You've obviously never worked with MS in a corporate environment. 1, 2, 3, 4, and 5 are all easily done with tools MS provide for corporate deployment. You have a tier1 image with all of your drivers/default apps/etc. You then package all of your less used apps and administer them via group policy.
If you know what you're doing you can use mono + monodevelop. THere are howto's out there, and they're getting close to having a "1 click install" like arduino is.
You have to remember the big difference between the USA (where policies like this tend to NOT work out) and the rest of the world (where socialized medicine, shared infrastrcuture, etc tend to work):

You're 100% right, the last I looked at esri was almost exactly 3 years ago. At the time we moved away because our local ESRI prof svcs guy essentially told us web apis/soap/etc were not in the pipeline.
Have you ever tried to you ESRI mapping APIs though? A few THOUSAND poorly documented COM+ components (and 1:1 wrappers if you want to use dotnet) does not an API make.

The FSF is not in any way threatening legal action, nor making demands. They've simply said, "This app isn't redistributable by your store due to licensing problems. What can we work on to make it so that isn't the case?" to apple.
Any lawsuit about copyright would be filed against the author for obvious reasons (the app store terms of service imdemnify apple against these sort of things and put the "check your license conditions" issues onto the shoulders of the author).
