    Not necessarily, a lot of people live a month or two in debt; in a whole but likely to get out eventually.

    So does NYU. Though admittedly as a CUNY grad I have no problem making fun of NYU.

    The only people who lose from inflation are people with a large percentage of their over all wealth in cash, which is to say poor people lose out from inflation.

    Except if those poor people have more debt than assets, in which case they win.

    If you go after big gangs and organized crime you end up with dead cops because those guys will defend themselves.

    That's just not true; in fact, federal agents especially tend to focus on the bigger gangs and organized crime because they think it's more efficient to get rid of the big fish than chase after a lot of small ones. There's a reason that organized crime organizations (in the U.S. at least) have tended to go out of their way to avoid violence with police; in fact, if an individual in one of those organizations killed a cop he would usually be killed by his own organization in a very public way to assuage police anger.

    And not all the l*wy*rs, either. NYCL is a good guy, but 98% of his profession makes it bad for the rest.

    I've worked in IT, and I've worked in law, and I think the ratio of jerks to nice people is about the same (around 1:1).

    I'm really not sure why I bother, except that they are in the same minimall as Wal-Mart.

    If you have to frequent minimalls that have Wal-Marts and Radio Shacks you need to move to someplace less soul-destroying.

    I hate this kind of thing, but I do believe that this is a standard practice for settlements outside of court for ANY company not just Apple.

    This isn't a "settlement" really though; it's just a refund outside of the warranty period. Demanding silence in exchange for a refund is idiotic.

    It should be illegal for a teacher to confiscate property from a student. Just because a student is on school property doesn't mean they have no rights regarding search and seizure of personal property. (I'm not sure what the courts have ruled on this, I'm sure they've said something.)

    The courts have said students have some rights in terms of search and seizure, but they have much less rights when they're on school grounds than they do off.

    Wells Fargo sueing itself (for default loans) is required to properly acquire payment. It is not like they are going to contest it and sit in court aruging with each other. Yes it's silly, but it is the fault of how the law was written not the fault of Wells Fargo. I am sure Wells Fargo rolled their eyes and said "come on, this is stupid, it's our company trying to write-off the debt to OUR company".

    It's not even that bad; the law isn't forcing them to sue themselves, it's just from a procedural standpoint slightly more time efficient to go through it this way.

    This means that as soon as you hit 18 you can choose to smoke dope, frequent hookers, drink alcohol (that's from 16, really), eat shrooms, vote, have sex (that's from 16, really), have same sex sex, marry someone of any gender, have an abortion, commit euthanasia in a pinch and convert to any or no religion.

    Just can't choose your words, or choose to own a firearm. Honestly, realize you can be imprisoned for what you say.

    Yet we are a social-democracy. According to many Americans this seems to equal a Socialist or even Communist State. In spite of all the choices we have, we're reputed not to be "free". When I then urge these individuals to consider the range of choices they have and from what age, they tend to shrug their shoulders and tell me they're right anyhow.

    "Many" would still mean a minority, though. I'm curious where you're meeting these Americans, by the way, most of those who would call the Netherlands "communist" tend to be found in more rural areas that most Europeans never really go to. If you're meaning the internet, then that's not really a good way to just anything in terms of public opinion, because the most ignorant people tend to be the loudest.

    Actually, no. People have been criticizing Stallman on these grounds since at least the 1980s, even after he's been proven right on issue after issue.

    Yep, especially on Slashdot. Criticizing RMS on slashdot is not exactly an example of pioneering courage.

    Some legal letterhead and a motion to dismiss is all it takes to make the case go away.

    I don't think this could be dismissed; if I represented this guy, I'd answer the complaint, denying everything. Any response on their part other than a voluntary dismissal, I'd file for Rule 11 sanctions and file a complaint with their state bar.

    If the judge was presiding over a DMCA case, and ruled that IP addresses didn't constitute personally identifiable information and therefore wouldn't support an RIAA subpoena, the same exact people ridiculing the judge here would completely reverse their decision and praise the decision.

    Europeans tend to have a medieval view of speech rights. This isn't surprising at all if you look at Europe as a whole.

    I would love to see the EFF argue any case successfully, their track record is not the most impressive. Rather than experienced trial and appellate lawyers they tend to have very smart, passionate people without much advocacy background. The Fred Von Lohmann guy, according to his biography, did transactional work before joining the EFF.

    It's not Wells Fargo we ought to be upset at, it's the legal system that's so borked it requires a company to sue itself. Can we burn the law books yet and just govern ourselves by common sense?

    If you want civilization to collapse, sure. Burn all those books and when a bank forecloses on you, they don't file a legal action but send a bunch of guys with baseball bats to throw you out of your house.
