Many years ago I was arrested (erroneously, but no matter) and while awaiting my turn in court I got to see the previous night's arrests being arraigned. There had been a prostitution raid, and a number of women were brought into court. One by one they would approach the bench, plead guilty, get fined $500 and be released. One woman, indignantly denying being a hooker, said she was only on her way to the corner store for groceries when she was arrested. When she pleaded not guilty the judge set bail at $1500 and remanded her to custody. Her response: "Wait a minute! If I'm guilty I pay $500 and go home? If I'm innocent I pay $1500 or go to jail? I plead guilty!" The public defender tried in vain to dissuade her, but to no avail. The judge accepted her guilty plea and she went home.

    The moral: I don't know.

Sure. Depends on what premise you start with. Given the right premise one can rationally conclude that war is indeed Good.

Now, in this case, to stay on topic, these guys are delusional. If the military wants to use this software, and I have no idea if they do, they will. A silly little license agreement will not stop them. In fact, there is probably an extant, yet secret, executive order giving the military the right to seize for its own use anything it wants.

I would venture that PC game copyright violation (I don't like "piracy") occurs 100 times more often than console game copyright violation; especially if we're only looking at current generation games.

No one in this case is asking for prior restraint on publication or prosecution for publication; apparently a crime is being investigated (and I do believe that tipping off the subject of an investigation, allowing them to destroy evidence, is a crime).

"F&L on the Campaign Trail '72" is the most remarkable work on American politics I've ever read. Thompson was able to avoid the filtering process of PR men and editors, and brought to life the actual process of selecting a candidate.

Now, with even CNN and the NY Times offering reporters' blogs up for perusal, Gonzo has lost its reason for existence, at least in theory. If HST was hitting the scene today he'd be "The Daily Gonz", or an editor at "SlashGonz".

The next evolutionary step in journalism is the one we don't see coming.

once again I must respectfully disagree. the Civil War was fought for many reasons, but elimination of the right of states to choose the president wasn't one of them. now, the Civil War did go a long way toward creating our current system of a powerful federal government overstepping its constitutional authority, but that isn't the reason the war was fought.

the war was fought to preserve the union, and "union" was understood, even then, to be the equal partnership of the several states in a federal system. if you don't like the idea of the "United States", that's fine; work to change us to something else. But don't rewrite or misinterpret history.

  16. Re:No on Proposal to Update the Electoral College · · Score: 1

I respectfully disagree. The whole of idea of the United States is that government would neither be concentrated in one person, nor would it devolve into the mob rule of unfettered democracy. While the current state of affairs has devolved itself into a bit of a mess, to resort to strictly popular vote to select a president is not, I believe, the answer.

This isn't an abstract line in the sand, it is the principle on which this country was founded. Take that away and we might as well resport to the solution I referenced previously, do away with the fiction of "states" and make the US one big country with one government.

  17. No on Proposal to Update the Electoral College · · Score: 4, Insightful

The whole point of the "United States" is that we are a federation of 50 states. That means that we have intentionally crafted a system in which each state gets a certain minimum representation, both in Congress and in selecting a president. Proposals such as this would change the rules under which smaller states joined the union; their voices would cease to be heard.

If this is really the way we want to go, then we should eliminate state government, replace it with regional governors to attend to regional issues, and stop pretending that states matter.
