    No, it does not lead to tough enforcement. It only makes enforcement a little easier. I am waiting for them to issue a report on required labeling so that we can program spam filters.


    The US can enforce our laws in other countries where there is a treaty that permits it. The FTC has gone after Global Web Promotions in Australia. The FTC was aided by the Australian authorities.

    It is harder to track them down and take them to court. This method could be profitable, and it also tends to stop them from spamming you.

    It is now always true, I filed a suit against Avtech Direct and they are still spamming me.

    Maybe when the sheriff comes into their offices and takes all their computers to auction -- to pay the $50,000 in judgments from all the lawsuits pending against them), they may stop.

    Last year, Berman tried to pass a copyright measure which would immunize a copyright holder's efforts to stop someone from violating their copyright -- hacking into their system to remove the material, take it off the network, or shut it down.

    Last year, I received about $30,000 going after spammers. 4 of them are out of the spamming business.

    I just settled with Global Web Promotions, but cannot discuss the terms. But, part of what encouraged me to settle is that the FTC has gone after them (and I am helping with that) and had an injunction and order to freeze assets granted.

    The I-CAN-SPAM ACT and the Ohio law may get some of the worst spammers, but that does not take care of most of it.

    By allowing a private right of action for individuals, you get some of the smaller-time spammers.

    There is one spammer, AVTech Direct (Avtech Direct 22647 Ventura Blvd. Suite 374 Woodland Hills, CA 91364), that I and about 10 others filed suit against for spamming. A $5000 small claims judgement won't get them, but if they had 100 or 1000 judgments for $5,000 each for spamming, they may not spam anymore.

    He is not pushing for more illegal workers... He's just trying to get them to be treated as human beings.

    Huh? Lets see, they don't enforce the laws to require employers to check if the employee is legal. They offer amnestly to people who broke the law and was able to sneak across the border. When there was talk of amnesty last year, the number of attempted border crossings increased by about 50%. If there is a "guest worker" program, it should be required that they come across legally -- if they are here illegally, they are forever banned from using this program. I have gone through the process of getting a K-1 visa for my wife, so that I could bring her here -- LEGALLY!. Why should the people who went through the effort to follow all the rules, come here legally, have someone sign a document that prevents the immigrant from becoming a public charge, be slapped in the face by a program that says, "you broke the rules, ok -- it does not matter."

    I suspect that the Indian government will start limiting this type of worker, because it impact on jobs for Indians.

    In Mexico (from my understanding), a foreigner must have a permit to work there. This is really ironic because Fox is pushing for more illegal workers in the USA.

    I have dealt with programmers in India. They can program, but it seems as though they are limited in common sense and creative problem solving skills.

    I had explained the equations to convert hardware values into input levels. They looked at the values and could not understand why they were getting 0 for an input value -- they didn't realized that you have to have an input device generating audio to have an input level. In porting an application from one platform to another, they didn't think of looking at the original application to answer questions -- yes, they did have the original application in a running condition.

    That is why Barbi Leigh surrender her prior domain BarbieFlasher.com. In the Miler case, they spent over a year litigating it, and even made the one of lawyers in the case want to quit law -- because the tactics of Mattel and it's attorneys.

    Mattel tried using a libel claim to try to shut me up. It really backfired, as that got the interest from a TV station, CNet, and the Boston Globe on two occassions.

    Of course with me, Mattel learned their lesson, as they didn't say a word about Mattelabuse.com or BarbieSLAPP.com.
    But, they didn't learn their lesson before they were ordered to pay $1.8 million to a photographer that they sued for using the Barbie image.

    The doctor who treated me in Mass. was charging $70 per accupuncture session. The muscular therapist that was treating me was charging $60/session.

    When I had tendinitis, I went to China for accupuncture () and found it to be much cheaper.


    For 2 weeks of daily accupuncture and massage, and neck and arm x-rays, it was a total of $72 USD. In Boston, accupuncture alone is $45-$70 per session.


    I got the Chinese rates as the hospital since I had a friend who had a girlfriend working at the hospital. The Foreigner rate is much higher, I was told 3x.

    There are general consumer laws of deceptive and unfair practices. What he did is like a protection racket -- a few guys walk into a restraunt and ask for protection money to keep people like them from breaking up their restraunt.


    Under California law, Penal Code 502 prevents his from installing unauthorized software.

    Remember the guy in Georgia who installed SETI or some other software like that on the University Systems getting charged for doing that since he had no authorization?


    The FTC has the power to take action against companies that act in a deceptive manner. They are not only going after GWP
    but, also for selling penis enlargment pills that don't work.
