Unless PC chip makers require all binaries be signed to run, I'm really not a supporter of GPL3... I don't have a problem with Tivo trying to protect themselves on a hardware level. Making a product that can be easily modified to pirate movies would (possibly) put them on quite shaky ground legally.
Sounds like what they are doing is legal, but it seems to be a pretty crappy way to create 80 new jobs! Our natural resources are really not ours anymore (if they ever were). I think that to many people oil is more important than clean water.
FTFA: The refinery will still meet federal water pollution guidelines. But federal and state officials acknowledge this marks the first time in years that a company has been allowed to dump more toxic waste into Lake Michigan.
If my band records Amazing Grace, our performance (and any changes, like adding a bass solo) is copyrightable, this does not change the original work (it is still public domain). This prevents someone from stealing our performance (not that I'd care, the more people who hear us will result in more paying gigs!) or our derivative work!
I believe that in film a public domain film may have versions that are not in public domain. If for example a company colorized it or did a significant amount work removing the hiss from the audio track and/or cleaning up the video, their version can be copyrighted.

A judge's interpretation of the law becomes precident and is (generally) applied to cases that follow... (called case law I believe). So over time their rulings don't make law, but change how it is interpreted and applied.

I'm glad I didn't, I don't need someone strong-arming others for me. I copyright my own songs, work out my own arrangements, etc... Sure my band will (probably) be small-time forever that way, but I can still make a buck or two here and there. We usually give away 30% of our songs free (we plan on 40% for our upcoming album), not just the bad ones either. Many people have heard the free one's and purchased an album or T-shirt (either to support us, or they wanted the physical album and the other songs).
I don't want Sound eXtort trying to collect on us (via internet radio) either & try to make that plain on our site. <shameless self promotion> NOTE: the music probably isn't your cup of tea, but it's at http://beckament.net/music.html no banners or anything, I don't get a penny if you visit. </shameless self promotion>
I used to work at a digital studio (back when ADAT was new) and our bass player used to own an indie studio in Chicago, we're doing just fine all by ourselves. The benefit to us (by giving much of it away) is that if people have heard of us, we may get a few more paying gigs here-and-there.
Being in an all-original band is tough, but at least we own all our music! (I'm not a big fan of the $$ of studio time or when producers shit all over a good song either, but that's another rant.)
