Here (in France) authors rights prevail upon copyrights. This mean in our case that clicking on an eula (aka not a fair contract where both sides have agreed on every terms) does not suppress my rights on my work as long as it is a creative work and certainly gives NO rights to the provider of the tool used. It's very special to creative work, as it is considered a very special area of human activities.
What is really annoying to me is that it is a french company that goes in that direction, that is against everything our society has been evolving toward.
To be honest I will have to check the french version of the eula to see if they have kept those parts.

Here is the link for the new eula from bioware site.
    Extract:
We have tried to address your concerns and here is the new EULA.
    .......
    5. Infogrames' and BioWare's Use of Variations. If you Distribute, or permit others to Distribute, your Variations, you hereby grant back to Infogrames and BioWare an irrevocable royalty-free right to use and distribute such Variations by any means.

And this is still illegal in my country where the original work of an author is protected and his rights in court are "souverain". Which means that if someone distribute any original work of an author without his written concent in a legal contract, his work is still his and a contract and repairs have to be done and paid that must be the most favorable possible to the author.
And this country is still infogramme's country.
On the other hand Infogramme is famous for having acquired a lot of works at incredible low rates wich then made incredible sales. Try to find what the author of "alone in the dark" say about his cooperation with them. His name is Frédérick Raynal.
    (in french it's here.)

    3/ the eula:
I've read it and section 5 wich grants infogrammes rights to publish MY work without MY concent is illegal in MY country which happens to be Infogramme's country too.
you hereby grant back to Infogrames and BioWare an irrevocable royalty-free right to use and distribute such Variations by any means, and to make such modifications thereto as Infogrames and/or BioWare deem are necessary to package, combine, and otherwise distribute such Variations.
    This starts to smell bad.

Here, such a boss (above poster) wouldnt have the back up of laws. Yesterday, a company was fined for having fired an employee by mail. the judge said in his ruling that the ease of use and speed of new way of communications should not make such matters fast and easy as they are human matters.
The laws forbid to fire anyone without a man to man meeting where the person is warned first, before anyone else in the company and where the reasons of his departure are explained.
We emphatize very much on this side of laws, as they have to protect the weakest elements of society, the strongest being ... well... stronger ... I mean, if laws don't protect your privacy in your boss little kingdom, who will? Ain't that one of the founding point of democracy? Or is it dead already ?

for kurosawa I wasnt talking about this script influence thing, i didnt watch the movie some people talk about. so i cant have an opinion about it.
No i'm talking about his recognition of kurosawa as a great director, along with spielberg i think.
Whats pretty bad, i think, in the new trilogy is the acting direction. It's terrible. It was better this time, but what could have been worse than episode one in term of acting direction? And it was a shame, as if there is ONE thing that can't be reproched to the american movies is the quality of their actors. They really are incredible. The lowest action movie (i speak about scenario not budget or number of entries) has great actors. (too bad they mostly perform in action movies, too bad there mostly is only action movies, what a loss).
But, I'm not as pessimistic about the rest.
I completly agree with you about the technical side. I will even go further, tecnic is everywhere in movies, yes, too much, but more, it is misused. When I see 3D everywhere to create "realistic" events, that is regular but much better done special effects, I'm always a little sad, when they could be used to create poetry. (the full avatar of this wastefull trend: final fantasy.)
But i had this strange feeling that ep2 was much better in term of writing than the rest of the lot. Most comments I read are quite unpleasant against that movie. Yet, i can't help to believe one character slowly rises up above all others, quietly, discreet and subtile, yet very present in a showing off way: queen amidala character.
And this is no theft from any past work. and it is done in a very subtle way.
Or beauty is in my eye only, but i don't think so.

Which is what happen when the components of an information system are expensive, wether they are software or hardware. he is in no way forking atheos as this is a linux (kernel) project, using code from atheos project found valuable. open source at his best in my books. It's too often that valuable projects just can't reuse existing code to cry a river when some valuable code is found usable.
