You are right there is a point where we just will need to kill you because you are a cost to our society.
Sound rough, yes? What about health care?
The reality is that the problem is not the drilling of oil. The real problem is that people are so damm used to driving SUV's and wasting energy! THERE IS NOT NEED FOR A HUMMER!
You know I can understand the reason of why we want to do this. I can even understand why people want a neutral standard. BUT... You know this is so boring because it is not going to help me one ioata...
Yes, yes in the *future* all will better. And we will have solved world hunger, poverty and what have you...
Yes I am frustrated because I F****G wish they would make Open Office a REAL competitor to Office.
For example Calc in OO now has the ability to go beyond 256 columns... Wow, progress! NOT!
Maybe if OO became a REAL competitor Microsoft would think much harder about playing nice!
If you say, "hey you have the sources..." No, I want to pay for a Microsoft competitor!
Share, I call BS! You were taught to share... Mind sharing some money with me? Mind sharing some of your food with me? I can give you something back, who knows... Maybe other stuff...
So we exchange and share yes?
Oh wait, how about you share some food for me, I give you a dollar. I share some music with you and you give me a dollar.
See what we did? We shared, but used currency as a way to measure whether or not one of us is getting the short end of the stick.
When people are asking for money they are asking to share, but they want money in return...
I am not being cynical here, but all barter systems and such boil down to currencies and neutral exchange mechanisms...
The problem is that people don't like today's currency system since they can be rich quick. It's easier to invent a new one...
>But there is another way to measure the value. These types of works can also be measured in the advantage they bring humanity. The more people who are enlightened, entertained, educated, cultured, the more value.
Whenever I hear this I think how are YOU going to measure the value? Who made you God? Money believe it or not is a direct result of the barter system. People got tired of lugging around goats, chickens and REALLY big stones.
No, here is a question for you. Let's say that you believe your system, what do you think about modern art?
I ask this because modern art is a direct result of a bunch of people who determined what is good art and bad art and paid for it.
If you don't believe me, read the book "Why are Artists Poor." He is an economist and artist who makes the case that art is what it is because those who pay determine what is good and bad art. In other words they determine how enlightened, entertained or educated art is.
If you don't believe me that an elite manages what art is of value, then consider the following which he states as well. Why is listening to Beethoven considered good taste and being cultured. Yet listening to Pop is considered being primitive? This is a direct result of your "value" system where a set of people think and other sets of people want to seem "cultured" and intellectual.
Notice how yet again in that system there is an elite who controls everything...
What about the Yahoo board asking 40 USD? What about Jerry Yang who rejects 33 USD and does not even take that to the board?
What ICahn is doing is telling Yang to go take a flying leap. I think Icahn is right here.
Yang let his emotion of hating Microsoft get in his way of business. If Yang had owned 51% of the shares then that is his right. BUT Yang owns about 43 million shares of 1.4 billion. This means he can say squat on what "his" company can or cannot do.
> Or would the person be charged with trespassing and petty theft by the local DA? In other words, you're being ridiculous. There is juuuuust a bit of a difference between "no punishment" and being sent to a "federal pound me in the ass penitentiary."
You just trivialized the stealing of potatoes. You don't think its a big deal. Just a little crime. nothing to worry about. My father-in-law would love to fine people 200,000 per potatoe because maybe then people would think twice. He earns his living with potatoes and when people take potatoes you are stealing from his pocket and food from his table.
This is exactly the reason why fines are as high as they are. You don't even consider the damage on the other side of the coin because well it doesn't affect you.
1) You have satellite... 2) You probably even have wireless from another telco
>I'm fairly certain the police don't stop or slow access to major roads just because a criminal -might- drive past with a body in the trunk
Really? Huh, what about those spot checks for drunk drivers?
>What I do with them is none of their business.
This is one of the most misunderstood pieces of the law. Let's consider your road metaphor.
If I drive on a road I have the right to drive on the road under a specific set of conditions. * I may only drive in the direction required. * I may only drive a certain speed limit. * I may only drive on a certain side of the road. * I may only drive with lights on at night.
>Oh please for the love of all that is holy, everyone stop using the "dont like it, switch" argument! Its common knowledge that the majority of US broadband users are only serviced by ONE company. Its simply not an option, and its getting old.
Oh please get with the show yourself. There is two way satellite. See an alternative...
>always on high speed access to the internet
Let's explain this one. Is your connection always on? Yes. Do you have high speed access to the Internet? Yes. Do you always have high speed access to a specific protocol on the Internet NO.
But then again it was not written in the words was it now?
>There is illegal software via HTTP and FTP too, in fact one might say that there is just as much via HTTP as via P2P.
That's right. BUT what about the percentages? People seem to forget that....
>It would be like if I set up a huge pile of sand in my backyard, and I had people pay $40 per month to get as much sand as they wanted and it said so in the contract and through advertising.
Read your contract. Does it not say that they have the right to terminate you if you overuse the network?
>I don't know where you live, but here in the US there are about 3 main ISPs and most if not all have torrent throttling.
Yes depending on the service you purchase you get throttling. Here is a suggestion GET a more expensive connection. That is exactly what I did. I have a SOHO connection and I pay more. BUT I also get an IP address and non-throttled connection.
Oh give me a break. You are saying it is ok to rip people or companies off?
Mind if I grab into your pocket to steal your wallet?
What you remind me of are those people that go into the fields of farmers and dig up vegetables or fruits. My father in law is a potato farmer and he has about 500 acres of potatoes. YET time and time again people go to his fields and steal potatoes.
They think it is ok to rip off from larger farmers. After all he won't notice, or he is ripping off the consumers or he is big enough to deal with it. The reality is otherwise...
For the most part GPL software is available without BitTorrent.
Yes there there are some pieces of software that are available on BitTorrent. That typically are installs for Linux from Suse, or so on.
So yes you are right, but that's the theory. Let's look at the facts. There is more illegal software than legal software. And I am sure it is clogging the networks of Comcast and other network providers.
>Just because some people use knives to kill people shouldn't mean that we have to now use forks to cut our meat
That only applies if you have bought the network. But since you haven't and are using the network as a service then they can give you any kind of knifes they please. Don't like, switch!
Wow way to go to cut down your project. If you want to send an email to the university word it with some optimism.
Dear University,
I have recently noted that you have adopted the use of a F/OSS software program that I am the primary developer for. I would like to thank you for your choice to promote Free and Open Sourced Software and say that I am honored by your selection of my project in particular to serve your needs.
At this time, I feel that it would be appropriate to inform you that this F/OSS project, while meeting your needs, does need ongoing support. This is not to say that the application is incomplete, more I am thinking along the lines of when many users ask basic questions like, "how do I do X?" or "Why can't do I do Y?" Additionally I am thinking that there are a number of features which I feel would benefit your University. With your financial support it is ensured that your future requirements and needs are 100% covered.
Having said all that, I am greatly interested the opportunity that University use of my F/OSS project presents, and I would like to present a set of possibilities for consideration that would greatly improve my ability to guarantee that you have the most mature, feature-complete software possible in the months ahead.
1. *** A support agreement between the University and myself (though affiliating yourself with a proper business entity to protect your personal assets would be VERY prudent) so that I can guarantee support on any issues with the F/OSS project encountered by the University. By enlisting the services of the author before issues occur, I hope it would give you assurance that I am committed to the F/OSS program and peace of mind that things will just as intended.
2. *** A development agreement between the University and myself to produce and release features that would benefit the University.
3. *** A partnership agreement between the University and myself so that we can build a working relationship that will be mutually beneficial. Depending on the needs of the University, I could offer to mentor as many as a dozen students whose assistance could greatly accelerate the development of the maturity of the F/OSS project.
I hope you will consider these possibilities and that you remain satisfied with the utilization of my F/OSS program. I look forward to being able to work with your University to continue to develop software together with hopes of it becoming useful for other Universities throughout the country and throughout the world.
Best Regards,

The main difference between mine and yours is that I am saying, "hey look cool that you use my project, and here is how this can work even better."
You are saying "Hey cool that you are using my project, but you know its not that complete, and needs more features and I am sure things could be added specific to your university."
Which one sounds more optimistic? I would say mine.
>IMHO, in the long run a subscription based anti-spam solution is the only way to go. Spam is mutating every day and having to keep up with it yourself is an exhausting task. So you'll have to treat the spam problem as you do with viruses: purchase a subscription product that is updated daily.
I came to that conclusion about a month ago. I simply became too tired with all of the SPAM. I decided to go the route of hosted domain Google Email.
>In my personal experience, while I'm a big fan of open source, open source anti-spam solutions require too much configuration and maintenance to really be practical in the long run. But your mileage may vary depending on the requirements your company sets forth.
I was using Open Source (ASSP and SpamBayes). It was not that they were not working. They were working like a charm. The problem was that I need to constantly update and tweak the database. I can appreciate that Open Source would have a hard time coping with that and I don't blame Open Source. It's just that I am getting tired of this SPAM game.
I have the option of running my own email server, or using Google hosting... It really is not that much anymore a matter of cost (reasonable). The reality is that SPAM is a ROYAL PAIN IN THE ASS!
GMail actually does a really good job. I am very impressed. So what I did was move our domain to hosted Google Apps. That gives you the benefit of your own domain, while still getting the look and feel of Gmail.
Besides their search business, this single feature of Google I find very compelling. Google REALLY knows how to take the pain of administration from your shoulders.
Do I use the spreadsheet, or docs? Naahh... Not a chance. Too simplistic...
Wait one minute. There is public street and privacy. Let say that you take a picture of a street full of apartments. (This is the case in Paris) And in one of those shots you happen to take there is a woman changing. Yes the shot is inadvertent, but it is invasion of privacy because the angle of the shot happens to include both the street and the woman.
As the article said:
2. By taking, recording or transmitting, without his or her consent, the picture of a person who is in a private place.

2. By taking, recording or transmitting, without his or her consent, the picture of a person who is in a private place.
When you take pictures on the street of somebody in a window of their house that is considered private. Google does that and hence is violating the law.
No... If they act in France they have to respect French laws. Think of it as follows. I speed and get a ticket in France. I don't live in France, don't have a French drivers license, and so on.
Do I have to pay the ticket? No, but then again France reserves the right to refuse to let me into their country. Google has the same problem.
Well dude you just buggered up in your stock picks.
Apple is falling, and I think for the foreseeable future the range is 210 and MSFT is just going up...
This is what happens when you let emotion get in the way of making sound trading decisions...
BTW I was long AAPL, but sold out on 184.42! What's AAPL now...

Need I go on?
No from what I remember what happened is that tax rebates were given. No monies were actually given out.
Were the telcos completely honest? No not really, but that is a second issue.
If you say you have the right to rip off the telcos because they ripped you off, well that is taking the law into your own hands. That's illegal...
Don't like what the telcos are doing? Change it, do something? Stop complaining!
>Oh please for the love of all that is holy, everyone stop using the "dont like it, switch" argument! Its common knowledge that the majority of US broadband users are only serviced by ONE company. Its simply not an option, and its getting old.

No it is an alternative...
If you only have Comcast then you can get satellite.
See already an alternative...
Ah an alternative that restricts how much you can shove down the pipe is not an alternative? Well that's your problem.
As I wrote in another post. Buy a more expensive connection and don't worry about it. These issues are a matter of money.
>There is illegal software via HTTP and FTP too, in fact one might say that there is just as much via HTTP as via P2P.
That's right. BUT what about the percentages? People seem to forget that....

That is not called justice. Its called taking the law into your own hands. And that is ILLEGAL...
Justice is not about getting your way. Justice is about protecting your rights whomever you may be.
And then there were laws created for the poor...
For example unions...
What you are doing is seeing only your side of the story.
I am going to play devils advocate here...
For the most part GPL software is available without BitTorrent.

OMG... You mean offer money to get things done? What a revolutionary thought...
And how would he make money? Here is an idea, what about charging money for the software? Why that would work...
Cynicism aside this is actually the reason why Open Source as noble as it is, will fail to attract critical mass...
If you think now there is critical mass, take a look at the bottom lines of Open Source companies and Closed Source companies. NOT EVEN CLOSE...
Wow way to go to cut down your project. If you want to send an email to the university word it with some optimism.

Even more basic... A university is using it, and they are not paying support... That is a huge gaping missed opportunity.
I would put it very simple to the university, "I appreciate the support, but I need support as well."
