    You are incorrect. TCS has to offer the prevailing wage. As per law it does not have to give the existing employees first crack at it. And if they already have employees who can do the job the govt cannot ask them to fire their own employees and hire the ex-Disney workers in their stead. As I said if you want ex-employees to have first crack at vendor jobs you have to put that into law. Its not part of the law currently. And it most probably never will as it would break the whole model of outsourcing a function to a vendor irrespective of whether the vendor is an American or non-American firm

    No jobs were outsourced. A function was outsourced to a company and it was upto TCS to decide what kind of staffing to use to execute the program. Those Disney workers could have applied for jobs with TCS. They preferred not to and instead preferred to make it an issue of foreigners taking our jobs. The only way to make them happy would be to specify that anytime a company outsources a function the vendor needs to hire all the employees doing the job currently. Of course there would not be any cost savings then. The whole precept of outsourcing a function is that the vendor can do it better or cheaper (with fewer people). This means they have some efficiencies of scale due to doing the same thing at many differnt installations they can share common resources.

    HR does not have to recruit for every position. HR simply has to file an LCA which describes the needed position and the wage being offered. If the wage matches the prevailing wages the company can go ahead and file an H1B. There is no requirement to recruit locally. it would not work. If you need someone in October you have to file the H1 in April which means you have to do the hiring in February. Noone local will interview in February and then wait 8 months to join a job. H1s are filed for general positions which will be needed 8 months in the future not specific (you cant be specific 8 months in advance given the pace of the industry)

    They are not breaking the law. They look at a position advertised as needing 4-8 years experience with salary 70-90K as the prevailing wages. They will hire someone from India with 8 years experience at 70K. Over a period of 4 years his salary will rise to 90K. At that point he will probably have a GC EAD and move to a product company to do more valuable work and get paid more. The consulting companies are based on the precept that the work which is outsourced out does not increase in complexity every year so you do not need more and more experienced person to do the same work. Once the person's experience demands a salary better than the billing rate for the position commands he/she is expected to move on to a better job and be replaced with a more junior person. This model does not work for people who expect to work forever at the same position and have their salary go up just because their experience went up. Typically what happens is that a whole department has been around long enough that their salaries have gone up with annual increments to a stage that it makes sense to outsource. The way to avoid H1B outsourcing is to keep moving up the value chain. Either do work not easily outsourced or if it can be outsourced do it with fewer people every year (automation). If you have a group of people with high business knowledge and automation (dont make the automation idiot proof . Focus on efficiency not robustness in the automation) its difficult to outsource

    He said he will get back jobs. Not that they would be middle class jobs. If the minimum wage in the US is made less than the minimum wage in China and unions are banned , companies will bring back factories. People who work these jobs will just have to get used to living 4 bunkbeds to a room and 6.5 day weeks to be able to afford food. The sick will just have to die as these jobs will not have medical coverage. Also the boss will not give time off to go vote so these workers will not vote out Trump next time around.

    Handouts to corporates is OK? Most Republican states depend on handouts from the federal govt because they give so much corporate welfare to their golf buddies that they cant pay for their own social services. California contributes more to the federal budget than it gets back as do most Blue states. The Red states are the ones running on handouts.

  14. Let me put it this way. The opposition to Hitler accepted his electoral victory in 1933 even though the Nazi party had used voter intimidation and minority baiting to win. They felt it would help democracy and they could always come back in the next election. Most of them died in gas chambers. There are some elections you should not accept else you are writing your own death warrant. Trump is not a normal politician.

    California must be doing something right if the population has grown so much. People actually want to come here. Unlike the Republican South from where people are leaving in droves for Blue states. Election by popular vote would be a good way of giving feedback to idiotic state govts. People could vote with their feet by leaving the idiotically run states . Instead we have an Electoral college. Even if people leave the idiots stay behind and still get a voice in fact the idiots voice gets more valuable

  18. CO2 is not a pollutant. Clean cola refers to reduction of Sulphur, Mercury and soot emissions. A Coal plant which emits only CO2 is a clean plant. When will you get it out of your mind that CO2 - the basic food for plants without which plants would not grow and we would all starve to death is not a bad thing. Global Warming even if true is probably not a bad thing. Canada and Siberia will become grain baskets and a warmer world means more rain in the Sahara and India. We could even have a Green Sahara.
    Canadian governments fighting Global Warming is the most traitorous Government action I have ever heard of.

    Maybe the problem is their factory is in Fremont which is in the Bay Area. They should move to a more reasonably priced place like South Carolina and they could pay top dollar. In the Bay Area they are getting the ones who could not make it in Tech or service industries serving those in Tech. Quality is bound to be an issue when you are scraping the barrel

  21. If you are going historical why not go to UK and Russia invading Iran during WW2(supposedly to keep Iranian oil out of Nazi hands though the nearest German territory was 1000s of miles away). Or even earlier lets talk about Iranian-Greek relations because Alexander. Or something more recent all the help Iran gave to the US forces going into Afghanistan after their common enemy Al Qaeda or the bad relations between Iraq and Iran though now they are besties. Nations change alliances as needed per their national interest. Right now Iran's national interest is fighting Sunni extremism and reducing Saudi influence in the Muslim world. Russia is a good ally in that fight and so is the US (as long as it can break out of the Saudi camp)

    Vote disparity in Japan has reached absurd levels. Political power is based on population distribution at the end of WW2, when much of modern Tokyo was still farmland. So urban areas are extremely disenfranchised, while rural areas with nothing but a few elderly farmers have disproportionate power. One result of this is extreme tariffs on agricultural products. When I lived in Japan, rice was ten times the American price, and American servicemen would buy American rice at the base commissary and smuggle it off base to give to their Japanese girlfriends. There were "rice police" to stop this, and some of the women were caught and went to jail (they couldn't prosecute the American men because of SOFA).

    In many countries, the elderly block change, and progress has to wait until they die off. But in Japan, that doesn't happen, because if one elderly farmer dies, his voting power just shifts to his equally elderly neighbors. Eventually, there will just be one 110 year old rice farmer in Shiname-Ken that will be able to out-vote everyone in greater Tokyo.

    Dont they have Censuses and redistricting?

    The US is sitting on a shitload of oil. it can become a resource based economy exporting oil. It doesnt need to be service based. It also has a lot of farmland which can grow way more crops than can be eaten here so the same can be exported. Teriary and Secondary are not the only choices , you can be a primary economy i.e. a resource exporting economy too. There will always be jobs for tractor repairmen and mining machinery operators.
