocked, but if you're signed in to yahoo.com you can see the subject lines of your last few emails on the www.yahoo.com front page.) If I'm being penalized by spam filters because user's don't open my emails, then obviously that's incentivizing me to do the users a disservice, by putting the proxy site name only in the message body.
(This might be an issue that is highly specific to my particular mailing list, because most people don't run email newsletters where they can fit all of the relevant content into the subject lines. However it's easy to think of other web applications that have a need for subject-only notifications -- Google Calendar sends me an email whenever one of my calendar events is coming up -- and those shouldn't be penalized just because the user never opens them.)
Finally, the presentation suggests that senders unsubscribe any user who hasn't opened the last 50 emails you sent them. This might set off mild alarm bells with tech-savvy readers, who know that the only way to tell if a reader has opened your message, is to embed images into the messages -- and if your newsletter content doesn't lend itself to images, you have to plant a surreptitious "web bug" image into the email, a tiny image that serves no purpose except that if you open the message and the image loads, it tells the sender that the message has been read. (For this reason, if you open an email message that does contain images, most email clients will not display them unless you click "Show images" or something similar -- because otherwise, if images always loaded automatically, spammers could use web bugs to tell who was opening their emails. So in fact, if a user opens your message and doesn't click "Show images", you generally can't tell that they opened your email.)
Again, I would consider web bugs to be an erosion of privacy more than a violation of it, on the order of asking for the user's zip code at the time they join their newsletter -- in both cases, the reason being that you are collecting more information than is strictly necessary for the operation of your mailing list. (In the case of web bugs, the "information" you're collecting is whether the user opened your message or not.)
Some people feel more strongly about it. A recent message posted on MIT's "liberationtech" mailing list had this to say about "web bugs", to a person who was asking about why his newsletter was being blocked:
You do not appear to use web bugs in your mailing list messages. A wise choice: web bugs are malware, they're invasive and abusive, and they actively degrade the security of recipients...which is a pretty crappy way to treat one's audience.
I think this is over the top -- all that a web bug does, is tell the sender whether you opened their message -- but, whether this opinion is valid or not, some people out there feel that way, and using web bugs in your email might piss them off.
Although before you cut loose the users who haven't opened your last 50 emails, Gurley's presentation also suggests trying to win them back with one last message with a "teaser" subject line like "We're saying goodbye...", or "Are we not going to talk to you any more?", or "Are we breaking up?". I hate subject lines like that, whether from spammers or from people I've signed up to get mail from. (Although now that I think about it, I doubt I'm really that mad about the 1 second of my time that they wasted; I think I just resent the fact that even just for that 1 second, they actually had me fooled, and I thought it really was a message from a friend.)
But again, we can't kill the messenger: Brad Gurley's job was to do a presentation on how to get your emails past the spam filters at the major email providers, and if using "come-on" subject lines works, because it gets more users to open your messages, then that's part of the answer. (Remember, this presentation was aimed at opt-in email senders, not spammers.)
So, I don't know that I can do anything differently with my list as a result of the presentation. I think it would be too off-putting to users to ask for their age and zip code, and in any case it wouldn't do any good for all the users who have already signed up. I probably couldn't use web bugs even if I wanted to, because the web bugs would have to load the image from a website, and if the user opened the email from a network where Web access was censored, the network's filter might block the website that the web bug loaded the image from. And for a list with many members who are still in high school, and whose parents might read their email over their shoulder, I don't feel like trying to get their attention by sending them an email with the subject "Are we breaking up?"
The more important takeaway here, though, is that there's no reason to expect the free market to deliver spam filters that are optimal from the user's point of view. In a world where users had perfect information, if Hotmail told their users, "We're going to start flagging the newsletters in your inbox as 'junk mail' unless the sender asks for your zip code when you sign up, and uses teasing subject lines to get you to open the message, and uses web bugs to verify whether you've opened it," their users would likely say, "Screw you, I'm going to Gmail!" (Which many of their users have apparently said anyway.) If this doesn't happen, it's because the vast majority of users don't have enough information for the market in spam filters to function effectively. And thus there's nothing to stop Hotmail and Yahoo from imposing arbitrary conditions on senders through their spam filters, which will lead to more legitimate senders resorting to "come-on" subject lines and web bugs -- ironically, looking more like the spammers they're trying to differentiate themselves from.

Inventor of OpenFlow SDN Admits Most SDN Today Is Hype

Speeding Ticket Robots — Laws As Algorithms

We already deal with red light cameras, speed limit cameras, and special lane cameras. But they aren't widespread, and there are a host of problems with them. Now, Ars reports on a group of academics who are attempting to solve the problem of converting simple laws to machine-readable code. They found that when the human filter was removed from the system, results became unreasonable very quickly. For example, if you aren't shy about going 5 mph over the limit, you'll likely break the law dozens of times during an hour of city driving. On the freeway, you might break it continuously for an hour. But it's highly unlikely you'd get more than one ticket for either transgression. Not so with computers (PDF): 'An automated system, however, could maintain a continuous flow of samples based on driving behavior and thus issue tickets accordingly. This level of resolution is not possible in manual law enforcement. In our experiment, the programmers were faced with the choice of how to treat many continuous samples all showing speeding behavior. Should each instance of speeding (e.g. a single sample) be treated as a separate offense, or should all consecutive speeding samples be treated as a single offense? Should the duration of time exceeding the speed limit be considered in the severity of the offense?' One of the academics said, 'When you're talking about automated enforcement, all of the enforcement has to be put in before implementation of the law—you have to be able to predict different circumstances.'" -
EdX Online Classroom Code Going Open Source, Uniting With Stanford

4 Microsoft Engineers Predicted DRM Would Fail 10 Years Ago

In it, they talk about the darknet, and how it applies to distributing content online. They correctly predicted the uselessness of DRM: 'In the presence of an infinitely efficient darknet — which allows instantaneous transmission of objects to all interested users — even sophisticated DRM systems are inherently ineffective.' The paper's lead author, Peter Biddle, said he almost got fired over the paper at the time. 'Biddle tried to get buy-in from senior Microsoft executives prior to releasing the paper. But he says they didn't really understand the paper's implications — and particularly how it could strain relationships with content companies — until after it was released. Once the paper was released, Microsoft's got stuck in bureaucratic paralysis. Redmond neither repudiated Biddle's paper nor allowed him to publicly defend it.' Self-Driving Car Faces Off Against Pro On Thunderhill Racetrack
Hugh Pickens writes "Rachel Swaby reports that a self-driving car and a seasoned race-car driver recently faced off at Northern California's three-mile Thunderhill Raceway loop. The autonomous vehicle is a creation from the Center for Automotive Research at Stanford (CARS). 'We tried to model [the self-driving car] after what we've learned from the best race-car drivers,' says Chris Gerdes (who talks more about the development of autonomous cars in this TED talk). So who won? Humans, of course. But only by a few measly seconds. 'What the human drivers do is consistently feel out the limits of the car and push it just a little bit farther,' explained Gerdes. 'When you look at what the car is capable of and what humans achieve, that gap is really actually small.' Because the self-driving car reacts to the track as if it were controlled in real time by a human, a funny thing happens to passengers along for the ride. Initially, when the car accelerates to 115 miles per hour and then brakes just in time to make it around a curve, the person riding shotgun freaks out. But a second lap looks very different. Passengers tend to relax, putting their faith in the automatically spinning wheel. 'We might have a tendency to put too much confidence in it,' cautioned Gerdes. 'Watching people experience it, they'll say, oh, that was flawless.' Gerdes reaction: 'Wait wait! This was developed by a crazy professor and graduate students!'" -

American Scientists Win Nobel Prize In Chemistry
SchrodingerZ writes "Two Americans have won the 2012 Nobel prize in Chemistry for their work in cell research. Their work involves the discovery and manipulation of the G-protein-coupled receptors, which detect signals outside the of cells they inhabit. 'The human body has about 1,000 kinds of such receptors, which enable it to respond to a wide variety of chemical signals, like adrenaline. Some receptors are in the nose, tongue and eyes, and let us sense smells, tastes and vision.' The winners are Robert J. Lefkowitz and Brian K. Kobilka. Lefkowitz works at the Howard Hughes Medical Institute and is a professor at Duke University Medical Center in Durham, North Carolina. Kobilka is a professor at Stanford University School of Medicine in California. Their research has helped create newer and more effective drugs with fewer side effects. California Legalizes Self Driving Cars
Hugh Pickens writes writes "The Seattle PI reports that California has become the third state to explicitly legalize driverless vehicles, setting the stage for computers to take the wheel along the state's highways and roads ... 'Today we're looking at science fiction becoming tomorrow's reality,' said Gov. Brown. 'This self-driving car is another step forward in this long, march of California pioneering the future and leading not just the country, but the whole world.' The law immediately allows for testing of the vehicles on public roadways, so long as properly licensed drivers are seated at the wheel and able to take over. It also lays out a roadmap for manufacturers to seek permits from the DMV to build and sell driverless cars to consumers. Bryant Walker Smith, a fellow at Stanford's Center for Automotive Research points to a statistical basis for safety that the DMV might consider as it begins to develop standards: 'Google's cars would need to drive themselves (by themselves) more than 725,000 representative miles without incident for us to say with 99 percent confidence that they crash less frequently than conventional cars. If we look only at fatal crashes, this minimum skyrockets to 300 million miles. To my knowledge, Google has yet to reach these milestones.'" -
Stanford-NYU Report: Drone Attacks Illegal, Counterproductive
trbdavies writes "In 'Living Under Drones,' investigators from Stanford and NYU Law Schools report on interviews with 130 people in Pakistan about U.S.-led drone attacks there, including 69 survivors and family members of victims. The report affirms Bureau of Investigative Journalism numbers that count '474 to 884 civilian deaths since 2004, including 176 children' while 'only about 2% of drone casualties are top militant leaders.' It also argues that the attacks violate international law and are counterproductive, stating: 'Evidence suggests that US strikes have facilitated recruitment to violent non-state armed groups, and motivated further violent attacks One major study shows that 74% of Pakistanis now consider the U.S. an enemy.'" -

Quantum key distribution, which exploits the phenomenon of entanglement, offers theoretically perfect encryption (although it can be vulnerable in practice). This advance is an important step on the way to key exchange with a satellite, which could enable practical usage of the technology." -
Stanford Researchers Discover the 'Anternet'
stoilis writes "A collaboration between Deborah Gordon, a Stanford ant biologist, and Balaji Prabhakar, a computer scientist, has revealed that the behavior of harvester ants, as they forage for food, mirrors the protocols that control traffic on the Internet. From the article: 'Prabhakar wrote an ant algorithm to predict foraging behavior depending on the amount of food – i.e., bandwidth – available. Gordon's experiments manipulate the rate of forager return. Working with Stanford student Katie Dektar, they found that the TCP-influenced algorithm almost exactly matched the ant behavior found in Gordon's experiments. "Ants have discovered an algorithm that we know well, and they've been doing it for millions of years," Prabhakar said.' The abstract is published in the Aug. 23 issue of PLoS Computational Biology."
