Even though [only recently] they claim they have suspended this, they still distribute Linux updates. This is in direct violation of copyright law with regard to parts of Linux they don't even allege they have any rights to.
Besides, what do you think their Linux kernel personality (for Open UNIX) is? It's a "copy & paste job" from the GPLed code. Just look at the quote from their LKP FAQ:
The LkP feature doesn't contain a Linux kernel, and therefore to the best of our knowledge, there should be no infringement issues. If the prior statement were proven inaccurate, SCO would take appropriate steps.
In other words, "we are going to violate your copyright until you prove something, suckers!" -

I cannot believe companies are caving in to SCO and paying these bogus licensing fees. Can you believe Questar's logic?
I tried to work out what Questar was thinking, while compiling a post to this Ghost article (it got yanked 'cause bigger news emerged). Here's my theory:
Questar, one of the licensees mentioned in Heiss's letter, said that its decision to purchase the IP Licence for Linux was a matter of simple economics. "Our usage of (Linux) is so small and isolated that's why we went ahead and signed the contract.," said Chad Jones a spokesman with the Salt Lake City company. "This was small enough that we made a business decision based on the modest cost of SCO's claim that it was in our interest to settle rather than litigate this thing," he said.
If a company has "small and isolated" Linux useage, why would SCO even notice them?
The simple answer: the litigious bastards are just a few miles away from their helpless victim.
I figure SCO has simply decided to move up a notch in the gangster hierarchy, and move from lawsuit-slinging to leg breaking. Imagine a large guy in a tailored suit walking up to Questar's front office -- and he's no missionary.

There's been a whole host of developments in the ongoing SCO saga over the past couple of days. SCO have now filed law suits against Autozone and DaimlerChrysler on the same day as announcing growing operating losses. Despite securing a deal to license their IP with ev1servers, SCOsource only generated an income of $20,000 for the quarter. Today it has been revealed that Computer Associates, Questar Corp. and manufacturer Leggett & Platt Inc have all joined the ranks of SCO source licensees. Over at the Nasdaq the publicity stunts are beginning to wane thin with investors who sent SCO shares plummeting by almost 14% yesterday. In the courtroom, SCO was yesterday given 45 days to identify all specific lines of code they allege IBM put into Linux from AIX or Dynix; identify and provide with specificity all lines of code in Linux that it claims rights to.

It doesn't say that exactly, the 45 day deadline is for IBM turning over their source and for SCO to fully comply with the Dec 12th court order.
As I understand it, this doesn't end the discovery phase, so they could still amend the lines of infringing code. The trial is going to be dragged out for quite awhile yet. This is just one step, remember SCO has already complied fully with the Dec 12th order once.

Why would they get a refund? Have you looked at the SCO Intellectual Property License for Linux?
If you terminate the license, you don't get a refund. They can terminate your license if you're doing something wrong, but a) SCO terminated IBM's Unix license without proper notification of the breach and b) SCO has described contracts as "what you use against parties you have relationships with."
They're selling a license that covers...

This is why people have been saying it's a bad idea to buy an SCO "IP license" until they are found to have rights to any "IP" in Linux. Because you're entering into a legally-binding agreement with a company that will audit you to try to intimidate you into "compliance".
Contrary to the notion where you get some kind of security in buying a license to use someone's IP, SCO's license gives you the exact opposite; no warranty, no indemnity (but Mr. McBride, what about all the times you claimed Linux users were at risk because of lack of warranty indemnification? And they explicitly state that there's no protection if you happen to infringe on someone else's intellectual property rights by using this license... like, say, the Linux kernel developers whose GPL-licesned code would be infringed?) and the right for SCO to audit you any time they want and make you cough up money if you "pirate" Linux by putting it on another machine -- oh, and the licenses are not transferrable between machines, either.
Sucker. Anyone who buys an SCO IP license has, in my opinion, no right to cry later when it turns out they bought a pig in a poke.

Do it with your own money not made on the backs of the contracts. What about Pixar?Google is obviously a top choice for the litigious bastards, but there are other plausible targets.
One big one is Pixar, or another animation studio. They use a lot of Linux for rendering farms, and some also have used SGI and other UNIXes in the past. They're moving to Linux in a big way.
And what about a large finance company on Wall Street? Most of them started experimenting with Linux years ago, and some have a lot of systems running it.
I guess we'll find out by the day's end. It's a sure thing, since SCO would never let its PR face say something and then contradict it in its actions.

When you search for "litigious bastards", you now get a website promoting the googlebomb technique listed first. The sco group was listed first, but now it's ranked about 47. I'm not sure if they are reducing the relevance of the link-text, or if the ranking has been lowered because the sco group probably doesn't point back at any of the blogs that link to it.

How many people work at software development companies that sacrifice quality to meet a deadline that sales or marketing proposed to the customer?
How about a company thats taken a new and possibly bad direction because one of the executives or a newly appointed CEO wants to impress shareholders and make money for themselves?
Point being, OSS projects are typically written on a timeline based on one requirement, is the project ready for the release?
It has always been my opinion that publicly traded companies are ruined by their shareholders.

The referenced article is 5 years old. To the best of my knowledge, Nuance does not currently support SCO UNIX in any of its products.

If SCO is gonna sue us and attack the moral and legal fiber of the GPL, I'd like to see them voluntarily remove all related code from their products and see whether the thing is even in saleable condition afterward. I'm not calling for retaliation by the community because some honest people may have inherited SCO systems to maintain, but I have no problem with those who choose to no longer actively maintain the many Unixware compatibility patches that exist in most core free software to work around their horribly buggy OS.
