  2. Anyway I hold to Jefferson and Madison's opinion that the US was meant to have a FEW enumerated powers, while most of the powers remained with the Member States. Just like the modern EU.

    dont go there! dont hold the bunch of corrupt head up their asses unrepresentative scumbags (or the supposedly representative, but more accurately porkbarrelquaffing donothing wasters) as a system worth emulating! The EU is a disaster for the majority of the populace of the member states who were hoodwinked into it.

    Well from my READING OF THE FRELLING ARTICLE Striking down this part of the bill means that the two cases you cited are going to end up being repealed because the insurance companies wont stand for it.

    My guess is the attack on this one part of the bill is designed to cause a domino effect.

    well the only thing 'closed' about the GPL in comparison to BSD licences is the Free Lunch counter (unless you give those downstream in the foodchain the same lunch menu)

    I guess it was a bad choice of name. I would happy to rename the app, but because my access to the app is now disabled, I can't do this.

    Of course I could get access by filing a counter notice, but was too scared to do this :-P

    The name is not the cause of their DMCA notice, as the name would be a trademark issue.

    To answer of the "rip off" accusations: My understanding of copyright is that it's perfectly acceptable to create something that is inspired by something else as long as the original source material is not used. I would add that there are plenty other pacman clones out there with a variety of names, so I don't believe the mere act of making a similar game is a breach. It is different from the original in that

    - graphics are different (but in some cases similar)

    - sound is different

    - ghost movement is different

    - number of dots in maze is different

    The issue isnt that individual parts are or aren't using their original art, but that, taken as a whole, the entire work is a wilful copy of their game.
    The minor insignificant differences are not going to be anough to disclaim the infringement.

    If the EFF want to get into bed with people attempting to profit off of copyright infringement (even if it is 'inadvertent' which is what the poster of TFA is seemingly attempting to claim) then any last vestige of their credibility is going to vanish.

    They did not defraud ticketmaster, they were defrauding the people buying the tickets.

      A t the simplest level, because they bought tickets in a manner that was in breach of the terms of service of the ticket company this means that the tickets were technically invalid. People who purchased said tainted tickets could be refused entry based on the fact that, when they were originally bought from the original vendor they were obtained in a manner not in compliance with the terms of service.

    What does this mean?

    It means that they were knowingly sold on in bad faith to a third party when they were technically not worth the paper they were printed on. This is the fraudulent action, and they knew it. The price at which they sold the tickets on is actually irrelevant.

    On a serious note, your viewpoint would carry more weight if, when you resorted to using acronyms to make yourself seem more knowledgeable on the subject, you used the correct spelling of said acronyms.

    It is possible to install unsigned drivers to Windows 7with the right settings, windows will complain very violently (with a RED dialogue box- which of course makes all the difference security wise!) however whether or not the drm in the kernel will stop these drivers from playing ball with hdcp is another matter, although that's not to say there aren't relatively easy ways around that issue too.

    ahh yes, the old causal link defence, as trotted out by the asbestos lobby and then hte tobacco lobby to name just two. There is a massive obesity problem in the US, and a massive diabetes problem in the US. It's not unreasonable to suspect a link between these and the HFCS (plus enzymes present in same).

    Obviously however too much sugar of any kind is obviously bad and could be the cause of both obesity and diabetes no matter the type of sugar.
