Chelsea Manning Set To Be Released From Prison, 28 Years Early (nbcnews.com)
An anonymous reader quotes a report from NBC News: Army whistleblower Chelsea Manning is set to walk out of prison Wednesday -- but she won't be entirely free. Manning's 35-year sentence for leaking an enormous trove of military intelligence records was commuted by President Barack Obama in January. But Manning is still appealing her conviction in a case that could take years, and the government has yet to respond to the appeal. And all the while, Private First Class Manning, 29, will remain an active duty soldier in the U.S. Army. She won't be paid a salary, and it's highly unlikely that she will be called to serve. But being placed on voluntary excess leave rather than discharged, says one of her attorneys, makes her vulnerable to new military punishment or charges if she steps out of line. Such an offense could be anything from getting into a fistfight to revealing previously unreleased classified information. Manning could even get into trouble with the military for speaking and writing. The Army private then known as Bradley Manning was just 22-year-old when she leaked nearly 750,000 military files and cables to WikiLeaks. Manning was court-martialed and sentenced in 2013 to 35 years in prison, with opportunity for parole after seven years served. n a statement given to the TODAY show the day after sentencing, Manning came out as a transgender woman. Last Tuesday, in Manning's first official statement about her plans after prison, she said, "I can see a future for myself as Chelsea."

As a whistle blower bringing a program back under civil oversight, Manning did well. However, the methods used were wrong. There was never any need to seek personal fame through the media, and if proper channels had been followed there would have never been a sentence that needed to be commuted.

As long as she is on active duty, she falls under the Uniform Code of Military Justice (UCMJ). If the charge is violating military rules or regulations, she would be processed under the UCMJ. But, even for normal active duty personnel, many crimes or charges are handled by normal civilian courts if they do not involve other military personnel or occur on military property. The military has the option to process them under the UCMJ, but often just let civilian courts handle the charges.

Snowden - leaked sensitive information to demonstrate government abuse. He conducted the leaks in a way that limited damage and avoided the public release of information that could put agents in danger. Information was leaked with good intentions in order to benefit society, and as such Snowden should be hailed as a hero.
Manning - leaked sensitive information because he wanted to take revenge on the army. He was pissed off about losing his day off per week because he was persistently late. He went nuts and smashed up the office and then leaked information. He leaked the information in the most damaging way possible with and did so purely out of malice. All actions were taken with the intention of doing as much harm as possible, and as such Manning should be in prison very a very long time.
Incidentally, I use he because at the time of the events he was still a guy.

Actually there are a lot of legal ways the military can hold an enlisted soldier past their ETS. One example being stop loss. Another is oh we forgot to do your paperwork in time so you have to stay in until we process you.
I am in the military, and I know multiple people 1 -3 years past their ETS and are still in because of various reasons not of their choosing.

I have not followed the trail, and i don't know the USA laws, but in Greece a traitor is a traitor - a traitor may be a traitor that either "gave aid to the enemy" (worst case - death penalty in war time, life sentence -25 years actually, if a civilian- in peace time) or not (still a traitor - death penalty in war time, maximum 25 years sentence in peace time). Note: we don't have a death penalty in peace time, plus a "life sentence" for civilians is 25 years maximum (even less in some cases).

just the first link I came across can not spend too much time now at work on this though I do recall reading other places where officials gave very narrow hints without saying names. The interesting thing about the law is that intent matters. If I run someone over with my car, there's a big difference between whether it was an accident or something I planned out carefully for months in advance. If Manning had sold the information to Al Qaeda for profit that would indeed be bad.
But what does it mean to be American? Fundamentally, being American is about believing in freedom and democracy - and, particularly, freedom that facilitates democracy - specifically, the importance of being sufficiently informed about what the government is doing (both good and bad) to have an effective "government of, by, and for the [ordinary] people". There are a lot of countries around the world (Singapore, North Korea, Saudi Arabia, etc.) where people are not allowed to freely discuss the things their government is doing wrong. I imagine that some people like it that way. But Americans are supposed to believe in freedom of speech. It's even right there in the first amendment of the Bill of Rights in the US constitution.
So what about the things the US government was doing in the era of Manning's leaks? Well, we now know that the US military tortured a number of innocent people to death (Dilawar and some others at Bagram and then the whole Abu Ghraib thing a bit later - under the same commander, incidentally). Plus, there's wars and then there's wars. In some cases, a country just minding its own business and then some other country comes along and tries to invade and occupy it - and fighting back is clearly a matter of self defense. But the mess in Iraq was a bizarre little banana republic war where some rich and powerful people (e.g. Bush, Cheney, and the Saudi dictators) were waging a war to compete for access to the region's oil.
There were lots of questions about what the USA was doing in that era. In particular, there was a crucial need for the American public to be informed about the full truth of a all the bad things the US government was doing. So, to the extent that Manning was intending to promote informed democracy, that's about as noble a goal as any true American can have.

In general, I'm not all that concerned about Trump, or anyone else, leaking "classified" information. The vast majority of classified information is only classified to prevent embarrassment of corrupt and incompetent government officials.
However, with regard to the mess in Syria, Putin is solidly on Assad's side and would undoubtedly pass on any information obtained from the USA to Assad if he thought it would help Assad stay in power. And Assad is a pretty bad dude so, all else being equal, it wouldn't be ideal for the USA to be helping Russia keep Assad in power.

Treason is the only crime whose definition is part of the US Constitution. There are a horde of lesser offenses under which someone who has committed treasonous acts might be convicted, but a conviction for treason itself requires either a confession in open court, or two eyewitnesses to the same overt act of treason. Stands to reason that a bunch of people who had recently rebelled against the authority of King and Parliament would be a bit touchy about the definition of "treason".
Is rightly ignored? If someone says "Doc, this arm is really bothering me, mentally speaking, and identify as a one-armed person. I need you to lop it off." Doc says "Umm...no, we're not going to do that."

That's fairly irrelevant. As a president, Trump could literally commit a crime and pardon himself for it. He could even pardon himself for future crimes. Both would lead to impeachment, but he could do it.
I think what people don't like about this little incident is the fact that there was no reason for it and that intelligence agencies are seriously worried about him, because he's arguably the most retarded US president ever and has (at least officially) full and unrestricted access to every state secret. However, there is probably no real danger, because it's quite likely that they don't give him access to any valuable secrets in practice.

It's possible to be at war without declaring war. We were at war with the Japanese on December 7, 1941, before either side had issued a declaration. Since the formation of the UN organization, the words in use have changed, but it's still war. The post-WWII wars we've been in had Congressional authorization without a formal declaration.

I don't know what the laws were in place, but the President doesn't have carte blanche to ignore laws. However, there's plenty to impeach Trump on. If and when to do it is a purely political decision (and it would be if there wasn't plenty to impeach him on).
