    Software is perfectly capable of damaging hardware, i just used stuxnet as the most visible example. Do I REALLY have to point out that software can trivially overclock a CPU to exhaustion? Your proposal to declare software modding exempt from violating a warranty is just plain stupid.

    And you have no way of knowing if that OS is secure in any way. It comes from an untrusted 3rd party. You have no way of knowing if the OS itself isnt rooted.

    Feebs have been installing rootkits for a long time. Just because this particular root kit is beneficial doesnt mean its much different.

    Nintendo's win here is Pyrrhic at best, they have nothing for the next gen and have ignored every request to expand their presence online with a real service. There is no way Wii U will be able to compete with what is coming. Dont forget about the 800lb elephant in the room called Apple. I assure you they WILL be a part of the next gaming 'console' war.

    TO PC gamers cost IS secondary, you dont buy a Porsche primarily thinking about cost. PC gaming is the Porsche level experience of gaming. The consoles are Chevy Malibus and Ford Fusions.

    And they would consume orders of magnitude more power. Also, all refurbished means is that the board is tested for electrical continuity, its still old, in a power hogging design. The goal is not CPU power, it is low cost and ubiquity.

    yes yes, the plural of anecdote is not data . However, in my personal experience, you have a MUCH better chance of getting leniency and concessions with a bought and paid for lawyer vs a court appointed schmuck.

    Do you have ANY idea how badly it looks to a judge to use a court appointed lawyer? I assure you, going that route will guarantee you receive harsher sentences and far less leniency then with a competent non-court appointed attorney.

    I totally understand the position of not wanting to be opened up. I was 37 years old before a scalpel ever touched my body. I never had a broken bone, never hospitalized , rarely ever sick. Its a frightening proposition for some to be CUT open.

    I would tend to agree with this. TO be fair, I understand his position a bit. They developed iOS over 5 years in total secrecy. The only real slip was when Steve was asked if they were ever going to make another Newton and Steve replied in 2003 ~ "to get into the PDA business they would have to get into the cell phone business". Some of his other comments are pure misdirection.     The exclusivity to distribute was INFRINGED. Stolen has specific legal meanings, and your usage is incorrect.
