    Under ICANN rules the domain with intentionally false whois information should be terminated immediately. Not after 2 weeks notice. In addition, if someone uses false whois information, the billing information should be made public.

    If a registrant uses a domain name protection service and then spams, then that information should me made public!

    In a layoff situation, some people may go postal. I was laid off from one company (to cut their burn rate), one person stormed out. I finished checking code in, removed my personal software and packed up some of my office to get the rest the next day.

    Where you have given notice, any damage that you may do has been done. Any time-bombs to be installed, would have been installed. Copies of code would have been made. The difference is the person who made the schedule -- the employer or the employee.

    I would be insulted, but have to move on anyways and then possibly start the new job early.

    Of course I worked with someone who was about to give notice, and they company laid him off with 7 months pay.

    Usually rulings do not set precedent until an appeals court rules on them. But, if there is a ruling in a case, Collateral Estoppelapplies to the parties in the case. If the EFF brings a case and wins, if it a good win.

    Even when they loose, they win. They bring the issue to light. If you don't like how they handle a case, then you take the case over or hire a lawyer to take the case over.

    This applies to doctors, lawyers, fighters, etc. If you only take easy cases, you can always win. If Mike Tyson only fights drunks at the local bar, he will always win. If you only take hard cases, you may lose more than you win.

    I was working on a digital cinema system based on RH 8.0. It Played WMV files w/o problem. It includes Linux drivers and playback software.

    Not just cybersex.

    There is unlimited potential for this. This is great for monitor preasure on a person. This can be used to measure what a person is doing, reproducing motion. This can be used to model ergonomic and analyzing movement.

    This can also be used for people who have no sensation in limbs as a warning mechanism.

    For cyber sex to work, you need to implement both sides of the equation, force applied to the other side. There is an advantage to cybersex over real sex, ANTI-VIRUS SOFTWARE.

    But, I am/was suing them (the first time) because they violated the employment laws and after discovery they paid me 3 years salary instead of risking a jury awarding more. Then, I sued after they refused to drop a libel claim, a libel claim without a real basis that they only brought to shut me up.

    This difference is that I don't bring my claims to terrorize.

    In litigating with spammers the first response is, "it is not us." I had one spammer try blame it on competitors and anti-spammers, but there was no offer of proof. Though this is different since liability for spam is not only on the person who presses "send" but also on the advertised site.

    The "somebody else did it" defense is common. But, what proof has been presented to support it?

    Here, we have not seen what evidence has been presented (in a summary judgment motion or motion to dismiss).

    Mattel tried to shut me up, but I fought and they lost.

    Since you've veered totally off-topic anyhow: "limiting the amount of spending increases" is effectively cutting spending, if demand for those services are increasing faster than the spending limits can cope with.

    It is not the same. Cutting is reducing, this year's budge is $X and next years budge is $Y, where why is less than X. They said cut, not effectively cutting.

    What I said was 100% accurate. An interesting thought, why when producing something, you get savings in volume, but never in education? And is there any data that supports the theory you propose -- the higher per student spending, the better the education?

    Just like how the unions are saying that Proposition 75 is a way to silence union members. What is is is to say that the union can only take money out member's paychecks for political campains, after they get permission. Not jump through hoops to get a refund of polical dues. Or Proposition 75 will cut school funding. But it actually limits the amounts of spending increases.

    Do you really believe it is $60K? I'd bet that he hid some of that money. I have a ink spammer whose attorney claims that he is broke, but the discovery that I have examined indicates that he was making between $49k to $70k a month.

    Would a spammer lie? Would a botnet owner that works with spammers lie?

    I don't think that slashdotters would get upset if the MPAA/RIAA sued people running P2P networks that was selling copyrighted matterial. Spammers abuse our computers and servers for their profit. When they are asked to stop, they send more.


    Laws only work when enforced. If the idiots in D.C. didn't pass the I-CAN-SPAM act, much spam would be eliminated as the California law would have made each spam illegal. But even with strong laws, the only way to stop spammers is to either take away all their money, or put them in prison and give their cell mates penis enlargment pills and cialis softtabs.

    I had a tour of the FBI's cyber crime office in Boston -- they got some neat toys.


    They didn't just take away his stuff. They took away his stuff, to then copy it onto network storage. Then copy the drives onto otpical media. Then copy it onto hard drives. All while leaving the originals unmodified. Then they will analyze the data to gather evidence.

    It would be real sweet to know the domains that they used so that every spam victim can file suit against Ralsky and Bradley. We can take out spammers with distributed lawsuits. A spammer can survive 1,2 or maybe 10 lawsuits, but can they survive 100? I, with help, took out Avtech.

    I tracked down a big time ink spammer, going under the name of payless inks, top quality inks, inks on sale. I posted the strings to search for on my spam page so that any spam victim can file suit. If you file suit, contact me and I'd be happy to serve the summons and complaint.

    You are correct. Of course, if they try to hide the money, you can go after them for it and dig. I know someone who will be filing a suit against Soloway (for spamming), but he will be in line after Braverman and Microsoft -- But he is determined to "make him my bitch."

    Even if they are overseas, you can still go after them. I went after Global Web Promotions in a California court. They spent at least $25K tried to fight. I cannot discuss what happened after. They are subject to the jurisdiction that they inject themselfs into.
