You supported Orbitz. It was owned, until that time, by those airlines, so your boycott may not have really worked, unless you indeed chose other airlines because of Orbitz's advertising practices.

    Hardly a handful.

An interesting tidbit. I saw speculation over at Hacking Netflix that while rumors abound that Amazon will acquire Netflix, we'll never actually see that day because Netflix's massive network of distribution centers in all or nearly all 50 states would give Amazon nexus everywhere, thus making ALL purchases on Amazon.com within the US eligible for applicable state sales taxes.

  5. Re:First Sale on EULA Confusion w/ Used Copies of WoW? · · Score: 1

The sale of your copy of the game was between you and the person who sold it to you, not between you and Blizzard, so I don't see how you would have a contract with Blizzard.

Well, it's a little less simple than that. Assuming the original EULA gave the seller the right to use the CD Key online to create an account, and assuming it gave the seller the right to transfer all the rights therein to another party, they are violating that contract.

Basically, the seller has a contract saying they will transfer the contract to another party, and if they won't, they are violating their contract with the seller.

(Not that I'm necessarily taking either side. I just wanted to point that out.)

It's kind of like when you have a warranty on your used car. A potential buyer of the car isn't necessarily owed something and isn't necessarily harmed when the company doesn't honor the warranty after the sale, but if the contract with the original owner stated that they could transfer the warranty to another party, the manufacturer is now violating that contract with the seller.

    I think.

You are right about the criminal trespass, but it could immediately become criminal trespass. McDonald's or Walmart both have the full legal right to tell you to immediately get your ass off their property for myriad reasons, and the scenarios you described are well within their rights. (Really, the only reasons that they couldn't use involve discrimination and unlawful termination.)

So, McDonald's has every legal right to walk up to you and tell you to get the HELL out of their store because you are taking pictures of Ronald or chewing loudly or your kids took a shit in the ball pit.

    So, where was the trespass?

The trespass occurs the moment you do something they don't like and you are made aware that you need to leave. In the case of a previously posted policy, you are immediately trespassing. In the case of the manager saying "we don't allow people to take pictures of the McDonald's bathrooms, please give me the film or leave", you make the decision at that point to either comply with him or be guilty of criminal trespass.
