With XNA the XBox is the most open of the game consoles from a developer's point of view. PS3 allows you to run Linux, but access to the video hardware is quite limited, and for the Wii your only route to hobby development is homebrew.
Piracy is the unauthorized distribution of copyrighted works. If you circumvent the copy protection but do not distribute the resulting product, you have effectively broken the DMCA but that is not piracy*.
Any given game is supplied by a single publisher. That means the publisher has a monopoly on said game. Supply and demand has no bearing on monopoly prices. Economics 101.
Price fixing happens when multiple suppliers agree on a price level instead of competing between themselves. The publisher has no other supplier of the game with whom to agree a price, thus no proce fixing.
It did work quite well for them. Got them to over 90% browser market share. Now if Google Search starts working slower for the other players we have a new shiny antitrust suit on the works.
LMAO. Yeah. Because Kazaa didn't tell you at the start of the install that files on your computer will be shared with other users unless disabled. Oh wait, it does.

I do, as well as a host of other people. Donating on a monthly basis. Others do donate at lights. The older volunteers who are no longer physically apt to work in fires and rescue keep active by holding events to bring in more monthly donations.
On the other hand, the ISPs would finally have an incentive to increase effective speeds, since the faster your connection the more data you can move around.
The RIAA is an organization dedicated to maximizing restrictions on copying, redistribution, and modifying music. They have a virulent, though perhaps less open, bias against music customers; and are blatantly biased against the public.
Which is why you will buy it online directly from the publisher's site or console maker's store (so they can blame your ISP for throttling/capping your connection), and they will make extensive use of P2P technology to deliver the content (thus not paying for the bulk of the distribution channel and further encouraging your ISP to throttle/cap).
