I actually made something on my Wii several years ago. It was a fun experience and I wouldn't have had it if it wasn't for something like this. Not everyone is out to just pirate games.

I was a company that had an open type plan for the developers. We liked being able to bounce ideas off of each other without really getting up and the overall communication improvement with in the team. It was helped others followed simple etiquette rules. The big rule being if someone has head phones on don't bother them unless it really is important.
What we hated was everyone walking through our space to get some where else. No one could understand this isn't a walk way. It's where we work. It's like a giant office just for us. We eventually put filing cabinets up and blocked our "open area" off so it was still open in the sense we could talk to each other, hold meetings and get the things we liked out of the design, but reduce the things we hated.
I rarely argue the employer, but start ups are completely different beasts. When you sign on to work with a startup crazy hours are expected and the possibility of missing paychecks is to be expected as well. You goto work for a startup for different reasons than you do a big corp. You generally get more say in the design of the software and you get to meet great contacts that you can goto in the future to fund your own startup.
Startups are generally strapped for cash and don't have big development teams and are expected to hit deadlines. Sometimes it's called for to work that 100 hour week. That's why you don't generally see people over 30 working at them or people with families. However, that shouldn't be the norm, but the exception. Generally after a crunch period you'll get to take several days off the next couple off weeks (think 3 day work weeks) to make up for it or you get to come in late for a while. If you've had long periods of crunch time the first two options aren't generally available to make up for all the time lost so sometimes they'll offer a cash bonus if they have the funds or after the next round of funding mixed with one of the first two options. If they don't give you one of those options after a crunch period then the startup is ran by morons and will fail.
I've worked at startups most of my career. I'm reaching the "over the hill" age of 30 and I have a family so those days are pretty much behind me now, but because I did all of the above I know VCs and they like and respect me. As a result if I need funding for the company I started a couple years ago I could probably get it.
I could see a lawyer arguing that the point of sale was where the server that handled the sale was located. Whether or not that would hold water is another story.
In most places it's not. I can legally go riffle through your garbage once you put it out for collection. Private business on the other hand you might not be able too. I'm not sure exactly what makes it legal for someone to riffle through my garbage, but not theirs (if that is the case).
No I'm not frustrated that people are still trying to solve this problem. I'm frustrated at the exact same topics showing up almost weekly on slashdot. As far as what have I done? I've done exactly what everyone else on slashdot as done, jack shit. If we're lucky we have 2 people that will even see this article and have any ability to influence any change. Even if we (slashdot) did have some sort of godly internet powers that let us (slashdot) influence changes on the internet we wouldn't even be able to agree on what to change.

It does get better. After a while you learn how to work around those issues and they start to bother you less.
