Im getting very tired of this whole SCO thing. As such, I propose that this be solved via the famous "Trial By Stone," designed by Jim Henson.
In the movie "The Dark Crystal" The Skeksis decide who gets to be emperor by who could put the largest dent in a solid stone with the swing of a sword.

Ahh. The old "videogames as artform" conversation. Ive had this one with many people. Usually the younger individuals say, yes, videogames are art, just like movies.
Its the elder generation that hasnt grasped that a game can be artistic as well.
Then I put in the game "Rez."
Rez is the best argument Ive ever seen for videogames as an artform. It is unique, beautifully stylistic, and incredibly interactive. You could say that this is just another rail shooter, but that doesnt integrate the way sound, vibration, and visual effects all tie in together. This concept of interactive musical and visual integrated together was originally concieved by Kandinsky, which he referred to as "Synestasia."
This is The Big Problem that open source needs to confront.
People instantly assume that once you see the code, you have automatically figured out how to get complete and full access to every bit of the system that this "open software" has been installed on.
Yes, we know better, but if you think about it, their logic is sound (based on their worldview)
Whats needed is education, but I have no idea how to change this perception.:(

I think its hilariouos that you used "Brain Damaged" as the topic, as one of the greatest albums of all time, Dark Side of the Moon, has a song with the title "Brain Damage."
While most moden albums do not ascribe to having the songs work together, this is not true historically. Dark Side of the Moon is probably the best example of this.
While I could argue in detail about this, Ive found that the best way to do this is to grab a dark side cd, put it in, listen to it the whole way through, then again on random.
The McDonalds coffee case IS NOT a good example of filing lawsuits due to dumb mistakes. Im not saying that that doesnt happen. It does. A lot. But this case is simply not a good example.
If people start getting busted for speeding thanks to these RFID tags, and it becomes public knowledge that thats the REASON they are getting busted, then used cars sales will shoot through the roof. Maybe I should invest in carmax.

Im fully aware that only a small subset of people would be able to review the actual code for something. But the more popular a program is, the more likely it will be to garner peer reviews. Its a simple matter of statistics.
I never claimed that EVERYONE would be reviewing code. Hell, my home pc is almost 100% open source (sans OS and a handful of programs) and ive never even looked at a line of the code.
When I buy a DVD, Im not just buying the movie. If I just wanted the movie, I'd download it.
Im paying for a high quality digital video presentation, a 5.1 DD/DTS audio track, Commentary, Bonus features, widescreen presentation, ect.. All for 15 bucks.
Thats less then the cost of the CD soundtrack of THE SAME MOVIE.
I argue that p2p has MINIMAL impact compared to competition from dvds and videogames.
Theres a massive market for high quality recording off of tv/dvd/hd/whatever. All that legislation like this does is raise the barrier to entry, and thereby cause LESS competition, giving the consumer (fitting word in this example) less of an option.
Besides, if/when it becomes widely known that you cant record your favorite sports game/movie/whatever with these new tools, people simply wont purchase them, and will stick with their old equipment.
According to zophar's gameboy page there are lots of nifty emulators for gba already.
Sierra's AGI, NES, SMS, SNES (!), tg16, and even spectrum.
While I would like to see more oldschool PC games ported to gba, I certainly wouldnt put this in a crisis situation. There are some pretty good alternatives.
