There was a semi-famous case with Tucker Max who published factually true information about his relationship with a woman. A court issued an order preventing Tucker Max from discussing his relationship with the woman, exercising his first amendment rights, even to the point where discussing it with his lawyer was prohibited.
When the case got in front of a judge with a 3-digit IQ, the order was laughed out of court.
There was recent case in Niagara Falls where a judge was annoyed by a cell phone ringing in his courtroom. When no one confessed, he ordered everyone arrested.
The judge has been removed from the bench. -

Remember, you only got to see a tiny piece of the situation, and not even very well at that.
After reading some accounts like this one, it seems pretty clear that tasing the guy once was justified. Tasing him again while in handcuffs, of course, was unjustified.
During "after hours" in Powell, they send security around every half an hour or hour to check ID's and ensure that you're actually a student. The guy refused. Loudly. Was told that was fine if he didn't want to show it, he would just have to leave. Refused. Campus security couldn't get him to leave, and the police couldn't get him to leave. He was absolutely not trying to leave on his own power. At one point they started to try and drag him out, and he just went limp and started grabbing onto things.
Another eyewitness said that the officers had already tried unsuccessfully to restrain him with compliance holds before using his taser. I'm having a hard time coming up with a reason why the first taser use was excessive given the background information. Again, tasing a restrained, unarmed person is never justified.Regarding threatening to tase a mob participant while the officers were in the process of subduing a belligerent person, it may have come out poorly, but that was not the time or place to demand a badge number. Wait until the officers have the situation under control, and then you can ask for whatever number you want. Heck, if you wait a few hours, you can go read the arrest report and get every detail down to the serial numbers of the tasers fired.

Yes, I was indeed at Powell Library at approximately 11:30 on Tuesday night, and yes I did see the entire event as it went down.
Let me start off by saying that the guy DEFINITELY was asking to get his ass kicked. He was being extremely rude with the campus patrol guys (who are college students...this was before the real UCPD got called in). He was not complying with their requests to leave the premises, and he was definitely itching for a fight. I actually know the guy and a few of his friends, and I can tell you that he's the kind of guy that loves to make trouble.
Just as a little backstory, one of the quotes the guy has on his facebook (which he now has taken down) was "I like to find the most difficult solutions to the simplest of problems".
He definitely taunted the UCPD into behaving the way they did with him.

Appropriation -- Use of a person's name, likeness or identity for trade or advertising purposes without consent.
Intrusion -- A physical, electronic or mechanical intrusion into someone's private space. This is an information-gathering, not a publication, tort. The legal wrong occurs at the time of the intrusion; no publication is necessary.
Public Disclosure of Embarrassing Private Facts -- Publication of non-newsworthy, private facts about an individual that would be highly offensive to a reasonable person (true defamation)(so intimate that outrage the public's sense of decency).
False light -- Publication of false, highly offensive (but not necessarily defamatory) information about an individual.
The most interesting part is this example for appropriation:Consent. For example, gameshows require participants to take the first step to enter contests. In Jeppson v. United TV (1978), a Utah man won on a claim of appropriation because a television station called him on the air after picking his name out of a telephone book as part of a dialing for dollars promo. He claimed the television station used his name on the air without his consent.
For the record, the embarassing facts portion may not apply because one of its requirements is that the material must be offensive to the COMMUNITY, not the image of the victim.
If this guy decides to try to make MONEY out of this ordeal, as he indicates here, this will definitely apply. -
Just sad
I've been waiting to comment on this one. I've seen it floating around in a couple places the past few days (digg, fark, etc.). The most repulsive part of this is that on the Tucker Max messageboard, he is asking for advice on how to turn this into some sort of career move.
My prediction is that this ruins his personal life, professional life, and finances. In the world of google, who doesn't run the name of a prospective employee through google? Lawsuit happy; Yep, he'd probably lose them and go broke. Personal life; I can't imagine there is much of one if he does this type of stuff, and even so, what girl would find this type of behavior endearing?
His best option at this point would be to just shut up, let it go, and do some growing up.

It's amusing reading, but it's apropos to this.
Whatever lawsuit that will be brought up will be dismissed on its face. No criminal laws were broken, and the words and pictures are those of their owners. Libel and slander depend upon falsehoods. Since there were no falsehoods, and the names were not "anonymized", then there is no tort, either.
All the indignation will come to naught but indignation and RFJason will continue to laugh. Just because you're an idiot doesn't mean that you can get compensated for it. If you send naked pictures of your junk to random email addresses for anonymous sex, then you have more problems than other people exposing you.

Even funnier Judges decision over Tucker Max
This is pretty funny, but I've recently seen an even funnier judge's decision from a Federal court.
I hang out on another web site a bit (Tucker Max) and he was sued by a guy that was being made fun of in a few of the threads.
The guy's lawyer was BEYOND a hack, and the judge's verdict from the site made me laugh out loud.

I'm no lawyer by any means, but I can tell that the judge had FUN belittling the guy. And, he actually had sentences using phrases with "fisted by a gorilla" and "jerkoff".
More importantly, this was a pretty serious precedent that was set, in that the operator of the board was not held to be responsible for the comments made by the members.
It's definitely worth a read if you have 10 or 15 minutes. -

Whether or not we can agree on a successful business model in Anderson's predictions, the events he describes are indeed coming to pass. The market for content is dissolving.
Last year, according to R.R. Bowker http://www.bowker.com/press/2004_0527_bowker.htm, 175,000 book titles were published in the US alone. That's more than any other year in history, and it doesn't even include all the titles being published without ISBNs through outfits like Lulu http://www.lulu.com/, which gives authors the option to distribute directly. And yet, the same report notes that sales of books are down. Why? More content; less consolidated sales.
This is bad news for big publishers and for brick and mortar retailers, whose profits have always relied upon the 80/20 rule described in the Wired article. It's good news, on the other hand, for authors (and bands and game designers, etc.) who are hoping for a sliver of the marketplace that they might not otherwise have gotten.
Lulu, where I work, currently sees over 50 new titles published a day by authors hoping for the attention of a few readers. That number is growing all the time. Most of these authors won't sell very many books. But the money being spent on books by the book-buying public is being divided into many more slices.
"How am I going to get rich if I only sell 100 books?" complains a typical author.
Well, the truth is that getting rich as an author has always been a bit like winning the lottery. The world can support very few Stephen Kings. But it can support an almost infinite number of Cory Doctorows http://www.craphound.com/down/ or Tucker Maxes http://www.tuckermax.com/. The publishing world (and I include music) is more democratic, but it's also less glamorous.
If you have content-- and people will always be compelled to generate more content, for better or worse -- in the digital world it costs you nothing to put it out there and hang a price tag on it (Lulu and CafePress are good examples). If it's out there, and it's valuable to someone, eventually it will sell. The economics of that marketplace, on the other hand, are not those of the publishing industry as it now exists.

Oh, I understand their motivations perfectly well... but I don't have to respect them.
Considering that most of the individuals I'm thinking of are/were 30ish before they even completed their training, one would hope they'd have grown out of that kind of nonsense by then... but you never know (I don't know how old you are... you may still be there yourself). If you're trying to point out that young men often behave in an idiotic, risky, and hormonally-poisoned fashion, then fine... that's virtually axiomatic.
If you're arguing that some guys are after indiscriminate sex and hedonism (ala the puerile tucker max types), there's some truth to that as well... but that brings its own set of problems, and I ought to know; I deal in the aftermath. Picking up random chicks at bars and doing the nasty is all a numbers game, and your number will come up eventually. It might be in the form of a psycho boyfriend/husband (but I'm sure the girl assured you she's unattached, right?), the STD dujour, conception... let your imagination run wild. I've seen it go wrong every single way (sometimes more than one way at a time).
If that's all you want out of your relationships, then go nuts... enjoy it while it lasts; hopefully you'll mature before your luck runs out. However, as your peers grow out of such activities, you'll find your herd of potential "mates" thinning considerably. Over time, you'll gain weight, lose your hair, lose your youth, and you'll eventually be forced to either beg/scam for sex, or at best negotiate for it... or you could be reduced to a pathetic sugardaddy and engage in the kind of thinly-disguised prostitution the name implies... even if you're wealthy enough to afford the best, you'll still be an object of scorn. Wave money around to get women all you like, but even a leper can buy sex.
As I said... an empty existence. What's most sad about some of these guys is that they're smart/worldly enough to know better... I don't know whether they lack insight, self-control, or both. Indulging your id like the lowest form of animal... Understandable in a way, but hardly admirable.

It seems that this is a clear cut case of libel for Mr. Max. I mean he basically states it in the first part of his writing that he's trying to bring her down because HE doesn't like the hypocrisy of HER site. Of course he does nothing to point out his own hypocrisy.

Flamebait my ass! This was a post clearly showing the other works that Tucker Max has authored on the web besides his "Belligerence and Debauchery" and "Date Application" sites. The teacher referenced on the tardblog site (Riti Sped) was in one of his stories on his main site. Look at the story under 'Saturday,' her name is Melissa Cochran. After they met he got the idea to make the tarblog site with her help and input. Pen names aside, it's hard to tell who is at the helm currently but all in all it's a testament to his writing skills.
He might be an asshole, but he's also my idol. -

Hardly. Beavis and Butthead was fart jokes and slapstick. Tucker Max is well written and sarcastic. Yes, it is mean, and he really does some stupid things, and he is certainly an asshole as he admits many times, but the humor is quite a different kind than B&B, and quite funny. I read a huge chunk of his site today and getting quite a few chuckles. Seriously, check out some of his stories.
