However the only reason why they are locked in the first place is that Intel or AMD did extra work to lock it... Completely shifty on their parts.

Any users who needs this one metric (in this case integer computation) would be crazy not to go for AMDs cpu over Intel's. This would force Intel into one of three options.
1) Adjust their architecture to match (Unlikely as this takes a lot of time and $$)
2) Cut their prices to even out the battle (Unfortunately they would have to cut their price everywhere which would kill their profit margins on unrelated customers)
3) Let AMD carve out a niche market and let AMD gain significant sales.
