Halo 2 Retail Date Broken in Midwest

Thanks to c0nrad, who alerted us to a Gamespot article stating that Halo 2's launch date has been broken by a Midwestern store. From the article: "Several reports on the Gaming Age forums--which included photos of the limited edition of the game--said that several individual Meijer stores, a self-described grocery and general merchandise retailer that operates in Illinois, Indiana, Michigan, Ohio, and Kentucky, were selling the game early. However, calls made by GameSpot to several Meijer outlets made it sound like the franchise was sticking to the deadline." The reader continues: "Despite that, Ebay auctions have already gone up, with one having already reached $265!"

    Wouldn't this be a violation of the terms?

    I wonder how the makers of Halo 2 would react to something like this -- may make the store lose the dealership, if it had one.

      Maybe so, but it shouldn't be.

      A covenant without a sword is but words among men. The problem with retail dates in the video game industry is that of enforcement. Sure the publishers, distrobution companies could sue the retail stores, but that would result in a bitter fight, and a lot of animosity. Stores compete with eachother locally to strenghthen their customer base, and one way that keeps coming up is this breaking of release dates as a method of getting customers to flock to a store in order to buy a copy of the latest game early.

      Policy should be to just put the games on the shelf when they arrive in the stores, because timed releases are just foolish on a number of levels. If copies are just collecting dust waiting for a retail date, the store is losing money and the customers are losing patience. Some stores will follow retail dates and others will ignore them, at whatever the cost may be.

      If video game companies just don't apply retail dates, stores can bid with the games companies to get early shipments at a slightly higher price, and the customer wins in the end because they can buy a copy earlier for a little more money. If they hold off and wait, they should get a discount on the games in proportion to the delay. Yes, there is an opportunity for some capitolist exploits if retail dates are a thing of the past, but supply and demand should not be controlled by anyone, IMHO, and supply and demand will still apply to a release model that does not support retail dates or try to enforce them.

      Most likely, and probably there will be consequences for the store. What scores me though, is that if sufficient hype is generated and/or enough keeners actually bought the early release for such heavily inflated prices, we might start seeing a trend. If game manufacturers or stores get the idea that they can sell pre-releases at 3x-4x the street value, we'll probably see them trying this as part of business in the future.

      HL2 is great and all, but don't feed the sharks guys!

      BTW: Bungie is a subsidiary of Microsoft now, and even if my information on that is incorrect, Microsoft is still the "Publisher" because it's for their console.

      Good point. They could start following the model the motion picture companies have been using for a while: release the movie on VHS/DVD initially at a ridiculous price, usually from $100 to $200. Generally it's too pricey for the average consumer, but Blockbuster will buy multiple copies at the price expecting to make it back up in the large volume of rentals. Effectively, it takes the large demand for a product and forces the consumer to rent it if they want to see it, then buy it later.

      I remember the $150 version of the Matrix DVD being sold at Amazon a couple of months before the "normal priced" edition, and people spending that much just to have the movie early. Marketing at its best.

      Actually, back in the day I worked at blockbuster video and we were bound to release dates too. One day a couple movies were put on the shelves like 2 days early and corporate freaked. Turns out what the movie industry does (or did) was, IMO, far more sinister than a lawsuit. If the studios found that we put out one of their movies early they postponed their shipments by 90 days for a period of time (the period, i forget) but can you imagine a store (or franchise) being denied shipments of games for 90 days? Gives everyone else a bit of a competitive edge and completely screws the people who screwed up.. I think this is far more effective, and a better deturant than a lawsuit.

      Personally my favorite part is -- That shows that not everybody solves everything in a court, and I love it.

      You think retailers would actually prefer that system?? Bidding for early shipment? That's crazy; that would just drive the price up and everything would be chaotic.

      If I were a retailer, I would much rather prefer to know for a fact that my competition isn't going to be allowed to sell a game until a specific date. And I would know for sure that on that date I will have just as many copies on my shelf as he does. Then the real compeition is in selling pre-orders. Pre-orders are much easier to sell because they're cheap and I can't run out (usually). Customers know weeks or months in advance when the game is comming out and everyone is happy.

      The concept involved is fair-trade, the idea is if all of the retail outlets begin sales at the same date, then they all have a fair shot at the market. By agreeing to the "street date" then the stores will get their shipments in time for the street-date without worrying about shipments delayed by third-party shippers. Outlets that violate the street-dates have to worry about their early shippment agreement getting voided, and the their shippments will be timed to arrive just-in-time rather than in-plenty-of-time. Now I doubt that they will do this with Meijers because they are a huge outlet, in their market area, Walmart competes with Meijers, not the other way arround. Most likely what happened is some minimum-wage sales clerk either put them out to soon cluelessly, or thought it was a good idea to jump the street-date.

      The reason BlockBuster pays more for the DVDs is to because they rent them out. A copy of a DVD you buy at $20 isn't a rental copy, and its prohibited for you to rent that out (I'm not sure what the consequences would be if you did, but anyway). Blockbuster pays something along the lines of $100+ per copy of the DVD, but they get the additional benefit of that being a license, so they can get extra copies of the actual movie in case the old one is scratched without having to pay the $100. They are allowed to sell their rental copies, but they sell it without the rental license, and at therefore at a regular price.

    Why would anyone pay $265 for Halo 2? 1. It's on the Internet if you want it now. 2. If you're that much of a Halo fanatic, you've got Halo 2 preordered. Which means you're garunteed a copy in 4 days at 1/5th of that price. Is there something I'm missing here?

      Obviously there's a benefit to buying a copy on Ebay (auction closing in another seven days, plus 7-10 days for transaction and delivery). I mean, why wait four whole days when you could wait two weeks?

      Kind of funny, because even with overnight shipping, they might not get the game until Monday. To garuntee a Saturday delivery, I bet that will add even more cost, close to $50 or more just for shipping.

      Not sure what a pre-sell copy would command on the open market. I mean, they can't go to eBay and say "This was sold 4 days early! Trust me!" If they wanted it that bad, grab it on P2P and buy it when it comes out. I've had it for a while, not bad but I stopped after maybe an hour and it hasn't touched my xbox since.

      I think that's why the companies are so strict on release dates: poor reviews based on early releases could kill the hype

      What's special about the copies on eBay is that they are (gasp!) illegal. Which makes them rare and desirable to brain-dead eBay-ers. It doesn't matter that they won't even be recieved until after Halo 2 ships anyway. At least they'll have a copy that was illegally released.

      The other strong possibility is that the $265 bid isn't serious. I've seen a lot of bid retractions and non-paying bidders in my time on e-bay, especially when I price gets as crazy as that. Just my experience however. -Diomedes

      No one is paying 265 for Halo2, after reading your post and realizing that it made a lot of sence I decided to look to see if anyone bid on it, the problem is there is no auction for just Halo 2 all the one's in the 150+ range are bundles of Halo 2 and Xbox. I think the story submitter was just embellishing a bit.

      so what you do is put a copy up for sale on ebay, put the shipping date sometime after halo2 actually ships. Kids with rich parents credit cards see halo2, miss the shipping date, and heavily over pay you for a copy that you will go out and buy to send to them when halo comes out.

      look at it this way, they are paying you 200$ to buy a copy for them.

      1) You can probably not play online until the official retail date even with the retail version. So there is ABSOLUTELY no reason at all to by the game for 270 USD instead of downloading a copy from www.piratebay.org, and then purchase the retail version when it is officially available.

      I know more than a few people who paid twice that much for the first generation X-Box. (You do realize these auctions are for a bundle with the XBox and the game, don't you?)

      I paid $250 for my X-Box with two games. I don't really see the problem here.

      Only if you're getting butt-raped on shipping charges. Which, by the way, most places really do. More often than not, Shipping & Handling means $10 shipping and $10 profit.

      Shipping is part of my job, so I'm pretty current on rates, and can double-check the stores that send me goods. In all seriousness, the H in S&H is all-too-often 50% or more of the actual cost to ship.

      Yes- Half Life 2 has proven it's greatness over and over...as it missed each promised ship date. It just keeps getting better and better.

      Doom 3 was supposed to be the greatest thing since masturbation. It didn't quite cut the mustard.

      I really can't say which will be better- Half Life 2, or Halo 2. But a game I am actually playing, will always beat a game that isn't available yet. So, let's see which game actually ships. And then when they BOTH ship, that is the time to make comparisons.

      Ebay auctions don't have to last 7 days. They can be three days - or even one. In fact there's a Halo 2 auction ending in 12 minutes that's a 1 day listing. Parcels can be delivered within a day - so if a person placed a winning bid now they could have it by this time tomorrow.

      How, exactly, are they illegal? Because Microsoft/Bungie have announced on their website that they want the product to sell at a later date?

      Well, #1 is the right of first sale. If you have something in your hands, nobody, and I mean nobody (except the government) can tell you how to sell it unless you've entered into a written contract. This includes unopened, unused software since until it is opened/used/clicked on/signed in the USA you aren't bound by any agreements with the manufacturer at all.

      And, unless the EULA says you may not play the game until a certain date, there's nothing illegal about playing it. I *VERY* highly doubt the EULA says you can't play it until the release date. It would be the first of its kind.

      The store which had it in their hands did INDEED have a contract not to sell before the release date, which they of course violated. I don't know if it's a civil offense knowingly to buy goods on sale as a result of contract violation in the same manner that it's illegal knowingly to buy stolen goods; in either case, however, I'm sure Microsoft has enough money and lawyers to harrass the baka who bought this.

      There is a problem with pre-ordering, I pre-ordered doom3, got it nearly a week after I could have bought it in a walk in store. (and it was one of the retailers that linked off of the doom3 website)

      Illegal is a pretty big leap, the store certainly breeched a contract. Unless the seller was an employee of the store who stole it I'd be surprised if this violated a law. Typically the partie that violated the contract would be required to make the other party whole, specific performance (getting the game back) is fairly rare consideration.

      Well, they can, because the box says "Limited Collector's Edition." I suppose there's some chance that the buyer actually IS a collector and the game will never be opened.

      I've kinda been waiting to see if this would make the news... a friend of mine managed to snag several copies of Halo 2 on Wednesday night. He drove a couple of hours to Livonia, MI and managed to get three copies. The guy is dedicated to videogames if nothing else. He bought two copies of the special edition and one regular one. I'm slightly jealous as I could've had a copy had I not moved to Minnesota just a few months ago...

      Regarding Meijer, it's not the first time that I've seen them break the release date on a major videogame release. When I was in college in Big Rapids, MI, the local Meijer store had copies of Mario Kart Racing available for at least a week before it was supposed to be out. The place is great (as far as large retail chains go) but they don't have a huge electronics/game section so I don't think the staff is fully trained on what to do regarding game releases. In both cases the games went up in the middle of the night when some stocker got their hands on them and just thought they were doing their job.

      You do not have to be "in shipping" to determine the costs. You can go directly to the carriers web sites and get that information.

      So you are saying that the customer is responsible to know the details of a contract between the Microsoft and the retailer? Because MS has a magazine ad that says something will be released on a certain day has absolutely nothing to do with the contract between two companies. I suppose you are also saying that the customer is responsible to listen to all commericails and advertisements and should just know what a certain release date is? The last time you bought a candy bar from the grocery store, did you have any idea about the contracts and release dates for that product? How about when you last bought gas, did you know the parent company had a contract with your local gas station to sell it for $2/gal but they were actually selling it for $1.95. Are you liable for that contract discrepency between them? Why should you be obligated to know about a release date of a piece of software. You are not a party to the contract. Dealing in stolen goods is a crime, a "do not sale before this date" is a contract violation, two completely different things.
      Your agruement makes no legal sense if you step back and look at it BIG PICTURE.

      San Andreas started selling at 7:00PM the night before the official release date at my local mall. I picked one up. I have NO idea what their contract states and I did nothing wrong by buying it then.

      Either eBay pulled the auctions or they never existed. I just searched for "Halo 2" and nothing fitting the description came up for over $200. So I don't know what the article submitter is blathering about.

      But what if the person didn't know what the release date is? Is it his fault that the store he bought it from was making it available for purchase? Perhaps he's just a casual gamer who walked by the store, saw it on the shelves, and purchased it because it looked interesting.

      Yeah right. There will be like a hundred other cheapskate warezz dudes online using GameSpy, whereas there will be tens of thousands on Live after the game has been released.

      On GameSpy you will not get statistics, fixed gamer tags, OptiMatch, leagues, clans, friend system etc. Just forget it. System Link over the internet using something like GameSpy just doesn't compare to Live.

    The game has already gone gold. MS and Bungie will still get money from the sales. Some rubes on eBay will be out some more $$$ just for bragging rights. All that will happen is that some PR prick will feel as though their spectacular launch day has been violated.

      Meijer is fairly large (each store is a Wal-Mart combined with a sizeable grocery store, and they're all over Michigan, Indiana, and Ohio at least), so I doubt that'll happen.

      Who cares how much larger MS is, the point is, MS doesn't want to lose the business. Meijer's have lots of parents running around inside them getting Xmas/Bday presents for their kids, MS wants to have their product there. In stead, MS should start distributing their product with a stipulation that if the release date is not adhered to, they will fine that company. Its something I'd try at the very least.

      Stores break release dates quite often and aren't sued over it. There is no way that MS is going to bring a lawsuit over this. They'll raise a stink about it behind closed doors and express their anger over the incident but it's not going to court.

      Please, if you don't know a thing about the video game industry perhaps you should not be making definitive statements that you're sure MS is going to sue over this. This is not ground-breaking news nor is it unusual for some store to break a release date. I've gotten quite a few games before the release date simply because some store is trying to get a leg up on the competition.

      Considering that usually in the same areas that there is a Meijer's, there's usually a Walmart/Super Walmart, Target, Costco, Sam's club, etc... That I don't think it would hurt Microsoft all that much. They can easily distribute it to Meijer's various competitors.

      Nobody signed anything that specified any damages for selling this thing before the date.

      There's nothing for the lawyers to litigate.

      In all seriousness though, how come a company hasn't tried something like this? Setting a release date for a game, and then auctioning off advanced copies ahead of time? If someone is willing to pay three to ten times the MSRP to get something early, why not cut out the pre-ordering ebay middleman, and sell it direct yourself?

      Assuming that games work like music, Microsoft is likely going to get a shitload of money from Meijer for breaking the street date. The fines are usually very large, and it is money that Microsoft had to do nothing to get, and Mircosoft doesn't exactly seem like the kind of company that would mind getting money for someone elses screwup.

      Probably because if Microsoft does this, then suddenly, inexplicably, Xbox merchandise in retail outlets is moved to a single shelf, right next to that bathroom that's never cleaned. If you ask for an Xbox game, the store will have it, but you'll take hours trying to find the "display." You do NOT want to piss off retailers in this area - especially retailers who have plenty of other products to sell and could use the space to sell something that the manufacturer ISN'T selling direct either earlier or cheaper.

      Don't kid yourself. Why do you think that Walmart started doing SuperCenters? Meijer's market may just be focused in a few stats, but they are huge there. The more Walmart tried to break into that market the more they realized they needed to at least be on par with Meijer's "One Stop Shopping." Where I live (which, admitidly, is one about 20 miles from Meijer's Grand Rapid corp. office) Meijer and Super Walmart are about the same size... but there's 3 Meijer stores about a 15 mile radius and one Walmart.

      When I saw the headline I thought the same thing... but when I saw who was implicated it struck me as quite unlikely. While Meijer is only big in a few states, it is absolutley huge in those states. From what I understand, Micrsoft is far from considering itself the winner in the game console wars which means they can't afford to not have the X-Box on the shelf at Meijer... especially as the Christmas holiday season approaches and the "unwashed masses" will be out there buying video game systems w/out knowing the difference between a controller and a game.

      I worked in software retail for several years, and saw countless "release date violations". Never once did I see a store ever get sanctioned by the distributor for doing it. Even Windows 95, which had the biggest launch in software history didn't generate so much as a nasty email for stores that sold it early (like we did). The theory of relase dates is for the distributors to be able to get the product on sale in all the retailers at the same time, regardless of shipping and supply issues. This keeps the complaining down from retailers. If someone "violates" the release date, the distributors dont really give a crap. They sell just as many numbers, and they have a scapegoat to point their finger at if stores complain who didn't get stock.

      Actually, I've had my .sig for a very long time. I didn't copy it from anywhere (i.e., I made it up myself, though it seems a fairly obvious statement so it's certainly possible that others had it before me, though I'm not aware of any). Since I've started using it on /., I've seen it showing up in various places. It's kind of cool to see it quoted along with quotes from great authors.

    At the EBgames I work at we have around 10 or so big boxes with Halo 2 and the strategy guides.....so it's no surprise people are selling it early. It's tempting as hell to take one home.

    Each of the shrink-wrapped game cases has a sticker....under the shrink-wrap, that says "DO NOT SELL UNTIL 11/9/04." I've never seen a game this hyped or this heavily protected. Hope you all pre-ordered.

      Sounds like standard "Street Date" shipping to me. Used to work retail electronics. Wasn't uncommon to have half a dozen boxes with "DO NOT SELL UNTIL $Date" on the shelf. (Hell, I had "Finding Nemo" DVD's sitting on the stockroom shelf while the movie was just hitting the second run theater.)

      But good to know that there's not going to be a shortage. This game is almost as heavily anticipated as Doom 3 or even Half Life 2.

      Who am I joking. There will be a shortage.

      Why, because you're going to keep the extra copies under lock and key until 11/10 to "teach people a lesson" about preordering?

      The EBGames in my local mall had "zero" copies of GTA San Andreas at 9:00 PM on release day if you hadn't pre-oredered, but dozens the next morning. Luckily Wal-Mart doesn't pull such stupid crap, and I was able to get one of their 100+ copies the day the game came out. You really expect me to believe that with how many copies they're hoping to sell of this game that they aren't shipping enough to retailers? Halo 2 won't be sold out. It's the games that *aren't* expected to sell well that you need to pre-order.

      EB tried to hose me that way with Star Wars KOTOR on release day. They told me to come back in three hours and check if they had any extra copies available for people who didn't preorder. Their mistake, of course, was that there is a Gamestop only 15 feet (plus escalator) away and they were happy to sell me a copy of KOTOR - as a bonus for them, because I decided I wanted to support a game shop not having anti-customer policies, I picked up the strategy guide at the same time (something I very rarely do considering the availability of DSL in the house).

There is also the message of "want to buy it? Forget about it: we're sitting on the boxes for now. You'll have to scan Kazaa for a cracked copy."

      My guess is that its so the game has a chance to be distributed to all retailers before they're allowed to start selling. It would be an unfair advantage to allow Meijer's to start selling if they had, say, received it a week before everyone else.

      They make an agreement with the stores to ship the game early, but they cannot sell it until release date. This way all the stores across the country can start selling it on the same day. If you don't agree, they don't ship to you until just before the release date, so you dont get it until on or after the release date. This way ensures a nationwide simultaneous release, which maximizes release-date hype and the effect of release date advertizing. Stores like it because there is plenty of time to fix shipping problems without missing out on all the release date sales and pissing off their pre-order customers. It also stops the first shop to get it from hiking up the price and taking advantage of the situation. Stores voluntarily enter into these agreements as they benefit everyone, although some stores break them from time to time (either intentionally or by mistake).

      Your argument makes sense as a rant, but it completely ignores the reasoning behind release dates. The stores can't sell it early because it doesn't go on SALE until the 9th. Everyone knows it comes out on the 9th. I met a 50 year old guy the other day that couldn't stop talking about how he couldn't wait until Nov. 9th so he could get his copy of Halo 2. This is a huge date, and there are huge parties and huge programs and lots of hype and lots of expectations. Many of the EBGames will be hosting halo tourneys, and staying open very late, so they can give away Halo 2 at 12:01am on Nov 9th.

      Now, because of the effort required for a store to recieve merchandise and ready it for sale and put it into their store's computer systems, and all that jazz, they have to do a lot of work. Hours and Hours worth of work. It's not as simple as getting a box, putting it on the shelf, and selling it. So all the stores need to get their copies early. It's common practice for movie stores to get movies 1-2 weeks in advance. I expect that, for game stores, the same is generally true (if possible, of course :).

      Having games in the back offices early doesn't "encourage" piracy... it merely means that it is possible that someone unscrupulous might get their hands on a copy early and put it up for download.

      This is pretty common practice on new releases of product and is not limited to the software industry. It's to be fair among retail stores. Distibutors feed the various retailers with product, if retailers are given the rights to sell on reception of the product, they gain an advantage over the retailers who have not yet recieved that product. So they set a common date, where all stores should have receieved their product by and can put it out on their shelves and be competative with the other stores.

      It certainly does, just like the "DVD Region" system does. It does provide an incentive for piracy ("illicit appropriation") if the product is available, but for some arbitrary reason (or region) you can't buy it.

      The open question would be, whether such an agreement is binding, and whether any real damages can be claimed. I'd wager there are states that will not uphold any such agreement (property laws perhaps superseding any agreement you can make to try to circumvent them, for instance). Or pre-existing arrangements with vendors that don't override this "thou shalt not sell before the Ninth" clause.

      Or maybe, some stores are bargaining that they are bigger, and would prevail. "You'll say nothing about this, because we might just not carry your product next season." Somebody like WalMart would have that much power, even over Microsoft.

      Street dates is to protect the retailer, not the consumer, it levels the playing field in the event of random distribution.

      Street dates are heavily enforced in the music and movie industry. One Target store was fined over $1k for selling one copy of one CD one day early. They take it seriously.

They're compete directly with Wal-Mart and Target. So if Microsoft/Bungie decides to stop giving Meijer their software/hardware to sell, I think Meijer would just say 'boo-hoo'... they've still got hundreds of aisles of clothing, food, other companies' software, and housewares to make a profit from.

    Will it come to a lawsuit? Maybe. Would it be worth Microsoft's time? Probably not, but that is a question left up for debate.

      I bought 2 copies earlier and already sold them for $100.00 each to the morons her at work that have been drooling over HALO2 for weeks, one of them even has printed posters in his cube.

      I made a tidy profit, they have each in their hands the super special early pre-release and get to feel their buyers remorse set in about noon tommorow when they realize they paid $40.00 each for only a couple days early playing time.

      BTW, the Meijer stores make this mistake quite often, they are insanely large everything under one roof stores.

      No kidding. The one that opened up in a town I used to live in had everything. A-frames for houses to phones and clothes. Imagine a Home Depot + Super WalMart + a mall food court. And they seemed to treat their workers alright.

      They won't just lose Xbox stuff. So I can't buy my Xbox games there, I'll go accross the street to Walmart, or down half a mile to Target (all three are on the same damn block of Titabawasee in Saginaw). While I'm there, I might as well get my other games there. And I'm out of beer, so I'll get that. Hell, as long as the cart's half full, I'll get my groceries while I'm here. Oh, that's a cool shirt, I'll buy that. Before long, I have the Target shopper's card and stop carrying my Meijer discount card because I don't need it anymore. If I went to Meijer, it would just mean an extra hop over someplace else to look for Xbox games.

      Almost certainly the case. The stock crew never seems to know what's going on in a particular department. Beyond checking what system a game is for they probably don't read the package.

      I'm in the unfortunate position of working for the Meijer corporation (store level, cashier). The parent post was pretty spot on, in that we carry some of just about everything (except new release (non-hyped-to-the-moon) video games). movies, plates, clothes, food, you name it, we have it, or something comparable. as to the 'treat their workers alright' comment, it might have been true before, but corporate level management is doing their best to set Wal-mart-esque labor standards, even with a 'union' to protect our rights. Of course, it helps that when you talk to one of our union guys, they tell you that you're "lucky to have a job at all". I love America.

      I've been there, done that. Worked as a 3rd-shift stockboy in the toy department a bit during college. (long family history related to working for the Meijer corporation)
      I can see how it's easy for someone to slip up and accidentally stock a game before it's official release date. If the employee doesn't follow headlines on their own, odds are they won't know about holds on certain products like that. I know I never knew about any during my time there. It was all "get as much on the shelf as you can so we can clean up before the morning customers show up."

      And as for unionization, the state of Michigan allows them to pretty much take over at certain stores, and I remember having to join the union just so I could recieve my paycheck. About the only valuable thing they did for me was to lock my pay in at $0.25 above minimum wage (3rd shift premium), which ALMOST (but not quite) made up for the cost of Union Dues that had to be payed with every paycheck. I know unions do good work at times, but for a kid trying to make a couple bucks during the summer, it was more hassle than it was worth.
      I've heard stories from Meijer and similar stores in states that the unions haven't taken over, where if the store was non-union, occasionally union members would sneak in, pretend to be regular shoppers, but in reality just end up leaving big messes throughout the stores when nobody was looking and leave. A random cart full of ice cream left in the home improvement section for a couple hours, etc. I don't know the truth to such claims, but they didn't surprise me.

    Yeah, there is something you're missing: the fact that most people are idiots. Remember when the PS2 came out, and was sold out everywhere? And it was selling for triple or quadruple what it was worth on eBay? And this was despite the fact that the PS2 didn't have a single decent launch game. Some people just have to have the latest thing now now NOW, even when it flies in the face of logic.

    So yeah, I'm not surprised that people are paying ridiculous amounts just to have it a few days early. People can be really stupid sometimes.

      I take it you've never taken a basic economics course. If a foo sells for price x in the store and plenty of people buy it, it is worth it. However should the same foo be sold on eBay for more than x, say 10*x and someone is willing to pay that much... is the foo worth x or 10*x? the answer... is 10*x. Why? Because if someone is willing to pay a price, it is worth it to them.

      Even today, PS2's and Xboxes cost a given amount which is far lower than in pass, however they are still not worth that amount to me, so, I do not buy them.

      Ultimately, worth has nothing to do with what price a retailer puts on a product, it is what both parties are willing to buy for and sell for.

      You mean besides SSX, Madden and Time Splitters? It didn't have many launch titles, but most were good. We're talking about, at the time, a next generation console with a few decent launch titles, that blows away previous consoles, that you can play PS1 games on AND use as a DVD player with optical out. That at the time would cost as much as an old console + a DVD player. Why on earth would anyone want that in time for Christmas?

    A french beta was floating around my dorm hall a few weeks ago. Everything was in english exccept for single player dialogue. I played the multiplayer game for a while.

      Microsoft probably has a deal with the suppliers that they will not sell copies for release before the release date. In cases where they are the direct supplier (like to Wal-mart) the deal will be between Microsoft and the retailer. Shit rolls downhill. Someone is probably getting sued.

      If that's true, Microsoft would still have to figure out if it's worth it to sue. with a company like Meijer who probably has a large pack of rabid lawyers (it's a grocery store, pretty good target for consumer suits) and the fact that this causes very little actual damage to Microsoft, it'd probably end up being more expensive to sue.

      Only a court of law (Judge) can levy fines -- Microsoft is not a Court of Law, so cannot 'fine' anybody for anything. They can sue however for Civil Recovery if they can prove that they lost revenue (which is doubtful).

    This happens all the time. I myself got the Tron Collector's DVD at Walmart 2 days before (wasn't realy looking for it, but I saw it and realized it was early and picked it up anyway...). Usually the way it goes is EBGames, or Meijer or some other retailer will have some low wage guy accidently pop it in the case and start selling it. It wasn't his fault. Then people will see it, think it's out, and go to thier favorite store and ask them about it. Most managers of these stores figures well if one store is selling it, then I sure as hell am going to make a sale as well. Then it just goes by local gamer grapevine and the day before the release date, everyone has it out for sale. I honestly don't understand why they do things like this. If it's not supposed to come out til X date, why ship it so it's sitting in the store room for 3 days? I doubt Meijer will have anything happen to them. They sell too many Xboxes and game for Microsoft for Microsoft to even care. For all we know, it may be a stunt being pulled by Microsoft....i mean the game was advertised by ilovebees.

      Considering they tend to come in boxes with bright green or orange stickers all over them that say "DO NOT DISPLAY BEFORE THIS DATE" or "STREET DATE XX/XX," I'd say it is the employees fault for being a complete indiot.

      They ship the product early in order to ensure that it arrives in time. Also, most retail operations only receive a few shipments of product a week; although new releases often are shipped 2nd day via UPS or Fedex.

      Nah, it's not actually the managers figuring anything. I work in a store that sells video games, and there are specific things that we're supposed to do if a competitor violates street date: call some part of Corporate, wait an hour, and put in on our shelves too...but only in the exact same fashion. If another store is selling the XBOX version early, you only put up the XBOX version yourself. If another store is renting Halo 2 early, then you can still get slapped for selling it, but not for renting it. And so on.

      Yeah, it does happen all the time. I don't see what's the big deal or how this is even news! Unless you're Really Big and Really Powerful publisher, I don't think the stores listen to the release dates anyway. Many do, but there's always some store that hasn't listened or doesn't care. And even in case of big publishers, there's still always some stores that screw up the release like this.

      I think I bought one of my games before it was supposedly released. Can't remember what, probably Max Payne. I think I heard just the same old discussion somewhere. Gamer1: "I got my copy!" Gamer2: "Shouldn't it be out in Friday?" Development house rep: "Some stores apparently have started selling as soon as they got them..."

      ...and, of course, I have also bought several games the day (or week) after the release date simply because the stores just didn't have them on the supposed release date. =)

    Reminds me of how I got my Playstation 2. This happened about three days before they were officially released.

    A friend of mine is general manager of an unnamed software retail store, and he owed me for money I loaned him to get his car fixed. He called and told me to come by the store. He handed me a PS2, the most recent version of Madden, a hockey game and a couple of others. It sucked because you could not buy the extra dual shock controller yet, so he popped open another box and gave me the one from there.

    Just because a store has a release date in mind, does not mean people's agendas change.

    No x-box for you -- I am guessing that Meijer stores will no longer be selling x-box related materials.

    Meijer, for those unfamiliar is a BIG BOX store chain which probably moves a significant portion of video games.

    The chain started, ages ago in the Holland/Grand Rapids area as Meijer Thrifty Acres, with a dutchboy in wooden shoes and pageboy haircut nicknamed Thrifty, as the mascot. It's like pairing Safeway and Target stores, food and general merchandise.

    When they built one of these in my former home town of Midland, MI, it nearly killed all the other grocery stores in the city.

    Don't kid yourself that Meijer would suffer some injuction. They're simply so big the left hand and right hand don't quite reach each other.

      I grew up in Midland too, and I remember when they built the mall, the Walmart, Meijer, and damn near everything else in that area of town. Some of downtown died off, but that's because of the mall. Meijer came later, and not a single grocery store closed. It just saved people from driving to Mt. Pleasant or Bay City to go to Meijer. Plus, they had the benefit of being open 24 hours, which wasn't the case for nearly any other store in town.

      If you're going to complain, do so about the fact that all of that shopping center used to be wetlands, not about some mythical store closings.

      It's pretty disappointing how you and a couple other posters could read that completely wrong and then launch into some garbage about better service or mom/pop or downtown. Then again, if I were going to be both stupid and obnoxious I'd probably post anonymously, too.

      FWIW Downtown was pretty dead long before the first spade was turned for Meijer or the Mall. The impact of Meijer was considerable, most groceries around town renegotiated pay, sold or closed. Any Saturday morning you could stroll into Michael's, Kroger or Farmer Jack and find short lines, while Meijer was a madhouse with lines at 20 or more registers. The primary reason some of these stores survive is because they carry things you can't get a Meijer. Meijer works in volume, not variety. Other stores are closer to residential areas, which has helped them. When my parents need a loaf of bread or gallon of milk they go to the closest store, but when they go to buy a weeks groceries, they're off to Meijer, just like much of the rest of the town.

      That 'wetland' was nothing compared to the land south of US 10 and Wackerly, which was once littered with ponds, now littered with houses and duplexes.

    I used to live in Michigan and did a lot of shopping at Meijer's. I still remember my mom buying me some Mexican Jumping Beans at Meijer's when I was still in early elementary school. Meijer's carries damn near everything - groceries, clothing, appliances, etc. - and most stores are open 24 hours (IIRC). I doubt video games are a large percentage of their sales, so I doubt a reprimand from Bungie will do them any serious damage (though it'll still sting).

    I've lived in Michigan all my life, not far from Greenville where the first Meijer store was founded. I have to say, Meijer rocks. They do so much for the community.

    One thing I just think is awesome, is that the Meijer family paid for the casting of a Leonardo da Vinci sculpture. The sculpture was to be a 22 foot tall bronze horse for the Duke of Milan. However, before Da Vinci could finish, the French invaded and used the horse as target practics. The Meijer family had two cast, one is now in Milan, the other sits in Fredrick Meijer Gardens in Grand Rapids.

      As for cleanliness.. It depends on who is running the store. The better the management the better the store. As for working... if you work at walmart you can be fired for no reason at all. In fact every so often everyone is polled in the place, and if they feel that the management isn't to the other employees liking then they can completely gut them all out and replace everyone with someone else. If that's what you call job security... wow! a better selection of words to use intead of "political organizations" are unions. Unions help keep your ass from being fired without a reason.. Although unions suck imo, atleast they do that for ya.

      Many Meijer workers are forced to join unions which then extort their money and use it for political causes and candidates. Union membership has nothing to do with whether or not the worker can do the job or how well, so it all comes down to being a political organization. It is about as appropriate as Meijer forcing its workers to tithe to the Dutch Reformed Church.

      The "force" part is that the workers will be fired if they do not join the political organization. No one is holding them at gunpoint, granted, but it is about as much "force" as it is with sexual harassment where the secretary must have sex with the boss or be fired.

      It is pretty outrageous. Workers' rights must be upheld: the decision to join such organizations should be left for each worker to decide, and not be made a condition of employment.

      Tell that to the workers in the newspaper strike in the Midwest about 10 years ago who were fired in a lockout during a labor dispute. A few of them got their jobs back a couple of years later. It was just the union members. Then there are all the factories and stores which are forced to close due to costs after they are unionized. Great job security here!

    By treating their game like a movie, with all the attendant buzz about weekend sales and sales rankings, it is the distributors of the product that are to blame.

    Are there 'release dates' for white goods? No. The producer places the product in the channel, and distributors and retailers get it when they get it, without restriction on when they can start *selling* the product.

    By trying to artificially control demand through massive 'first day sales', it is the publisher who is to blame, not the stores who sell the product early.

    Supposedly, the Walmart in Piscataway, NJ put 60 copies of Halo 2 on the shelves yesterday. Haven't had time to go see if there are any left.

    Best Buy was selling copies of StarWars: Battlefront almost a week early. I purchase mine on Saturday when the game wasn't due to be released until the following Tuesday. I went straight home and started playing Live. They had some MAJOR network performance issues but I was expecting that. Why would Micrsoft punish the user when it is obiously the retailers fault for releasing the game early (a little short-sighted on your part)

    You're not missing much anymore. The ones in Saginaw, Midland, and Flint have gone to hell the last couple years. The Saginaw Tittabawassee location started some renovations a few years ago, and half the store's been lit with utility lights ever since. The same one was losing lots of money because people were stealing flowers from the garden department (which is set up so you can go outside from it without passing the checkout lanes). So they moved it to the back of the store, and put the drug isle in its place. Guess how much they're losing now when you can walk from isle with some of the most expensive and often stolen items in the store outside without passing the checkout lanes?

They are not controlling demand by having a first day of sale - it is logically impossible not to have a first day that a product is available.

    If they did do what you said and allowed stores to sell as soon as they got it, that would artificially limit supply on the first days, allowing lucky retailers to gouge people that were willing to buy it, and hurting the sales of unlucky stores whose shipment arrived a day latter.

    Given there is demand for a popular game, and that there has to be a first time that it is available, the most fair thing to do - for the retailers and the customers - is to make it available for all the retailers to sell on the same day.

      That 'fairness' is only for the publisher end. Not the consumer end. As there will be consumers WILLING to spend big bucks on stuff.

      The 'agreement' as it was explained to me was this. You sell on the date we say or you will not get the next game. This is a disaster for a small shop. For a wallmart it is nothing. Also more than likely it is LARGER retail stores that drive these dates. It is really in the interest of the publisher to create a 'buzz' that the thing is rare. The larger stores need time to clear space to put that game in place. Smaller stores only get a dozen copies total through the life of a game. So they have little say in how it works. Larger stores also tend to stick to the dates as they helped set them in place. I have got items from big stores before just because someone messed up and put the item out to soon. It happens quite a lot.

      I would be WILLING to bet money there are 'rock bottom' sales going on for some stuff at the larger stores right now. To make room for this very game.

      Fair? Not in a business enviroment, and make NO mistakes it is a business. Get real. When HALF of the budget on a game is marketing... Controling demand is a absolutly great way to create sales. Even then it is a balance between to high of expectations and what people really get.

      Now consider the PS2. As soon as it hit the shelves it was gone. Stores sold it as fast as they could. There was no real 'global' release date on it. It created quite a buzz about the thing. Even the DreamCast was the same way.

      Now will this retailer be getting a copy from MS early next time? No they will be waiting for the shipment that happens AFTER the 'release' date.

      In fact if you do not belive me go to a store where you 'know' someone and ask if they have played halo 2 yet. BET if you ask enough more than a few will say yes. As they either already have the shipment or are waiting on it to show up very soon. Within the next day or two...

      There is nothing illegal about getting 'pre release' stuff. As soon as someone gets it they are actually free to sell it. Now if they have some agreement in place that says they will not do this. It could hurt them the next time around so they will not. It is more of a 'cold war' between the big boys of Circuit City, Best Buy, Walmart, EB, and GameStop. They have all agreeded to stick to the dates. There is nothing saying they HAVE to though... I am surprised one of the larger chains have not moved on that sort of thing. 'SHIP AS SOON AS IT ARRIVES'... It could get very interesting if they do... Bet it is walmart that drives it. They have their suppliers SO wrapped around their fingers they DECIDE when things hit the shelves...

      I'll tell you this for free - a $50 computer game with a $15 production cost is far more of a commodity good than a $300 freezer.

      Not true. If you didn't know a product existed, you can't want it. Consumers want games because they're told they're being developed, beta versions are reviewed by the trade press, and marketing campaigns are launched by the publishers. Demand does not exist in a vacuum.

      Again, not quite correct. If the distributer wanted, they could go gold, press a million copies, distribute them to local distributers across the nation, *then* release them simultaneously to retail channels. Everyone would get as much product as they wanted in the first day or so they were available. Supply is *already* artificially limited by retailers - what do you think the pre-order system at Electronics Boutique is for? It's to encourage you to pre-pay for a game so they only have to buy as many units from their distibuter as they can sell. It maximises their product by limiting the overstock.

      And you're really not going to die if you don't get that copy of Tony Hawk XXVI Extreeeeme on release day.

      Really. You're not.

      Instead the publishers deliberately go for these Day One Sales events - they do it to fuel demand and boost their chances at getting the #1 slot in the charts, not as a service to the customer, but to make more money by creating an 'event' around the release of a product. They do not do it out of the goodness of their hearts.

      If you believe otherwise, you probably haven't worked with Marketing people enough. :)

    These people shelling out big bucks for an early copy are probably the same ones who rushed out and bought a $300 video card in anticipation of the release of Half-Life 2.

    I considered it, because I need to upgrade my card anyway. But I thought about it, and decided that I wasn't willing to shell out that kind of money for a video card, just to play a new game. The game will still be out a year after its release, it will be cheaper, and the cards needed to play it will be much cheaper. Boy, was I right. It is now a YEAR later, the game isn't even out, and those same cards are about 1/2 price of what they were a year ago. By the time I get a copy of HL2, the cards needed to play it will be around the $100 mark. And those hardcore gamers will have upgraded their cards at least one more time.

    Early adopters are suckers in my mind, the costs are large, and I don't see any percievable benefit. Same goes for standing in line for hours to see a movie on opening weekend.

      Online games in particular really are more fun right at first - everybody's skill level is more equal, and you can still find your own novel tricks and strategies, instead of just visiting some web page to see it all spelled out.

      Plus, we're talking about a console game here, which (unlike PC games) don't go into the bargin bin after a month, and have considerable resale value. if you don't wait too long.

    When I went into work (Meijer) the other day we got a call about 6 am telling us that we had sold a copy of Halo 2. Since I sometimes work in the Electronics section, we quickly checked the tightly held stock. Nothing was sold. I'm sure Microsoft will try to slap us with a $10,000 fine; but the faulty network the stores run on is possibly to blame. I mean hell, I held the Star Wars DVD set 2 weeks before it was sold, and not a single one was leaked.

      Well, I know nothing about whether Meijer workers are unionized. It is likely because unions cover many aspects of the grocery/retail business. Oh, and by the way, some Wal-Marts have unionized workers in Canada. Having said that...

      Perhaps you have never heard of the terms "closed" and "open" shop, and "right-to-work laws? 22 states have right to work laws in which you do not have to join a union OR pay dues to be employed.

      In most other places you MAY not be forced to join a union. You DO have to pay dues that cover things like bargaining-things that help the WORKER. But you can get a refund of the percentage of contributions that went for political activity.

      Actually, I would say that employees in both stores have the choice in most states.     If the game publishers can enforce the street date, stopping them from selling the game prior to the "release day", then why can't they just let them sell the game whenever they get it, and instead, enforce a MSRP price, so no gouging occurs?

    I agree with the grandparent post. It seems assinine that they are bitching about early pirate releases, but then refuse to sell the game until some PR date.

      The problem with that is games sell a whole lot more copies the first week then any other day. That means any store who's shipment is delayed is screwed out of a lot of money. Costumers are also irritated, as they go to their game shop on release date and it's not there, etc. Opening week sales are important for sales just like they are for movies. The sell it as you get it model was tried, and the ship it beforehand method has been tried, and game shops and game companies seem to think the beforehand shipping is better. I personally have never bought a game on release date, as I prefer to wait and let the suckers try it out for me. Building up release date hype tends to lose it's effect if the release date is spread out randomly over a week.

    Meijer has a reputation for selling things inadvertently before the "drop" date. I've bought a few CDs there as much as two weeks before they were supposed to go on sale. I have a friend that works at one and I worked at one for a while. I got Madden 2k5 for the PS2 this way, also. I've heard that many stores' cash registers won't allow products to be scanned until the date.

      I'm from the area of Michigan where Meijer originated, they are similar to Walmart in some ways, but different enough to be distinctive if you look.
      They're both big-box sell-everything-cheaply type of stores, Meijer's been doing it for quite a while in that area of the US, and now that Walmart's been moving into that area in the past few years, they are becoming major rivals to eachother.
      Walmart started putting in stores next to the Meijer ones to try to drive them out, now when Meijer moves into a new area, they try to position next to a Walmart to attack them back.
      Walmart sometimes has lower prices that nobody can match, even the other big-box stores, but it also feels like the cheapest place in town to shop. Meijer may not be classy, but it feels a step up from Walmart (though that may just be personal bias). At least Meijer has a full, real grocery section to the store, and not just ramens and prepackaged cookies that most Walmarts carry (even though that's what I lived off of at the local Walmart back in college -- Meijer didn't arrive there until my senior year, when Walmart and Target were forced to upgrade to the SuperWalmart variation of the stores -- right next door)

    Ends on SUNDAY November 7th at 8pm EDST.

    So the earliest the seller will be able to ship is MONDAY November 8th.

    By next day mail, you will receive the game on NOVEMBER 9th!

    And for this, someone is paying $100 + shipping. To get the game on the same day they could walk down the street and buy it for $50.

    Now this guy could have listed it on the 28th with a BIN of $300 and probably gotten it.

    Let's not get too carried away with the WalMart comparisons. Meijer is family-controlled. The retail staff is unionized; full-time preferred. The health benefits are great (f'r'instance, a friend of mine got hyperthermic blood work in Germany for his cancer), for part- and full-time. Meijer tends to advance from the ranks. Here in Meijer home office-land, there is rarely an aftertaste of "payoff" when the patriarch, Fred, donates money to the community (unlike with some of the other billionaires in the area, or with WalMart).

    I think there's another angle. The Hype Machine wants you to believe that the stores will sell out of the product within a matter of minutes or hours. That you will NOT be able to walk down the street and buy it for $50, because the store will have sold out (due to all the people who camped out and waited). So then the price on ebay goes up so high that the $300 ebay price starts looking good.

    Meanwhile I continue to play nethack and wonder what you people see in these undergamed things.

    The publisher of the last Harry Potter book punished severe consequences for violating their embargo. When a paper published a leak, their lawyers threatened "severe consequences". Hot story got lots of publicity. Then a few days later they quietly dropped it. Mission accomplished, and you the public lapped it up. Many born every minute.

    You know, the game will be out _really_ soon. All any self respecting Ebay scammer has to do is set up and auction, close said auction, then wait for the game to ship and tell the buyer, "Oh, I'm sorry it took so long, it's the shipper's fault". I've read reports of it being done with laptops. It takes a little more care and elaboration to not get caught, but if you're careful you can get away with it...

    You're missing that the people who posted the French version to the warez scene got plenty of status and recognition for their work, and that for a measly $265 one of the other groups will be able to post a much cooler version --4 days before release-- in a language that people who aren't cheese-eating surrender monkeys can enjoy.

    Its not uncommon to have $10,000,000.00+ in the bank if you made it rich in the DOT-COM era in 1999.

    No one is "forced" to join a Union. What you may be referring to (though I doubt it) is "Fair Share". Fair Share is a due that you pay, even if you do not belong to the Union, to work in a Union shop. What it basically is about is that if the Union members go to all the trouble to organize, and bargain as a group - so that they can limit the abuse to workers and gain higher wages - that you as a worker in that shop should help out in the expense. You are literally paying Fair Share so that you can get higher wages. The Union protects you in many other ways (Dismiss w/o cause etc. ) that you also pay for without realizing it.

    Walmart as an employer blows major chow, even with the Union representation in the few stores that have managed to get it in.

    As far as politics go the Dems are much more Labor (and by that I mean anyone who punches a clock) friendly then the Repubs. That is the traditional Dem base in part - their was a day when union busting would get you killed. Now-a-days it is business as usual.

    I guess my thought on this is that though you may be a fantastic (fill in the blank here) there comes a day when you can still do your job, but are no longer the 'Flavor-of-the-Month'. Then what do you do? Truth be told I can always find 2 people younger than you willing to work at .25 of your wage that can do the same job. Always. But ther is the rub...they *cant* do the same job, but for half your price - I can try,and will do so, despite that in the long run it will cost me money. And I as a corperation will live with results..because corp profit is what matters...not substance, and (surprise) it is the young guys running it that run the stats about how much much money dumping those 'Dinosaurs' is saving them.

    And that *IS* WalMart ..all profit - - as long as the US consumer can buy tongs for $0.34 per. If you want to get into the cheaper, faster, better race, jump on in, and when in 10 years you start to drown, holler out, I will be waiting on the shore with an anvil slightly lighter than your Corperate Masters.

    If it is a computerized 'chain store', simply do not put sales information for these 'pre-release' goods into the system until the day of release -- '12:01AM' style if need be.

    There are two known drawbacks to this approach.

    1) Non-computerized store chains and single store 'Mom-n-Pop' outlets.

    2) Time zone issues and a single distribution point of computerized sales information.

    Entirely incorrect. Most union members are forced to join, due to closed shop. The "Fair Share" situation you mention is where workers are forced to pay union dues, which the union then uses for anything, including political campaigns. Sorry, it is a pretty weak argument to say that they are forced to pay dues but they are not members.

    That is great union-thug spin, as union abuse of workers is quite common (look at the assaults strikers commit against working people who cross picket lines), and the wage certainly isn't higher anymore when the union forces the company to move the factory to Mexico.

    Are you using "union busting" to mean insisting on the right of workers to join or NOT to join? Used to that "union busting" meant Pinkerton thugs busting skulls of organizing. Now there are extreme spinners (well paid with stolen money) in the AFL-CIO that call any effort to protect worker rights, such as paycheck protection "union busting". It is no wonder the unions represent the interests of a record low of about 8% of workers.

    That would work except for one factor your forgot. The greed(well possible greed) of the workers. I work at a GameStop and we already have the Guides AND the games in. We got them in on wednesday. Mind you, these all have big bold letters saying "Do not sell till 12:01 11/9/04" but if you had a greedy employee with no ethics all's he would have to do is sell it to people without using the proper SKU or without even putting it into the system to begin with.

    If you pay dues, you have been forced to join. You are using weasel words. It is like saying "I am not a member of the NRA, but I pay dues to it". As for "helping the worker", that is very much in dispute, and it is union-thug spin. It helps some workers, not others. The workers disagree with you.

    We know this does not happen. It is all a slush fund, an workers are threatened if they try to get their money back. There is also a problem with taking the political money in the first place. Why not have paycheck protection so the contributions are entirely voluntary? The unions always put roadblocks in the way to make it hard for people to get their refunds. There would be no problem if membership was voluntary. Then the union could do whatever it wanted to with the money.

    Meijer employees in Illinois, Ohio, Wisconsin, Indiana, and Michigan do NOT have this choice. They are forced. I think this covers the vast majority of Meijer stores.

    Nothing stops you from giving money to the union. There is much more choice there.
