    I'd say unlocked, too much threat of a lawsuit, etc because of the presumably thousands people that bought the phone unlocked. The key is what would keep it unlocked, I bet that will fall into some hands that turn it into an awesome patch.

    Note that he did not mention what was being copied, he just assumed we would think music so he added non copyright. It could have been porn, I'm sure if it were porn he would have been fired but saying it the way he did makes it 'organic'.

    If he was released partially because he said he made no money from it and then later on says he hired out his services to hackers for money shouldn't he be afraid of additional charges such as filing a false statment? Personally I think he was a front man for a criminal group to sell anti-spyware software to cure the spreaded malware or some other such scam.

    I loved ice world in super mario brothers, it may seem like you can enter a save point on that 'stage' but in my book that is a partition that can be called a level. I'd say it is for game navigation after the fact.

    I was kind of hoping that one day I could buy an electric car that was covered in solar panels. I live in a city and drive my car maybe 30 miles a day and occasionally take extended trips sometimes going days without moving it. Theoretically if it were solar powered I could get by never plugging it in anywhere. I think that would be an ideal for people who live in areas such as mine who don't have access to a garage and our personal outlets are above a sixth floor.

    I am in the rental business on the side and do pretty well I'd say, no foreclosure risks. I go into tenant apt's all the time for various reasons and it's always the people close to default or that are late that have the best stuff, 52'' LCD screens, 2+ laptops, new king size bed and bedroom set, sub zero fridge. One tenant that had those things was being 100% subsidized by social services. It's crazy, but just like you I live below my means to have no financial worries but it always seems like the ones who default and break the rules make out in the short term, I guess it's monkey see monkey do at that point...

    I've always been very surprised on the various activist groups out there that will call you at 2am to tell you your SS# is on some ID theft forum or that abortion is wrong and yet there is no advocation for forced security updates other than the microsoft 'security' updates.

    I believe before that items were designed to fail as a result of prior models lasting too long. A bad way to make a profit, but when you have one toaster why buy another unless it breaks? Fashion/trends can only go so far. Maybe this was the 20's?

    In a libel action, the plaintiff must prove three elements of the tort of libel, "the plaintiff has to prove it's false." You either just proved me correct or by circular logic and lewd comments you just think you're right. Reminds me of people calling me A$$ whenever I one up them. Anyway, I think this is why it is going to the courts and not arbitration.

    I don't have to prove I didn't but I still have a burden of proof.

    In a libel action, the plaintiff must prove three elements of the tort of libel:

      The statement has been made to a third party.

      The statement referred to the plaintiff. (This does not mean that the statement has to refer expressly to the plaintiff. A statement can be actionable if it is reasonably capable of referring to the plaintiff).

      The statement must be defamatory, which means that it must be a false statement to the plaintiff's discredit.
